FIFA's Competence to Enforce FFAR
- FIFA has competence to enforce further provisions of the FFAR, including imposing sanctions for behavior in violation of the FFAR.
- This competence is triggered by conduct connected to an international transfer or international transaction, regardless of the existence of a contractual dispute.
Jurisdiction of FIFA and Member Associations
- FIFA has jurisdiction over:
- Conduct connected to a representation agreement with an international dimension.
- Conduct connected to an international transfer or international transaction.
- Member associations are responsible for:
- Enforcing their national football agent regulations.
- Imposing sanctions on any football agent or client that violates national football agent regulations.
- Conduct connected to a representation agreement without an international dimension.
- Conduct connected to a national transfer or national transaction.
Introduction of National Football Agent Regulations
- Member associations must implement and enforce national football agent regulations by 30 September 2023.
- National football agent regulations will apply to all representation agreements that have no international dimension.
- FIFA will provide templates for national football agent regulations on www.fifa.com/legal.
- Member associations must provide a copy of their domestic regulations to FIFA in one of the official FIFA languages.
Existing Representation Agreements
- Existing representation agreements will remain valid until their natural expiry and may not be extended.
- New representation agreements or renewals of existing representation agreements concluded after the FFAR are approved must comply with the FFAR as from 1 October 2023.
- Any person who has entered into an existing representation agreement must obtain a licence pursuant to the FFAR to continue providing football agent services as from 1 October 2023.
Entry into Force of FFAR
- The FFAR will enter into force on 9 January 2023 for articles 1 to 10 and articles 22 to 27.
- The remaining articles will enter into force on 1 October 2023.
- As from 1 October 2023, any individual who provides football agent services to a client must hold a licence issued by FIFA in accordance with the FFAR.
Football Agent Working Group
- FIFA will establish a Football Agent Working Group composed of representatives of professional football stakeholders and agent organisations.
- The Working Group will act as a permanent consultative body in relation to any football agent-related matters.
