Dismissal vs Redundancy
- Dismissal is when an employee is terminated due to misconduct or unsatisfactory performance
- Redundancy occurs when a role (not an employee personally) is no longer required by the employer
- These are both methods of employment termination, but differ in their reasons
Unfair Dismissal Reasons
- Being pregnant or on maternity leave
- Taking time off for family reasons
- Acting as an employee representative, trade union representative, or occupational pension scheme trustee
- Having joined or not joined a trade union
- Working part-time or on a fixed-term contract
- Reporting wrongdoing at work (whistleblowing)
Summary Dismissal
- An employee can be dismissed immediately for gross misconduct, such as violent behaviour
- An employer should still carry out a proper investigation before making the dismissal
- Another substantial reason - such as an employee being sent to prison, losing their license to drive a business or work
