  • NEP (Pollution abatement In Industries And Facilities Generating Waste) Regulations
  • National Environmental Standards and Regulations Enforcement Agency Act 2007 (NESREA Act)
  • Nigeria's Challenges in Environmental Assessment
  • SPESSE Response to address these challenges

Brief Historical Background of EIA in Nigeria

  • Environmental consciousness and need for environmental protection.
  • 'Koko Toxic Dump' in the then Bendel State in 1987
  • Led to the creation of the Federal Environmental Protection Agency (FEPA) by decree 58 of 1988 (amended by Decree 59 of 1992)
  • FEPA produced sectoral and procedural guidelines for carrying out EIA in Nigeria
  • FEPA is now absorbed into the Federal Ministry of Environment since its creation in 2003
  • States were encouraged to establish their own (S)EPA under decree 59 of 1992

Nigeria's EIA Systems

  • EIA Decree 86 of 1992 made EIA a legal requirement for all projects that could harm the environment
  • Department of Petroleum Regulation's (DPR) Environmental Guidelines and Standards (EGAS) of 1991
  • Town and Country Planning Decree 88 of 1992 also made EIA a requirement for estate and property development

The National Policy of the Environment of 1989, revised in 1999 and 2016

  • National Policy on Environment (1989, revised 1999 and 2016) provides a viable national mechanism for cooperation, coordination and regular consultation for harmonious management of the policy formulation and implementation process
  • 2016 revision defined a holistic framework for the management of the environment and natural resources for sustainable development in the country

Objectives of the Policy

  • Secure a quality environment adequate for good health and well being
  • Conserve the environment and natural resources for the present and future
  • Raise public awareness and promote understanding of the essential linkages between the environment and development
  • Restore, maintain and enhance ecosystems and ecological processes
  • Co-operate with other countries, international organizations, and agencies to effectively prevent trans-boundary environmental degradation

The Environmental Impact Assessment Act No. 86, 1992 (FMEnv)

  • EIA Act (now revised as EIA Act CapE12 LFN 2004) is mandatory for all projects.
  • EIA process applied to all major development projects throughout the planning stage
  • All agencies and institutions (public and private) except those exempted by the Act, must apply to the Federal Ministry of Environment before embarking on any project.
  • Provision for all stakeholders (agencies, public, experts, NGOs, communities) to be notified, consulted, or given an opportunity to make comments on the EIA prior to approval or disapproval

Objectives of the Act

  • Decision taken before the undertaking of any activity likely to affect the environment
  • Implementation of consistent policy for Federal, State, and Local Government areas
  • Encouragement of information exchange, notification, and consultation between different bodies in any activity

Degree of Environmental Significance and Mandatory Activities

  • Environmental effects are assessed with a degree of detail commensurate to the significance.
  • Mandatory study categories:
    • Category I projects require a full Environmental Impact Assessment (EIA)
    • Category II projects may only need a partial EIA, focusing on mitigation.
    • Category III projects have essentially beneficial impacts

Cases where environmental assessment is required

  • The proponent of the project
  • Doing an act or thing that commits the government to carrying out a project
  • Making payment or providing financial assistance for a project
  • Disposing of or testing lands for enabling a project
  • Granting approval or taking action to enable a project

Restriction on public or private projects without prior consideration of the environmental impact

  • Public or private sector cannot begin projects without considering their environmental effects at an early stage
  • Projects likely to affect the environment require a proper environmental impact assessment (EIA)
  • All agencies must apply in writing to the Agency before embarking on projects so the activities can be quickly identified and properly assessed

Exceptions to the EIA

  • Environmental assessment not required if a project is listed and the President, Commander in Chief of the Armed Forces, or Council believe the environmental effects are minimal
  • Not required during national emergencies
  • Not required for projects in the interest of public health or safety

EIA Process Flowchart

  • Project proposal and TOR submitted.
  • Initial evaluation, including site verification
  • Review and confirmation of TOR by FMENV
  • Execution of EIA
  • Submission of draft report
  • FMENV review, panel review, and public review
  • Proponent develops final report
  • Approval of EIA report by FMENV; report and certificate are issued

Consultation with the Public

  • Agency gives opportunity to government agencies, public, experts, and interested groups to comment on the project's environmental impact assessment
  • Agency advises the public about;
    • Course of action
    • Mitigation measures
    • Report recommendations
    • Follow-up program

Disclosure of the Mandatory Report (EIA)

  • Agency publishes a notice after EIA report is received, containing;
    • Date of public availability
    • Location where copies can be retrieved
    • Deadlines and addresses for filing comments
  • Agency makes report available to public after review

Transboundary Effects

  • If a project outside Nigeria or on Federal Lands may cause adverse international environmental effects, an international review panel may be established

Penalties

  • Any person failing to comply with Decree provisions is guilty of an offense and faces fines (individual and corporate) and/or imprisonment

The National Environmental Standards and Regulations Enforcement Agency Act 2007 (NESREA Act)

  • NESREA Act replaced the 1988 Federal Environmental Protection Act
  • Vision: Cleaner and healthier environment for Nigerians
  • Mission: Inspire personal and collective responsibility for a sustainable environment
  • Mandate: Enforcing environmental laws, guidelines, policies, standards, regulations, international agreements, and treaties

Sector Guidelines

  • NESREA has issued sector guidelines since 2009 covering various areas (e.g., wetlands, river banks, waste control, etc.)

The National Effluents Limitations Regulations of August 1991

  • Mandates anti-pollution equipment, effluent treatment, maximum effluent limits, and penalties
  • Includes best available/practical technology for effluent standards
  • First Schedule lists waste water parameters for different industries.
  • Second Schedule provides effluent limitation guidelines
  • Third Schedule lists gaseous emission guidelines

The National Environmental Protection (NEP) Regulations

  • Defines limits for hazardous release into air, water, and land
  • Requires discharge monitoring reports each month.
  • Permits necessary for disposing of hazardous toxic waste

The Management of Solid and Hazardous Wastes Regulations (1991)

  • Objectives include identifying hazardous wastes, surveillance, record keeping, and waste management.
  • Includes handling and managing solid, radioactive, and infectious hazardous waste.
  • Defines objectives of management

The National Environmental (Air Quality Control) Regulation, 2014

  • Aims for improved air quality, protecting flora, fauna, and public health.
  • Powers given to the agency include entering and sealing facilities that violate regulations.
  • Convictions result in fines and/or imprisonment.

Challenges Relating to Operationalization of National Environmental Regulations

  • Difficulties with proper EIA policies and environmental legislation
  • Lack of effective enforcement and public awareness regarding regulations
  • Lack of enforcement tools, limited capacities among stakeholders
  • Politicization of environment which views it as a privately owned resource

The Way to Move Ahead

  • Increased awareness creation, collaboration & synergy among relevant institutions and stakeholders.
  • Stronger enforcement, skilled manpower
  • Cooperation with various agencies

SPESSE Project Appraisal Document

  • Delays in E&S management instrument implementation
  • Lack of compliance with ESMPs, etc.
  • Inadequate capacity and monitoring among client institutions
  • Need to improve technical capacity

SPESSE Interventions

  • Improving the quality of environmental management instruments and implementing capacity.
  • Strengthening client capacity including labor, gender violence assessment, health, safety, and risks.
