    Land Acquisition, Restrictions on Land Use and Involuntary Resettlement

    • ESS5 recognizes that project-related land acquisition and restrictions on land use can negatively impact communities and individuals.
    • Project-related actions can cause physical displacement (relocation, loss of homes), economic displacement (loss of land, assets, income), or both.
    • "Involuntary resettlement" describes these impacts, occurring when affected people or communities lack the right to refuse land acquisition or use restrictions leading to displacement.
    • Physical and economic displacement, if unmitigated, creates severe economic, social, and environmental risks (disrupted production, impoverishment, loss of skills, weakened communities).
    • Involuntary resettlement should be avoided whenever possible.
    • When unavoidable, involuntary resettlement should be minimized, and measures to mitigate adverse impacts on affected people and host communities should be planned and implemented carefully.
    • Avoidance of resettlement is preferred, but may not be possible in cases involving public health or safety risks, or where resettlement offers development opportunities for communities.     Scope of Application

    • The applicability of ESS5 is determined during the environmental and social assessment (ESS1) procedures.
    • ESS5 applies to permanent or temporary physical and economic displacement caused by land acquisition or restrictions on land use (expropriation, negotiated settlements, restrictions on land use and access to natural resources, including legally designated protected areas, forests, or biodiversity areas).
    • ESS5 does not apply to impacts on income or livelihoods unrelated to project-imposed land acquisition or restrictions.
    • ESS5 does not apply to voluntary land transactions where the seller retains the right to refuse and is fully informed.
    • The document outlines specific situations where ESS5 does not apply (e.g., land use planning, refugee management, natural disasters, conflict, crime or violence, community-based natural resource management, disputes between private parties, etc). Also, ESS5 does not apply to disputes between private parties in land titling or related matters.

    Project Design

    • The Borrower must limit involuntary land acquisition and restrictions to clearly defined project requirements and timeframes.
    • Feasible alternatives to avoid or minimize displacement should be considered, especially where displacement would result in physical or economic displacement.
    • Environmental, social, and financial factors must be balanced. Options (and their impacts), for project design should be considered, particularly if they affect gender or the needs of vulnerable people. This should also include considering feasible alternatives to avoid minimizing land acquisition.

    Compensation and Benefits for Affected Persons

    • Compensation will be provided at replacement cost for acquired land or assets, including transaction costs. Compensation should be sufficient for replacement housing if necessary, covering all reasonable and necessary costs.
    • Additional assistance will be provided to help restore pre-displacement livelihoods and living standards, including livelihood improvement programs where necessary.
    • Consistent compensation standards for various land and asset categories must be applied. This includes determining replacement cost based on market value, or appropriate alternative methods in areas with limited functioning markets, considering individual needs and situations. Compensation includes administrative fees, registration fees, reasonable moving costs and similar related costs.
    • In specific instances (e.g., relocation to replacement land, assets, assistance with livelihood restoration, cash compensation), alternative measures beyond compensation may be implemented for affected persons, including compensation for lost income and assistance with business relocation or re-establishing commercial activities. Contingency funds may be deposited in an interest-bearing account to provide compensation to affected persons until any outstanding issues are resolved.

    Community Engagement

    • Affected communities, including host communities, will be engaged actively through stakeholder engagement processes described in ESS10.
    • Affected people should have meaningful participation in decision-making processes related to resettlement, livelihood restoration, and alternative project design considerations. Consultations and disclosure of relevant information throughout planning, implementation, and monitoring are required.
    • Women's concerns and perspectives must be included in consultations and planning, and their preferences regarding compensation mechanisms (cash or in-kind) should be considered, and their livelihoods protected.

    Grievance Mechanisms

    • The Borrower should establish a grievance mechanism to address concerns about compensation, relocation, or livelihood restoration measures from affected persons promptly and effectively.
    • These mechanisms (which can utilize existing systems when possible) should be provided to the affected people in a fair and impartial manner, including specific arrangements for disputes.

    Displacement (Physical)

    • Physical displacement planning covers requirements applicable to any number of displaced persons, factoring in potential impacts on livelihood and living standards, and including a detailed resettlement budget and schedule.
    • Plans will mitigate displacement's negative effects (including providing resettlement options, or cash compensation, and relocating impacted groups to appropriate destinations with equivalent living standards).
    • New resettlement sites will offer living standards comparable or better than previous conditions for displaced persons, taking into consideration existing codes and standards. This will include consideration for potentially impacted communities.
    • Preferences for relocation destinations will be considered, and existing social and cultural institutions respected wherever possible, including existing community groups and practices.

    Economic Displacement

    • Economic displacement plans support income and livelihood restoration or improvement for all affected persons, including those who may have lost assets.
    • The mitigation of economic displacement is considered complete when affected persons have received all appropriate assistance, and have the means to re-establish livelihoods.
    • This includes compensation for lost income during the period of transition, assistance with business relocation, and support for re-establishing commercial activities. This support will include compensation for both direct and indirect losses associated with economic displacement. The costs will be considered a charge against the economic benefits of the project, factoring in appropriate consideration and financial support.

    Collaboration

    • Coordination between project implementation agencies and any other relevant government entities responsible for land acquisition, resettlement planning, and assistance (including host community involvement) is essential.
    • Where the capacity of other agencies is limited, support for resettlement planning and implementation is required, including capacity building if needed.

    Technical and Financial Assistance

    • The Borrower may seek technical or financial support from the Bank to enhance their resettlement capacity, including support for project planning and implementation.
    • This may include training, policy development, or financing of resettlement plans and related measures, including additional assistance for livelihoods and businesses.
    • Stand-alone resettlement plans or dedicated funding may be requested for projects with significant involuntary displacement needs. Additional mitigation for loss of livelihoods may also be requested, particularly focusing on livelihood support assistance.
