Disability Retirement

  • Sworn members with 10+ years of service may be eligible for disability retirement if their non-duty illness, injury, or medical condition renders them unable to perform their job duties.
  • Sworn members with less than 10 years of service may be considered for separation from the department.

Sick Leave Accrual

  • Sworn members appointed prior to November 16, 1987, accrue 20 hours/month (Option I) or 12 hours/month (Option II).
  • Sworn members appointed on or after November 16, 1987, accrue 12 hours/month.
  • Non-sworn members appointed prior to November 1, 1987, accrue 10 hours/month.
  • Non-sworn members appointed on or after November 1, 1987, accrue 8 hours/month.

Sick Leave Accrual Timing

  • Members appointed on or before the 15th day of the month accrue sick leave for that month.
  • Members appointed after the 15th day of the month do not accrue sick leave for that month.
  • Members who retire, resign, or are terminated, and their last day on payroll is:
    • Prior to the 15th day of the month, will not accrue sick leave for that month.
    • On or after the 15th day of the month, will accrue sick leave for that month.

Sick Leave Use

  • Sick leave may only be used as described in the policy.
  • Members are responsible for having a legitimate need for the use of sick leave.
  • Sick leave is paid leave accrued by and granted to members for absences due to:
    • Own illness or medical condition.
    • Family and Medical Leave Act (FMLA) qualifying event(s).

Return to Duty

  • Prior to returning to full duty, members must:
    • Obtain a medical certification from their healthcare provider regarding their ability to return to work.
    • Present the medical certification to the EBU.
  • The medical certification must include:
    • A statement that the member is able to resume working.
    • A statement that the member can perform all of the essential functions of their position.

Sick Leave Abuse

  • Substantiated abuse of sick leave may result in disciplinary action, up to and including termination.
  • Members may be required to provide satisfactory proof of illness, injury, or medical condition to the EBU.

Other Provisions

  • Members may convert a maximum of 16 hours of accumulated sick leave per calendar year for use as personal leave time (Y).
  • Members on sick leave may engage in any activity at any place the illness or physical condition will permit, as approved by the member's attending physician.
  • Members on sick leave may carry firearms in accordance with the current written directive entitled, "Firearms Procedures."
