Rule 41 Verification of Compliance
- Contracting Parties are subject to periodic audits by the Organization to verify compliance with the Convention.
- The Secretary-General of the Organization administers the Audit Scheme based on guidelines developed by the Organization.
- Contracting Parties are responsible for facilitating the audit and implementing a program of actions to address the findings.
- Audits are conducted at periodic intervals based on an overall schedule developed by the Secretary-General.
Exemptions and Transition Periods
- Repositioning of masthead lights due to Annex I Section 2(b) is exempted until nine years after the date of entry into force of these Regulations.
- Repositioning of sidelights due to Annex I Section 2(g) and 3(b) is exempted until nine years after the date of entry into force of these Regulations.
- Requirements for sound signal appliances in Annex III are exempted until nine years after the date of entry into force of these Regulations.
- Repositioning of all-round lights due to Annex I Section 9(b) is permanently exempted.
Definitions and Audit Scheme
- An audit is a systematic, independent, and documented process for evaluating compliance with audit criteria.
- The Audit Scheme is the IMO Member State Audit Scheme established by the Organization.
- The Code for Implementation is the IMO Instruments Implementation Code (III Code) adopted by the Organization.
- The Audit Standard is the Code for Implementation.
Application and Execution
- Contracting Parties shall use the provisions of the Code for Implementation in executing their obligations and responsibilities contained in the present Convention.
Exemptions for Vessels
- Vessels (or class of vessels) with keel laid or at a corresponding stage of construction before the entry into force of these Regulations may be exempted from compliance.
- Exemptions include installation of lights with ranges prescribed in Rule 22, repositioning of lights due to conversion from Imperial to metric units, and repositioning of masthead lights on certain vessels.
