Constitution and Supremacy
- The Constitution is a written instrument that establishes, limits, and defines the fundamental powers of the government.
- It distributes powers among several departments or branches for the benefit of the people.
- The Constitution is the basic and fundamental law of the land, and all other laws must conform to it.
- Any law or contract contrary to the Constitution shall be considered void.
Exclusionary Rule
- Evidence obtained in violation of Section 3 shall be considered as the “fruit of the poisonous tree” and is inadmissible for any purpose in any proceeding.
Freedom of Expression
- No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances.
- Protected speech includes every form of expression, whether oral, written, tape or disc recorded, including motion pictures and symbolic speech.
- Peaceful picketing is also included within the meaning of speech.
Citizenship
- Citizenship is a membership of a citizen in a political society, which membership implies, reciprocally, a duty of allegiance on the part of the member and duty of protection on the part of the State.
- Citizens of the Philippines enjoy full civil and political rights.
- The following are citizens of the Philippines:
- Those who are citizens of the Philippines at the time of the adoption of this Constitution
- Those whose fathers or mothers are citizens of the Philippines
- Those born before January 17, 1973, of Filipino mothers, who elect Philippine citizenship upon reaching the age of majority
- Those who are naturalized in accordance with law
- Natural-born citizens are those citizens who at the moment of their birth are already citizens of the Philippines, and do not have to perform any act to acquire their Philippine citizenship.
Filipino First Policy
- The State shall give preference to qualified Filipinos in the grant of rights, privileges, and concessions covering the national economy and patrimony.
- The term "qualified Filipinos" means people with credible competence and efficiency who can make a viable contribution to the common good.
Public Utility
- The term "public utility" is defined under Commonwealth Act no. 146 Section 13 (b) as every person that owns, operates, manages, or controls public services in the Philippines for hire or compensation.
National Talents
- The State shall promote the sustained development of a reservoir of national talents consisting of Filipino scientists, entrepreneurs, professionals, managers, high-level technical manpower, and skilled workers and craftsmen in all fields.
