Purpose
- Establish guidelines for effective response to reports of child pornography possession, transmission, and production
- Guidelines also cover solicitation and/or exploitation of children involving computers
Policy
- Bexar County Sheriff’s Office aggressively investigates reports of child exploitation and victimization
- Responds to:
- Public complaints
- Referrals from law enforcement, businesses, government divisions (schools, libraries), and reputable agencies
- Full cooperation with other agencies for investigations, both reactive and proactive (undercover operations)
Procedure
- Bexar County Sheriff’s Office employees are prohibited from producing, receiving, possessing, or distributing child pornography unless during an official investigation
Investigations
- Complaints from citizens, businesses, public agencies, or law enforcement are referred to the investigator in charge and their supervisor
- If investigator or supervisor unavailable, responding officer obtains information, completes a supplemental report, and sends it to the investigating officer
- Officers discovering child pornography on any media should not let anyone disturb evidence
- No one, including other peace officers, should alter the computer or its power source
- Suspects will not be allowed to disturb or remove electronic media or items containing data
Investigator Responsibility
- Investigator should ascertain necessary information from the complainant to prioritize the case and response
- Investigator should advise the reporting party not to alter or change the status of the computer in any way (do not turn it off, close programs, or otherwise touch the computer or its power source)
- Contact the Sex Crimes Division and complete a supplemental report containing all pertinent information without delay
- Investigations involving child exploitation and computers are coordinated with the investigator in charge and involve direct supervisory oversight
- Undercover investigations are subject to guidelines prescribed by the Internet Crimes Against Children (see attachment), and require pre-approval by the Chief of Investigations or their designee
- Any investigation involving child pornography should be brought to the attention of the investigating officer’s direct supervisor
- Conducting an investigation involving illegal distribution or possession of child pornography from home, or any location that is not pre-approved, is not permissible
