Bexar County Sheriff's Office Policy Manual - Deputy Involved Shootings and Custodial Deaths
- Policy Purpose: To detail procedures for investigating incidents involving Sheriff's Office personnel, particularly those involving deadly force or serious injury/death.
- Scope: Covers Deputy-involved shootings, deaths during custody, and serious injuries during arrests or while incarcerated.
- Exclusions: The policy does not cover justified shootings at ranges, training facilities, or during lawful hunting. Also excludes accidental shootings.
- Incident Notification: Deputies involved in officer-involved shootings (OIS) or deaths in custody must immediately notify their supervisor and secure the scene.
- Scene Safety: A supervisor is dispatched to secure the scene, ensure the safety of all involved, and summon medical aid if necessary.
- Medical Assistance: If a deputy is injured, medical personnel are to be summoned, and the deputy's family notified immediately.
- Family Notification: Family assistance officers (FAO) are assigned to assist families during emergencies.
- Investigative Measures: The involved deputy's weapons, spent casings, and gear are to be secured and documented; audio/video recordings are to be preserved.
- Photography: Photographs and videos are to be taken of the scene and any evidence.
- Medical Personnel: Efforts should be made to ensure that if the situation requires it medical personnels have taken proper precautions.
- Incident Details: Supervisors will obtain details including the number and direction of shots fired, locations of victims, witnesses, and any discovered evidence.
- Deputy Rights and Restrictions: Deputies are advised of their right to legal counsel, and are not to discuss the incident with others except for designated personnel.
- Investigative Confidentiality: Investigators will not disclose potentially sensitive information.
- Toxicology Testing: Toxicology screenings are restricted to fatal incidents.
- Bloodborne Pathogen Exposure: Any blood exposure must be documented, and decontamination procedures followed.
- External Agencies: Other agencies with jurisdiction may be involved in the investigation.
- Administrative Leave: Involved deputies are placed on administrative leave, with pay, for approximately 5 working days.
- Investigation Team: The Criminal Investigations Division (CID) will assemble an investigative team to investigate all officer-involved shootings and custodial deaths.
- Internal Affairs: Internal Affairs and Public Integrity units will also investigate independently, focusing on policy adherence.
- Confidentiality: During investigations all documents, information, and evidence will be preserved until conclusion of any associated cases (criminal or civil action).
- Privacy: Personal information of involved parties will be protected.
