  • Policy Purpose: To ensure adherence to international and state law requirements regarding foreign nationals, diplomats, and consular interactions, and to comply with the Vienna Convention on Consular Relations.
  • Law Enforcement Procedures:
    • Deputies are not to use race, national origin, citizenship, or ethnicity in law enforcement actions, except to identify a suspect.
    • Custodial arrests of foreign nationals require supervisor approval; the assigned TAG Follow-Up unit investigator must notify the supervisor prior to the arrest.
    • Deputies making arrests will complete a BCSO Form #350-479.
    • Deputies should avoid bias-based profiling based on national origin, immigration status, ethnicity or race when conducting investigations.
    • Documentation of incidents involving foreign nationals is critical.
    • If a suspect claims diplomatic or consular immunity, deputies must verify the status and immediately notify their supervisor.
  • Consular Notification:
    • Deputies must notify the relevant consulate when a foreign national is arrested or detained for more than four hours.
    • The foreign national has the right to request consular notification.
    • Deputies must use BCSO Form #350-477 for consular notification.
