Bexar County Sheriff's Office Policy on Enforcement of Immigration Related Laws

- Supersedes: Previous policy
- Effective Date: March 19, 2024
- Policy Purpose: To ensure adherence to international and state law requirements regarding foreign nationals, diplomats, and consular interactions, and to comply with the Vienna Convention on Consular Relations.
- Law Enforcement Procedures:
- Deputies are not to use race, national origin, citizenship, or ethnicity in law enforcement actions, except to identify a suspect.
- Custodial arrests of foreign nationals require supervisor approval; the assigned TAG Follow-Up unit investigator must notify the supervisor prior to the arrest.
- Deputies making arrests will complete a BCSO Form #350-479.
- Deputies should avoid bias-based profiling based on national origin, immigration status, ethnicity or race when conducting investigations.
- Documentation of incidents involving foreign nationals is critical.
- If a suspect claims diplomatic or consular immunity, deputies must verify the status and immediately notify their supervisor.
- Consular Notification:
- Deputies must notify the relevant consulate when a foreign national is arrested or detained for more than four hours.
- The foreign national has the right to request consular notification.
- Deputies must use BCSO Form #350-477 for consular notification.
- Foreign embassies'/consulates' fax numbers should be readily available and current.
Additional Details
- Diplomatic Immunity: A diplomatic passport does not automatically grant immunity.
- Training: All deputies must undergo training in immigration-related laws, diplomatic immunity, and consular notification procedures.
