- After declaring a development area under section 42A, the State Government must constitute an Area Development Authority (ADA) for that area by notification in the Official Gazette.
- The ADA is a body corporate with perpetual succession, a common seal, and the power to acquire, hold, and dispose of property.
- The ADA consists of various members including the Guardian Minister, Zilla Parishad Presidents, Mayors, Municipal Commissioners, Collectors, Chief Executive Officers, Chief Engineer, and Settlement Commissioner.
- The State Government may appoint a government company or any other agency, authority, company, or corporation as the ADA instead of constituting one.
- The ADA is bound by the directions and instructions of the Metropolitan Planning Committee or District Planning Committee within whose jurisdiction the development area is situated.
- Disputes between the ADA and the Metropolitan Planning Committee or District Planning Committee are referred to the State Government for resolution.
- The ADA's powers and functions include preparing and executing town planning schemes, controlling development activities, levying and collecting fees, entering into contracts, acquiring property, executing works, and exercising other powers and performing other functions as directed by the State Government.
