New Town Development

  • The State Government can designate an area as a site for a new town if it is considered expedient in the public interest.
  • The designated area will be known by the name specified in the notification.
  • A New Town Development Authority will be constituted by the State Government to acquire, develop, and dispose of land in the area.

Composition of New Town Development Authority

  • The Authority will consist of a Chairman, a Vice-Chairman, two members representing local authorities, and up to seven members with special knowledge or experience in town and country planning.
  • The Chairman, Vice-Chairman, and other members will be appointed by the State Government.
  • The Chief Executive Officer will be the Secretary of the Development Authority.

Alternative Development Authority

  • In cases where the development work is complex and requires speed, the State Government may require the work to be done by a corporation or company set up for the purpose of developing a new town.
  • Such corporation or company will be declared by the State Government to be the New Town Development Authority for that area.

Powers and Functions of Development Authority

  • Every Development Authority will be a body corporate with perpetual succession and a common seal.
  • The Authority will have the power to acquire, hold, and dispose of property, and contract and sue or be sued.
  • The Authority will have all the powers and duties of a Planning Authority under this Act, including those related to Chapters III and IV.
  • The Authority will carry out its objects and follow the necessary procedures under this Act.

Acquisition of Land

  • The State Government can acquire land for the development of a new town through agreement or under the Land Acquisition Act, 1894.
  • The acquired land will be vested in the New Town Development Authority for the purposes of this Chapter.

Development Authority Objects and Powers

  • The objects of a Development Authority are to secure the laying out and development of a new town in accordance with approved proposals under this Act.
  • A Development Authority has the power to acquire, hold, manage, and dispose of land and other property, and to carry out buildings and other operations.

State Government Directions

  • The State Government may give directions to a Development Authority for restricting the exercise of its powers or requiring it to exercise them in a specified manner.
  • Before giving directions, the State Government must consult with the Chairman or Vice-Chairman of the Development Authority, unless it is impractical to do so due to urgency.

Development Authority Proposals

  • A Development Authority must submit proposals for the development of land within the designated site of the new town to the State Government.
  • The State Government may approve the proposals with or without modifications.

Land Acquisition

  • A Development Authority has the power to acquire land for the development of the new town.
  • The Development Authority may acquire land adjacent to the designated site or elsewhere for the provision of services and amenities.

Disposal of Land

  • A Development Authority may dispose of land, but must prioritize the sale of land to persons living or carrying on business on the land, subject to the Development Authority's requirements.
  • The Development Authority must ensure that the disposal of land is done in a manner that secures the development of the new town according to approved proposals.

Directions for Disposal of Land
