Procedure for Arrestees with Dependents
- When taken into custody with a dependent:
- If another adult is present, the arrestee may place the dependent in their care.
- If no adult is available, the dependent will be transported to headquarters, either with the arrestee or separately based on circumstances, following department policy.
- Arrestees should have a reasonable opportunity to make phone arrangements; if unable, an officer will assist in notifications.
- If arrangements are unfeasible, the supervising officer must notify an appropriate agency about the arrest and the need for alternate care.
- Records must be created, including:
- Name of the person or agency taking charge of the dependent.
- Contact information for the agency’s representative.
- Details on how the arrestee can regain custody post-release.
- Shift supervisors or arresting officers will promptly contact a judge regarding bail and inform them of the situation and arrangements made.
Procedure for Extended Detention
- If detaining the arrestee for more than two hours:
- The arrestee must be questioned about any dependents reliant on their care.
- Similar to the previous procedure, the arrestee should have a reasonable chance to make arrangements and be assisted if needed.
- Notify the appropriate agency if arrangements cannot be made.
- Arrestee must be informed about the care arrangements that have been established.
- Maintain detailed records similar to those required for shorter detentions, including mandatory contact information and custody regaining details.
- The supervising officer will also contact a judge for bail setting and to report on the arrangements.
