OFFICE OF THE CHIEF OF POLICE NOTICE 2.2.7 December 30, 2014 TO: All Concerned Personnel FROM: Chief of Police SUBJECT: UNIFORMED CRIME REPORTING RESPONSIBILITIES AND PROCEDURES - ESTABLISHED PURPOSE: This Notice establishes Department responsibilities and procedures for the classification of crimes in accordance with the Federal Bureau of Investigation(FBI) Uniform Crime Reporting (UCR)Program. Consistent with our Core Values and a high regard for the public trust, this Notice is intended to emphasize the importance of statistical accuracy. Finally, this Notice supersedes previous directives where any conflict may exist. BACKGROUND: Pursuant to California Penal Code §13020, the California Department of Justice(CAL DOJ)is mandated to collect all crime, arrest and clearance information on the offenses of homicide, rape, robbery, aggravated and simple assault, burglary, larceny-theft, motor vehicle theft and arson from every law enforcement agency in California. The CAL DOJ has established that the information collected on these offenses be in accordance with the guidelines set forth under the FBI UCR Program. PROCEDURE: All concerned personnel shall continue to title crime reports (i.e., Investigative Reports and arrest reports) based on the appropriate California Penal Code Section. It shall be the responsibility of the Watch Commander to review the narrative and Modus Operandi(MO)of each report and to determine the correct UCR Crime Class(CC)code. The Watch Commander or other concerned personnel as indicated below shall review the narrative and MO of each report to determine which UCR CC code best reflects the crime reported and shall be responsible for entering that code directly on the IR or arrest report. Personnel shall utilize the UCR Summary Reporting System User Manual (2013), the Los Angeles Police Department Guidelines to Uniform Crime Reporting and the Consolidated Crime Analysis Database(CCAD)Code Manual to enter the appropriate UCR CC code on the Investigative Report(IR) or arrest report. These manuals and guidelines are available on the COMPSTAT page of the Local Area Network(LAN). All Concerned Personnel Page 2 2.2.7 Officer's Responsibilities: Based upon a thorough investigation, the reporting officer shall: • Title IRs and arrest reports based on the appropriate California Penal Code Section,(e.g., Robbery, Burglary); and, • Include all elements of the crime in the report narrative. Watch Commander's Responsibilities: The Watch Commander shall maintain the primary responsibility for the proper UCR classification of reports. Watch Commanders should be diligent in the review of all IRs and arrest reports to ensure that each report contains the necessary elements of the specific crime reported and that the title is based on the appropriate California Penal Code Section. The Watch Commander shall: • Review the IR or arrest report and select the appropriate decision tree (see attached); • Apply the facts in the IR or arrest report narrative to the applicable decision tree to determine the primary UCR CC code; and, • Write the Primary UCR CC code directly above the Incident Number field (INC#)on the IR, or directly above the DR Number field(DR)on the arrest report face sheet. Note: The primary UCR CC code is based on the highest UCR offense under the UCR Hierarchy Rule,(See UCR Summary Reporting System User Manual, Chapter 1, Page 23 available on the LAN). Records Unit's Responsibilities: Area/divisional Records Unit and Records and Identification (R&I) Division supervisors shall ensure adherence to the guidelines as set forth in this section. Area/divisional Records Unit and R&I Division personnel shall: • Enter the primary UCR CC Code in CCAD on the first crime class code field as written on the IR or arrest report by the Watch Commander; and, • Review the title of the IR or arrest report to determine if additional CC codes are required in the 2",3rd and/or 4th designated CCAD crime class code field(s). Note: The Watch Commander shall determine the proper crime title and primary UCR CC code prior to submittal to the Area Records Unit. If no primary UCR CC code has been written on the IR or arrest report, Area Records personnel shall return the report to the Watch Commander for the required UCR CC code. All Concerned Personnel Page 3 2.2.7 Detective Supervisor's Responsibilities: To help ensure accuracy in UCR CC code reporting, Detective Table Coordinators shall be responsible for an additional level review. Prior to assignment, the Detective Table Coordinator shall: • Review the IR or arrest report to ensure that the title is based on the appropriate California Penal Code section and correctly classified in accordance with the UCR Program; and, • Complete and submit a Follow-Up Investigation, Form 3.14, to reclassify reports that have been incorrectly titled per the California Penal Code or misclassified per the UCR program in compliance with Office of Operations Order No. 5, dated August 5, 2013. Note: It shall be the sole responsibility of the Principal Records Clerk or designee to reclassify reports in the Area Records Unit.
