This assessment consists of direct questions and problem type scenario questions. (scenarios are fictitious). 2. It is compulsory that you answer all questions. 3. Miss Mercy Banda (28years old) witnessed the shooting that killed one of the taxi drivers at the Govan Mbeki taxi rank in September 2023. Her statement was collected, and she has been considered the most credible eyewitness. Mercy was going to attend the trial at the Port Elizabeth High Court to testify as an eyewitness to the shooting. On the day that she witnessed the shooting (in September 2023), Mercy was coming from the hospital where she had been informed that she is one month pregnant. The trial where she is meant to testify is scheduled for 15 May 2024. Unfortunately, this is the same day that Mercy is meant to give birth. She will not be able to attend court to give her oral evidence. Jack is the investigating officer who took her statement in September 2023. Jack confesses to you that he was not attending any of his JTR101 lectures therefore he forgot the conditions that must be met for contents of a written statement to be admissible without the witness attending court to give oral evidence. a. Since you are currently studying JTR101, fully explain to Jack what these conditions are and what Jack needs to do to have Mercy’s written statement admitted in court since she will not be present in court. Any examples you make must relate to the scenario provided above. Mercy instructed Jack that if he chooses to call the landline, she uses at home then Jack should speak in English because that is the common language everyone in Mercy’s family (household) speaks since her mother is Xhosa, her father is from Zambia, she lives with 2 cousins that only speak English and French. It turns out that the shooting was gang related and Mercy is now hesitant to give her statement is a witness because she fears that she or her baby may be in danger because she gave information to law enforcement. There are several methods that can be used to encourage a witness to provide information during an interview. State any three of these methods and provide a practical example (for each method you stated) that would explain of each method you stated. Your examples must be relevant and related to the scenario give in Question 1. Pg 13-16 2. In the PE hospital, the rates of newborn babies, dying in the nursery has become very high and concerning. In every 10 babies that are born alive, and average of only four babies manage to leave the hospital alive. The other six die in the hospital nursery and the explanations given for their deaths is very suspicious. The head nurse (Nurse Dorothy) decides to investigate to see if the problem is with the hospital staff or that the problem is that the babies are dying because their mothers had contracted COVID-19 at any time between 2020 and 2022. After checking the shift roster of the nurses responsible for newborn babies, nurse Dorothy notices that every shift that nurse Kelly is on duty, at least three babies die. What is most strange about this is that when these babies die nurse Kelly is alone in the nursery. Mr. Dorothy is scared that this may all be a coincidence, so she does not want to falsely accuse Nurse Kelly for killing the babies. You are with Dorothy, and she tells you that she wants to interrogate Nurse Kelly to gain information. You know that Dorothy is mistaken because what she actually wants to do, is to interview Nurse Kelly. Fully explain the difference between an interview and an interrogation to Nurse Dorothy. Support your explanations with practical examples. Because you are explaining to a nurse, use practical examples that are relevant and related to the scenario so that nurse Dorothy can understand. You are preparing for a JTR101 test 1 and one of your study partners says, “an interview is only a speech event.” You know that this is incorrect because an interview consists of multiple tasks. Provide the multiple tasks that an interview also consists of. Pg21 4. The following section requires you to state whether the statement is TRUE or FALSE. If your answer is false, you must also write the correct answer: a.
