BOCA RATON POLICE SERVICES DEPARTMENT Departmental Standards Directive 71.105 TEMPORARY DETENTION AND PROCESSING FACILITY Revised: March 11, 2022 I. PURPOSE: The purpose of this departmental standards directive is to provide information and guidelines governing the Boca Raton Police Services Department Temporary Detention and Processing Facility. II. POLICY: It is the policy of the Department that temporary detention of persons in custody by law enforcement officers (LEOs) of this department should be no longer in duration than necessary and the detention should be completed in a safe and appropriate manner. III. DEFINITIONS: Physical Structure: The physical confines of the Temporary Detention and Processing Facility (hereby referred to as the “facility”) include the reception area, sally port, holding cells, and related spaces. If used for processing detainees into the detention area, the processing area is also included. Temporary Detention: Detention of a person for the purpose of processing or testing. Temporary detention is measured in hours and does not involve housing or feeding detainees, except in extenuating circumstances. IV. PROCEDURE: A. MANAGEMENT AND ADMINISTRATION: 1. RESPONSIBILITIES: a. Detainees are the responsibility of the arresting LEO and his/her supervisor. b. All employees must be familiar with and adhere to the policies pertaining to the Detainee Processing and Temporary Detention Facility. 22.12 c. All employees will receive a briefing on the facility during field training. 22.12 d. LEOs will receive additional instruction during field training, including fire alarm activation and operation of extinguishers. 22.12 Effective: January 1, 1989 Revised: March 11, 2022 Temporary Detention and Processing Facility Directive No. 71.105 Page 1 of 6 e. 2. LEOs will receive retraining at least once every three years. 22.12 AUTHORIZED ACCESS: a. LEOs who are processing or monitoring detainees shall be the primary users of the facility. b. Civilian employees shall be authorized to enter the facility when required for the performance of his/her duties, e.g., tours, inspections, maintenance. c. Civilian employees and visitors shall not be granted access when detainees are present. d. Tours of the facility shall be scheduled in advance, but all tours will be canceled if there are detainees in the detainee processing and temporary detention areas. Visitors shall never be left alone in the facility. e. The police administrative technician shall schedule all non‐emergency repairs and maintenance at times when these activities will have the least impact on the facilities’ operations and will cancel them if a detainee is present. Workers shall never be left alone in the facility. f. Emergency repairs, fire inspections, and Department of Juvenile Justice (DOJJ) inspections may be carried out if there are detainees present in a manner that will not cause the following: i. Invasion of the detainee's privacy ii. Impediment to processing iii. Any negative effect on an investigation iv. Jeopardy to the integrity of the facility or a negative effect on any safety precautions or detainee's security g. Visitors shall be properly identified prior to entry. h. Department employees escorting maintenance employees shall verify that all tools and materials have been collected and shall ensure that no items have been intentionally or unintentionally left within the facility. i. An inspection of the entire facility shall be conducted by the escorting employees after workers depart and before any other detainees are secured in the repaired area and documented on the Daily Temporary Detention and Processing Facility Inspection form located on the Department Intranet. Effective: January 1, 1989 Revised: March 11, 2022 Temporary Detention and Processing Facility Directive No. 71.105 Page 2 of 6 B. PHYSICAL STRUCTURE: 1. CONSTRUCTION AND DESIGN: a. The Department’s facility was constructed in 1987 and conforms to all City of Boca Raton Building and Fire Codes. b. No additions, structural changes or renovations shall be permitted without approval of City Engineering and the Department of Juvenile Justice. c. Facility Maintenance will conduct periodic inspections to ensure that minimum standards are being maintained. d. Defective equipment shall be replaced or repaired immediately as soon as practical, unsanitary conditions shall be documented for cleaning, and pest control services shall be called as needed. e. Detainees have access to a toilet and drinking water. f. Video monitoring equipment shall be positioned to protect detainees’ privacy. 22.06 C. SAFETY AND SANITATION: 1. FIRE AND SAFETY: a. Evacuation routes for emergency situations are posted in the facility along with fire equipment that shall be readily accessible to all employees. 22.02 b. Fire extinguishers are mounted in the following locations approved by the Boca Raton Fire Rescue Services Department, normally out of sight of detainees, but easily accessible to LEOs: i. Sally Port ii. Supply Closet iii. Restroom c. In case of a fire, smoke, or suspicion of a fire, LEOs will adhere to the following procedures: 22.02 i. LEOs shall evacuate all detainees via posted routes to safe locations outside the building to patrol vehicles or the detainee transport van. ii. The watch commander on duty will designate a location to relocate the detainees. Boca Raton Fire Rescue Services Department (BRFRSD) shall be called. iv. If feasible, Department employees will attempt to safely extinguish or contain the situation. v. No detainee shall be permitted to return to the facility until the BRFRSD has inspected the area and rendered it safe. 2. DISTURBANCES: 22.02 a. In the event of a major disturbance, the LEO in the facility shall notify Communications Section employees of the situation via radio or panic button and request additional assistance as required. 3. INSPECTIONS: a. The watch commander or his/her designee shall conduct daily inspections for cleanliness and to determine if any unsafe conditions are developing. b. The watch commander or his/her designee shall conduct a weekly documented inspection of the facility, which will ensure the following: i. No tampering, damage, or blocking of the sprinkler system has occurred. 22.02 ii. First aid kit and fire extinguishers are charged and in working condition. 22.02, 22.13 iii. Safety devices including panic alarm buttons and the corresponding cameras are functioning properly. iv. Evacuation routes are posted correctly. c. Communications Section employees will visually monitor the facility at all times via video screens and enter any defects noted or suspected in safety systems in the Supervisor Daily Report. d. If employees observe any vermin or pests, he/she shall inform his/her supervisor and the police administrative technician, who shall arrange for pest control services. e. Documented inspections and testing of fire equipment shall be completed annually. 22.02 f. A documented administrative review submitted to the chief of police shall be conducted by the Community Services Division commander or his/her designee annually to ensure that policies and procedures governing the Effective: January 1, 1989 Revised: March 11, 2022 Temporary Detention and Processing Facility Directive No. 71.105 Page 4 of 6 temporary detention are being followed and that the original intent for authorization and use of the facility continues to be adequate for the agency's needs. g. The Department will allow Department of Corrections inspections on request. D. SECURITY AND CONTROL: 1. CLOSED DOORS: a. When not open for granting entrance or egress, the following facility doors will remain closed and locked: 2. i. North and South Sally Port (1 & 2) ii. First (Easternmost) Vestibule (3) iii. Westernmost door to the facility ENTRANCE KEY: a. All LEOs have been issued an entrance key to the facility. b. The combination lock box, located on the south wall in the facility, will house the cell key at all times when it is not in use. c. 3. The spare cell key will be kept in the KeyTrak system. LOGS AND REPORTS: a. The watch commander or his/her designee shall complete the Daily Temporary Detention and Processing Facility Inspection each shift via the electronic inspection form or via the handwritten Inspection Report in the event the electronic system is offline. b. The watch commander or his/her designee shall complete the Weekly Temporary Detention and Processing Facility Inspection once a week via the electronic inspection form or via the handwritten Inspection Report in the event the electronic system is offline. E. INTERVIEW ROOMS: 1. All LEOs will have access to all areas used for interviews. 2. Interview rooms shall be kept clean. 3. Fire prevention equipment and evacuation routes for interview rooms are included and posted in a conspicuous area near the interview rooms. Male, female, and/or juvenile detainees will not occupy the same interview room simultaneously. 5. Under no circumstances shall a juvenile be exposed to adult detainees. This shall include contact between juvenile children and adult parents when both have been taken into custody and are being processed. 22.07 6. If there are adults in the processing area when juveniles are brought in, the adults will be placed in a cell while the juveniles are processed to keep the juvenile separated from adults by sight and sound. 16.03, 22.07 7. If simultaneous interviews of a male, female, or juvenile detainee are necessary, the detainees will not be left in the interview room without a LEO being present or continuous visual monitoring. 8. Detainees shall be provided access to bathrooms and drinking fountains on request. 9. Breaks will be documented on the detainee’s Detainee Observation Log. 10. LEOs will be aware of safety issues whenever interviewing detainees and, if necessary, will be accompanied by a second LEO who will remain near the interview room to intervene on behalf of either the LEO or detainee. 11. Only assigned LEOs and individuals specifically authorized by the assigned LEO may gain access to an occupied interview room to interact with the detainees. 12. If the circumstances warrant, all detainees shall be searched for weapons and/or contraband prior to being detained in an interview room. LEOs will inspect interview rooms for weapons and contraband before and after detainees occupy the room. 13. Detainee(s) being interviewed may be restrained if they become violent, using agency approved restraints and procedures.
