INTRODUCTION The Office of Agricultural Law Enforcement (OALE)-Bureau of Uniform Services (BUS) is one of the greatest allies the Division of Plant Industry (DPI) has in preventing the introduction of plant pests into Florida. Agriculture is second only to tourism of all Florida’s industries and is critical to the economic well-being of the entire State. In order to maintain Florida’s competitive edge with other states and countries, it is of the utmost importance that crop production costs be kept at a minimum. One of the major expenses involved in crop production is the control of plant pests. Pests include insects, diseases, nematodes, snails, and noxious weeds. Officers are the first line of defense against the introduction of pests by land transported plant material into Florida. The dedication and alertness have prevented the introduction of plant pest that could have jeopardized Florida’s agriculture or resulted in expensive eradication or control programs. DPI guidelines remain organized into decision tables. This format is designed to improve the readability and usefulness of the manual. Officers should find it a useful tool in making regulatory decisions. The tables are mainly composed of columns utilizing an “if/then” decision process. Find the table that pertains to the commodity in question, begin with the left column and work to the right on the row that applies to the condition of the shipment or documentation. A single commodity may fall into multiple tables and each table should be reviewed. The initial step in making decisions on the disposition of shipments of plant material lies with the Officers. Whenever a question about a shipment arises and you cannot resolve the problem with use of this manual, contact the DPI personnel listed on Page 3. Keep in mind certifications come in many forms and may not match the examples given in this manual however should include a statement clearly showing our regulation has been met. For example, BGS certification must have a statement that it is “free of snails” but can be on the bill of lading, stamped on the product or on a phytosanitary certificate. The responsibility for making final decisions on the disposition of shipments of plant material may lie with the DPI. We ask you to: 1. Check vehicles for regulated items. 2. Determine certification status. 3. Complete a FDACS 08003 Interdiction Station Report of Plants and Plant Products in Transit for violations or FDACS 08105 Report of Non-Commercial (Homeowner) Plants or Firewood without Certification in Transit from Other States. 4. Scan all passing documents into CTIS and assign to PLANT. Items we do not regulate and therefore we do not need it scanned or need a phone call: Frozen products Smoothie mixes Mulch, commercially packaged Soil, commercially packaged Peat, commercially packaged Dressings Powdered products Fertilizers Soil nutrients/supplements/enhancement Pine bark, commercially packaged Suspended shippers list When shippers are found with regulated plant pests or products they may be suspended from shipping into Florida until the issue is resolved. Usually these are for specific commodities only, for example, poblano peppers, Christmas trees, or crape myrtle plants. Emails are sent from the Import Certification Office when a shipper is added or removed from this list. The list is also posted on our SharePoint, Suspended-Shippers-Report. If you find a suspended shipper has shipped the prohibited product, collect the shipping documentation, and contact the Import Certification Office, Cheryl Jones at 352-258-0811. Further directions will be given at that time. List of items in CTIS The list has been narrowed down to 11 items. Below is the list along with a definition and/or description. Cut Christmas Trees – all cut trees used as Christmas trees but not live potted trees – this would be nursery stock Cut Foliage – all flowers, ferns, and miscellaneous foliage products (including hemp) that are cut and not used as propagative material – this would be nursery stock Firewood – all commercial and non-commercial (homeowner) cut wood intended for burning, homeowner shipments recorded on FDACS 8105 Hay- cut material, usually baled, to be used as livestock feed or for farm purposes Nursery Stock – all commercial shipments of plants and propagative material except non- commercial (homeowner) plants – this would be other-plant Other – Plant – non-commercial (homeowner) plants recorded on FDACS 8105 Pine straw – usually baled or bundled and used for landscape purposes Produce – Domestic – grown in the USA Produce – Foreign – grown in all other countries besides the USA Seed Potatoes –these are for planting, not for consumption – this would be produce Sod -cut grass for planting, usually baled or palletized, to be used in landscaping FDACS 08003 Interdiction Station Report of Plants and Plant Products in Transit A FDACS 08003 shall be completed on all violations of DPI rules or as requested by DPI personnel where follow up is needed. A report should be completed whether the plant products enter the state, travel within the state, leave the state, are confiscated, are destroyed, or returned to the place of origin. All FDACS 08003 forms shall be scanned, daily, into the CTIS system along with supporting documents and assign to PLANT. The most recent version of the Interdiction Station Report of Plants and Plant Products in Transit (FDACS 08003) was revised in January 2021 and can be found on the Department Form Search. FDACS 08105 Interdiction Station Report of Non-Commercial Plants or Firewood without Certification in Transit from Other States A FDACS 08105 should be completed on all incoming shipments of non- commercial (homeowner) plants and firewood permitted to enter the state. For confiscated, destroyed, or returned to the place of origin use FDACS 08003. All FDACS 08105 forms shall be scanned, daily, into the CTIS system along with supporting documents and assign to PLANT. The most recent version of the Interdiction Station Report of Non-Commercial Plants or Firewood without Certification in Transit from Other States-FDACS 08105 was revised in May 2020 and can be found on the Department Form Search. TABLE 1 Guidelines for ALL PLANT AND PLANT PRODUCTS entering Florida Any shipments of plants and/or plant products lacking the following information shall be refused entry or detained until the issue is resolved. Each shipment shall be accompanied with a bill of lading, or other valid documentation which contains the following information: (a) Name and address of shipper or consignor (b) Name and physical address of receiver or consignee (c) Description of plants or plant products in shipment (d) Country or state of origin (e) Ultimate destination or shipment if different than receiver or consignee The bill of lading or other valid document and all attachments shall be in the English language or shall have attached thereto an accurate English translation containing adequate information for examination of the product. Plants and plant products shipped into Florida must be in accordance with all applicable Federal laws, including prohibited or restricted foreign origin plants and plant products that require treatment or the distribution is limited to specific states. We assume all foreign products entered the US with the correct documentation and is approved to proceed. REMINDERS: Do not accept a P.O. Box for receiver, accept physical address only. Description of the product should be a recognized common name or the Latin botanical name. A trade name is not acceptable. Scan all related documents into the CTIS Imaging System and assign to PLANT.
