SCOPE: This SOP applies to all Members of the Department. POLICY: When dealing with Missing Persons, especially juveniles and the elderly, the Department will use every resource available to locate the individual. The primary objective will always remain the safe return of endangered children and adults. Every child reported missing will be considered “at risk” until significant information to the contrary is confirmed. Reporting Criteria: Per F.S. Chapter 937, a person will be considered missing if they are endangered, absent without reasonable explanation, become missing from, or were last seen in the City of Hollywood and meet the following F.D.L.E. criteria for NCIC entry: 1. Missing Endangered Person: a. A missing child; b. A missing adult under 26 years of age; c. A missing adult 26 years of age or older who is suspected by a law enforcement agency of being endangered or the victim of criminal activity; d. A missing adult who meets the criteria for activating the Silver Alert Plan of the Department of Law Enforcement. e. A missing adult who meets the criteria for activating the Purple Alert Plan of the Department of Law Enforcement under 937.0205 f.s 2. Missing Child: “Missing child” means a person younger than 18 years of age whose temporary or permanent residence is in, or is believed to be in, this state, whose location has not been determined, and who has been reported as missing to a law enforcement agency. 3. Missing Adult: “Missing adult” means a person 18 years of age or older whose temporary or permanent residence is in, or is believed to be in, this state, whose location has not been determined, and who has been reported as missing to a law enforcement agency. The reportee need not be in Hollywood, nor will there be any arbitrary waiting period required before a report is accepted. B. First Responding Officer: The first responding Officer will evaluate the circumstances surrounding the person’s absence and acquire accurate and detailed information. The information must be gathered and distributed immediately. Officers will adhere to the following: 1. Advise Communications of all pertinent information (physical description and clothing) and request a Citywide B.O.L.O. 2. Immediately notify a Patrol Sergeant. 3. Secure the crime scene, if applicable. 4. Coordinate an immediate search. a. Before beginning a search, jurisdiction needs to be established. The search for a person will begin where the person was last seen or known to be. SOP 251 Missing Persons Page 2 of 7 b. A search of the residence and surrounding area is imperative when the missing person is a child. Missing children have been located in the smallest of areas in a residence. c. If the missing person is a student at a local school, attempt to contact school personnel and friends. d. Diaries, personal computers, and phone books may provide valuable information, which could lead to the person’s location. e. For more investigative leads, refer to the Investigative Checklist for First Responders from the National Center for Missing & Exploited Children (see Appendix A). 5. Obtain a Missing Person’s Affidavit (see Appendix B). Immediately advise the Teletype Operator to enter the Missing Person’s information into the NCIC/FCIC system (per 937.021(4)(a)f.s. this must be completed within (2) hours). In missing person cases involving a juvenile, the NCIC/FCIC Operator will notify “A Child is Missing,” The National Center for Missing and Exploited Children and the Missing Children’s Clearinghouse. 6. Obtain a recent photograph of the missing person. a. If the missing person is endangered, prepare a Missing Person’s Flier (see Appendix C) for distribution in the area (forward a copy to the Investigative Services Section). b. Deliver the photograph to the Teletype Unit for NCIC/FCIC system entry. 7. Complete a detailed Incident Report. The incident report will be completed on a priority basis and will include the following information in the narrative: a. Teletype Operator’s name and I.D. number. b. Message Control number of the entry. C. Patrol Sergeant Responsibilities: The Patrol Sergeant is responsible for the following: 1. Assigning additional personnel from surrounding zones, as necessary, to assist in the search. 2. Ensuring that the first responding Officer has completed all initial tasks and made the proper notifications. 3. Ensuring that SOP # 251.1 is followed if information developed by the first responding Officer indicates that the incident is a Parental Abduction or Kidnapping. 4. Determining if the missing person falls within the guidelines to activate “The Florida Amber Alert, Silver Alert, or Purple Alert Plan.” (The Florida Amber Alert Plan, see SOP 251.1 Child Abductions/Kidnapping) (The Florida Silver Alert Plan, see Section II.) (The Florida Purple Alert Plan, see Section III.) 5. Notifying the Shift Lieutenant if the search does not locate the missing person within a reasonable time. D. Shift Lieutenant Responsibilities: The Shift Lieutenant will be responsible for the following: 1. Establishing a Command Post, if necessary. 2. Requesting additional search assistance, if available, such as a helicopter, K-9, Neighborhood Team Leaders, Code Enforcement, Park Rangers, Fire Department, Mobile Crime Patrol, C.E.R.T., BSO Bloodhounds, and Police Recruits 3. Determining the necessity for calling out a Detective. a. All missing person cases involving exceptional circumstances, including suspicion of foul play or a diminished mental capacity, require a Detective's response. SOP 251 Missing Persons Page 3 of 7 b. The Detective who is called out/assigned to the case will be responsible for conducting an investigation until such time as the missing person is located. c. Notifying the Investigative Services Section Lieutenant if information developed indicates the incident is a Parental Abduction or Kidnapping. d. Notifying a Patrol Division Major, or if after regular duty hours, the Staff Duty Officer. E. Patrol Division Major – Staff Duty Officer Responsibilities: It is the responsibility of a Patrol Division Major, or if after regular duty hours, the Staff Duty Officer, to: 1. Notifying the Public Information Officer and requesting that the media be alerted. 2. Ensuring that all reasonable search efforts are conducted. 3. Determining when to discontinue the search. F. Investigative Services Section Responsibilities: Detectives assigned to the Investigative Services Section will conduct follow-up investigations of missing persons and direct the initial investigation in cases with extenuating circumstances that indicate that the missing person is endangered. 1. The Homicide Unit will investigate all adult missing persons cases. 2. The General Investigations Unit will investigate all juvenile missing persons cases. 3. The appropriate Supervisor assigned to the Investigative Services Section is responsible for the following: a. Reading and reviewing all missing person reports. b. Assigning cases to Detectives and overseeing the investigations. c. Ensuring the photograph of the missing person has been entered into the NCIC/FCIC system. d. Verifying that notification to Florida’s Amber Alert, Silver Alert, or Purple Alert Plan has been accomplished, if applicable. e. Within (30) days, the Detective assigned the case will mail a letter on Departmental Letterhead (see Appendix E) and the Data Collection Entry Guide (see Appendix F) to the family or next of kin, which outlines the procedure for providing DNA standards and Dental records. f. Verifying that dental record requests for all persons still missing after (30) days have been followed up and documented via police reports and teletype and that a copy of this request and/or police report is added to the case file in Central Records by the assigned Detective. 937.031 f.s. g. Verifying that a biological specimen (DNA) request for all persons still missing after (90) days have been followed up and documented via police reports and teletype and that a copy of the letter and/or police report is added to the case file in Central Records by the assigned Detective. 937.021(6)f.s. h. Checking NCIC/FCIC validations monthly. II. FLORIDA SILVER ALERT PLAN A. Purpose: The purpose of the Florida Silver Alert is to locate missing persons suffering from an irreversible deterioration of intellectual faculties. The Florida Silver Alert Plan outlines two levels of Silver Alert activation: Local and State. Local and State Silver Alerts engage the public in the search for the missing person and provide a standardized and coordinated community response. SOP 251 Missing Persons Page 4 of 7 B. Local Silver Alert Criteria Recommendations: Although each agency may have their own criteria for activation of a Local Silver Alert for those individuals who are missing on foot, the Florida Silver Alert Support Committee recommends that agencies use the below criteria as a guideline when issuing a Local Silver Alert: 1. The person is 60 years and older; or, 2. The person is 18-59, and law enforcement has determined that the missing person lacks the capacity to consent and that a Local Silver Alert may be the only possible way to rescue the missing person. 3. The person has an irreversible deterioration of intellectual faculties (e.g., Alzheimer's disease or dementia) that has been verified by law enforcement. C. Local Silver Alert Activation Steps Recommendations: Although each agency may have their own policy or requirements for activation of a Local Silver alert, the Florida Silver Alert Support Committee recommends that local law enforcement agencies complete the following steps: 1. Conduct a preliminary investigation in which the agency has concluded that the disappearance poses a credible threat to the person’s welfare and safety. 2. Enter the missing person into the Florida Crime Information Center (FCIC) and issue a local BOLO. 3. Contact media outlets in the area and/or surrounding jurisdictions. Once the person has been recovered, contact the local memory disorder clinic, or provide the family with information regarding services and assistance. D. State Silver Alert (Missing in Vehicle): For persons with dementia who go missing in a vehicle with an identified tag, a State Silver Alert may be issued. In these cases, the Florida Department of Law Enforcement (FDLE) Missing Endangered Persons Information Clearinghouse (MEPIC) can assist with the illumination of dynamic message signs in your area. State Silver Alerts can only be issued for cases meeting the criteria below. E. State Silver Alert Criteria 1. The person must be 60 years and older; or, 2. The person must be 18-59, and law enforcement has determined that the missing person lacks the capacity to consent and that the use of dynamic message signs may be the only possible way to rescue the missing person. 3. The person must have an irreversible deterioration of intellectual faculties (e.g., Alzheimer's disease or dementia) that has been verified by law enforcement. 4. The person must be traveling by motor vehicle with an identified license plate number or other vehicle information that has been verified by law enforcement. F. State Silver Alert Activation Steps 1. The local law enforcement agency must enter the missing person into FCIC/NCIC. 2. The local law enforcement agency must notify media outlets in their area and/or surrounding jurisdictions. 3. Once the above steps have been completed, the local law enforcement agency may request a State Silver Alert by calling the FDLE Missing Endangered Persons Information Clearinghouse (MEPIC) at 1-888-356-4774. 4. The FDLE will ensure that the information is broadcast through dynamic highway message signs and via email through sign-up by public citizens and other resources. Note: Only law enforcement agencies can request activation of a State Silver Alert. SOP 251 Missing Persons Page 5 of 7 III. FLORIDA PURPLE ALERT PLAN A. Purpose: The purpose of the Florida Purple Alert is to assist in the location of missing adults suffering from a mental or cognitive disability that is not Alzheimer’s disease or a dementia-related disorder; an intellectual disability or a developmental disability; a brain injury; other physical, mental, or emotional disabilities that are not related to substance abuse; or a combination of any of these and whose disappearance poses a credible threat of immediate danger or seriously bodily harm. Purple Alerts engage the public in the search for the missing person and provide a standardized and coordinated community response. B. Criteria for Activation: The following criteria must be met for activation; 1. The person is 18 years of age or older and does not qualify for a Silver Alert. 2. Has your investigation determined the missing person: a. Has any combination of the following: an intellectual or developmental disability, brain injury, or another physical, mental, or emotional disability that is not related to substance abuse -and- b. Does not have Alzheimer’s disease or a dementia-related disorder? 3. Has your law enforcement agency’s investigation concluded that the disappearance poses a credible threat of immediate danger or serious bodily harm to the missing person, and they can only be returned to safety through law enforcement intervention? 4. Is there a detailed description of the missing person suitable for distribution? 5. Has your agency entered the missing person into the Florida Crime Information Center (FCIC)? 6. Does the agency recommend activation? C. Steps for Activation: 1. The local law enforcement agency must enter the missing person into FCIC/NCIC. 2. The local law enforcement agency must notify media outlets in their area and/or surrounding jurisdictions. 3. Once the above steps have been completed, the local law enforcement agency may request a Purple Alert by calling the FDLE Missing Endangered Persons Information Clearinghouse (MEPIC) at 1-888-356-4774. 4. The FDLE will ensure that the information is broadcast via dynamic highway message signs when applicable and via email/text through sign-up by public citizens and other resources. Note: Only law enforcement agencies can request activation of a Purple Alert. IV. RECOVERY OF MISSING PERSONS A. Persons Reported Missing: When a person who has been reported missing is found, Officers will complete the following: 1. Verify the person’s identity and status. 2. Notify the Teletype Operator of the recovery and note the Operator’s name, I.D. number, and Message Control number in the Incident Report. 3. Teletype Operators will record recovery information on the “Missing Person/Juvenile Recovery Log” (see Appendix D) and forward this information to the Data Entry Unit for a report classification update. 4. Recoveries of missing persons originating from outside Agencies require the completion of an Incident Report. SOP 251 Missing Persons Page 6 of 7 B. Found Child: When an Officer encounters a found child, the following will be conducted: 1. Check of the immediate area to obtain information that could assist in identifying the child. The child should be brought to Headquarters if information cannot be obtained. 2. If the child is unable to supply information as to their identity, and all attempts to locate the child’s parents have failed, the Officer will contact the Florida Department of Children and Families. a. An on-call DCF Case Worker will make temporary shelter arrangements. b. DCF Contact Information, (7261 Sheridan Street, HWD Phone 1-866-LE-ABUSE). C. Runaway Juveniles: A Law Enforcement Officer has the authority to take a juvenile into custody when reasonable grounds exist to believe that the child has run away from his parents, guardian, or other legal custodian. The child is to be released to a parent, guardian, legal custodian, responsible adult relative, or a Department of Children and Families (DCF) Case Worker for placement in a shelter when found. V. DEFINITIONS: A. MISSING ENDANGERED PERSON: 1. A missing child; 2. A missing adult under 26 years of age; 3. A missing adult 26 years of age or older who is suspected by a law enforcement agency of being endangered or the victim of criminal activity; 4. A missing adult who meets the criteria for activating the Silver Alert Plan of the Department of Law Enforcement. 5. A missing adult who meets the criteria for activating the Purple Alert Plan of the Department of Law Enforcement under s. 937.0205. B. EMANCIPATED JUVENILE: Emancipation of a child by their parents involves an entire surrender of the right to the care, custody, and earnings of such child as well as a renunciation of parental duties. The instructions and reports provided in the guide are intended to assist to law enforcement with the collection of information to create an accurate profile of the missing person. The Coding Dental Characteristics section of this guide should be used when coding dental characteristics for missing or wanted person records. CATEGORIES FOR ENTRY INTO THE MISSING PERSON FILE Disability (EMD): A person of any age who is missing and under proven physical/mental disability or is senile, thereby subjecting himself/herself or others to personal and immediate danger. Endangered (EME): A person of any age who is missing under circumstances indicating that his/her physical safety may be in danger. (NOTE: Is a Child Abduction (CA) or an AMBER Alert (AA) flag appropriate?) Involuntary (EMI): A person of any age who is missing under circumstances indicating that the disappearance may not have been voluntary, i.e., abduction or kidnaping. (NOTE: Is a Child Abduction (CA) or an AMBER Alert (AA) flag appropriate?) Juvenile (EMJ): A person under the age of 21 who is missing and does not meet any of the entry criteria set forth in 1, 2, 3, or 5. Catastrophe Victim A person of any age who is missing after a catastrophe.
