**ARTICLE I** **GENERAL PROVISIONS** **Section 1. Short Title.** - This Act shall be known as the \"Electronics Engineering Law of 2004\" **Section 2. Statement of Policy**: The State acknowledges the importance of electronics engineering and will develop skilled, ethical professionals through fair licensure exams and supportive measures.\ \ **Section 3. Definition and Interpretation of Terms.** **Section 4. Categories of Practice.** - The following shall be the engineering and technician categories covered by this Act: **ARTICLE II\ PROFESSIONAL REGULATORY BOARD OF ELECTRONICS ENGINEERING** **Section 6. Composition of the Board**: A Professional Regulatory Board for Electronics Engineering is created under the Professional Regulation Commission. It includes a chairman and two members appointed by the President from three candidates recommended by the Commission, who are chosen from five nominees from an accredited professional organization. **Section 7. It will hire a Secretary to handle these records and provide support services for this Act. **ARTICLE III**\ **EXAMINATION, REGISTRATION AND LICENSURE** **Section 13. Licensure Examination:** All people wanting to become registered and licensed as Electronics Engineers or Electronics Technicians must take the required exams. These exams will be organized by the Board at locations and times set by the Commission, following the rules of Republic Act No. 8981. **Section 14. Qualifications for Examinations**: To take the Electronics Engineer or Technician exam, applicants must: 1. 2. **Section 15. Scope of Examination for Electronics Engineers and Electronics Technicians**: **Section 16. Ratings.** To pass the licensure exam for Electronics Engineer or Technician, a candidate must score at least 70% in each subject. If a candidate scores between 60% and 69% in some subjects but passes the majority, they can take one removal exam for those failed subjects. A written explanation will be provided and recorded. ### Section 22: Professional Oath Qualified registrants must take a professional oath to register and practice as Electronics Engineers or Technicians. **Section 23: Revocation and Suspension of Certificate of Registration, Professional Identification Card and Cancellation of Special Permits** -The Board can revoke or suspend a Certificate of Registration, Professional Identification Card, or cancel a Special Permit for unprofessional conduct, malpractice, violations of this Act, or fraud, after proper notice and hearing. ### Section 24: Reinstatement, Re-issuance, or Replacement of Certificate The Board may reinstate a revoked Certificate of Registration and Professional Identification Card after two years, provided the applicant meets Commission requirements and hasn\'t violated the Act during the revocation. A new Certificate or Identification Card can be issued to replace lost or damaged ones upon payment of the required fees. ### Section 25: Roster of Professionals The Board will create and maintain an annual roster of all registered Professional Electronics Engineers, Electronics Engineers, and Electronics Technicians, including their names and addresses. This roster will indicate the status of their Certificate of Registration, Professional Identification Card, and membership in the Accredited Professional Organization (valid, inactive, delinquent, suspended, or revoked). It will be publicly posted at the Commission and available upon request. ### Section 26: Exemptions from Examination and Registration Foreign Professional Electronics Engineers, Electronics Engineers, and Electronics Technicians can work in the Philippines without taking a test or registering if: 1. 2. 3. They also cannot pretend to be qualified for these jobs or advertise their skills without these documents, unless allowed by Section 26. ### Section 28: Prohibitions and Limitations on the Practice of Electronics Engineering and Electronics Technician Profession Only qualified individuals can practice electronics engineering and electronics technician work. No company or group can be registered as a firm for these professions. However, licensed Professional Electronics Engineers, Electronics Engineers, or Electronics Technicians can form partnerships or corporations to work together. Each person in these groups is responsible for their own actions. **Section 29. Seal of the Professional Electronics Engineers** Licensed Professional Electronics Engineers must have a seal with their name, registration number, and title. The seal is required on technical documents, including plans and reports. It must include the Professional Tax Receipt (PTR) number, payment date and place, and membership number in the Accredited Professional Organization when submitted to the government. **Section 30. Code of Ethics and Code of Technical Standards of Practice** The Board will create a Code of Ethics and a Code of Technical Standards of Practice for Electronics Engineers and Electronics Technicians, which will be published by the Accredited Professional Organization. **ARTICLE V**\ **SUNDRY PROVISIONS** **Section 31. Continuing Professional Education (CPE) and/or Development Programs** Registered Professional Electronics Engineers, Electronics Engineers, and Electronics Technicians must comply with rules for continuing professional education set by the Commission, the Board, and the Accredited Professional Organization. **Section 32: Integrated and Accredited Professional Organization** - One national organization for Professional Electronics Engineers, Electronics Engineers, and Electronics Technicians, registered as a non-profit corporation, appointed by PRC. They manage continuing education and issue annual membership cards. Membership is required for good standing. **Section 33: Foreign Reciprocity** - Foreigners cannot register as Professional Electronics Engineers, Electronics Engineers, or Electronics Technicians unless they show that their country allows Filipinos to practice equally, including accepting licenses and degrees from the Philippines. **Section 34: Positions in Government Requiring the Services of Registered and Licensed Professionals** - Within three years from the effectivity of this Act, all government positions requiring Professional Electronics Engineers, Electronics Engineers, or Electronics Technicians must be filled only by registered and licensed professionals. **ARTICLE VI**\ **PENAL PROVISION AND ASSISTANCE OF LAW ENFORCEMENT AGENCIES** **Section 35: Penal Provision** - Violations will result in a fine of ₱100,000 to ₱1,000,000, imprisonment of 6 months to 6 years, or both: 1. 2. 3. 4. 5. 6. 7. 8. 9. **Section 36: Assistance of Law Enforcement and Other Government Agencies** - Law enforcement agencies must help the Board and Commission enforce this Act and its regulations. They will prosecute violators as needed. Other government agencies must also assist and cooperate when requested by the Board or Commission to implement this Act and its related policies. **ARTICLE VII**\ **TRANSITORY PROVISIONS** **Section 37: Transitory Provision** - After this Act takes effect, the current Board of Electronics and Communications Engineering has six months to finish its work before it ends. The President of the Philippines will appoint the first Board of Electronics Engineering members during this time, who will create the rules to implement this Act. **Section 38: Vested Rights: Electronics and Communications Engineers When This Law is Passed** - Electronics and Communications Engineers with a valid Certificate of Registration and Professional Identification Card when this Act takes effect will automatically become recognized as Electronics Engineers. They will receive a new Certificate of Registration and Professional Identification Card as Electronics Engineers, keeping their original license number, after paying the required fees and meeting other Board and Commission requirements. **ARTICLE VIII**\ **FINAL PROVISION** **Section 39: Implementing Rules and Regulations** - The Board will create rules and codes for Professional Electronics Engineers, Electronics Engineers, and Electronics Technicians. This is approved by the Commission and coordinated with the accredited organization. It will be published in the Official Gazette and take effect 15 days after. **Section 40. Appropriations.** The Chairperson of the Professional Regulation Commission will make sure that money for this law is part of the Commission\'s yearly budget plan. **Section 41. Separability Clause.** If a part of this law is found to be unconstitutional by a court, the other parts will still remain valid. **Section 42. Repealing Clause.** Republic Act No. 5734 is canceled. Any other laws or rules that conflict with this law are also canceled or changed. **Section 43. Effectivity.** This law will start 15 days after it is fully published in the Official Gazette or a widely read newspaper.
