[-- Overriding objective of enabling the court to deal with cases justly and at proportionate cost] 3. [-- The parties have a duty to help the court to further the overriding objective] Rule 1.3 -- parties are required 'to help the court' further the overriding objective (cf. language of 'duty' placed upon the court. 4. -- [The Court must further the overriding objective by actively managing cases] This includes: - Encouraging cooperation - Prompt decision of which issues can be dealt with summarily and which require full investigation - Encouraging ADR - Fixing timetables etc. [1.4.4 -- encouraging cooperation between parties] Eg. R.29.4 -- court may approve, without a hearing, proposals agreed by the parties for the management of proceedings on the multi-track and give directions in the terms proposed. [1.4.9 -- helping parties settle ] Following CoApp in Churchill v Merthyr Tydfil CBC \[2023\] it is clear the court has the power to order parties to engage in a settlement process.
