THE REGULATION ON THE PROVISION OF REMOTE HEALTH SERVICES (“TELE-MED REGULATION”) The Regulation on the Provision of Remote Health Services (“Tele-Med Regulation”) 10.02.2022 https://www.resmigazete.gov.tr/eskiler/2022/02/202 20210-2.htm ARTICLE 1 The purpose of this Regulation is to regulate the procedures and principles regarding the scope of remote health services, the granting of permits to health facilities that will provide remote health services, the development and registration of remote health information systems, and the inspection of health facilities within this scope, in order to serve the provision of health services independently of location and geography and based on contemporary medical technology. ARTICLE 2 This Regulation covers all health facilities providing remote health services, all healthcare professionals involved in remote health services, remote health information system developers, and real persons wishing to receive remote health services. ARTICLE 4 Remote health information system: Secure software that enables written, audio, or video communication produced by the Ministry or approved for use in the provision of remote health services by being registered by the Ministry, Remote health service: Health services provided by a healthcare professional to a person requesting health services via a remote health information system in healthcare facilities that have obtained an operating permit in accordance with the provisions of this Regulation. ARTICLE 7: The following services can be provided remotely, provided that they are suitable for remote healthcare service delivery due to their nature: A person requesting remote health service may be examined to the extent permitted by the remote health service; the person may be evaluated through medical observation, monitoring, and follow-up; diagnosed diseases may be checked; medical consultancy may be provided; consultation or a second opinion may be requested. In necessary cases, the person may be advised to physically apply to a health institution. For remote management and monitoring of diseases, a person's clinical parameters, such as blood sugar and blood pressure, can be evaluated and monitored, and treatment and medication management can be provided. Services can be provided to protect and monitor health, support healthy living, and provide psychosocial support services. Multi-faceted evaluation and monitoring of people with increased health risks or advanced age can be performed. ARTICLE 7: The following services can be provided remotely, provided that they are suitable for remote healthcare service delivery due to their nature (continue): Provided that technological possibilities allow and the necessary permissions are obtained from the Ministry, individuals may be provided with interventional or surgical operation services determined by the Ministry. In endemic or epidemic outbreaks, necessary medical procedures may be carried out in line with national guidelines to protect the health of individuals. The health data of individuals requesting health services may be measured and monitored with wearable technologies and other medical devices. An e-prescription and e-report may be issued by a physician to an individual who a physician evaluates. ARTICLE 9: Informing the patient: a) The identity and, if any, specialization of the healthcare professional who will provide remote healthcare services, b) The healthcare professional will not be physically present in the same environment, c) Remote healthcare services cannot be the equivalent of face-to-face healthcare services, ç) Remote healthcare services are different from practical treatments, d) Remote healthcare services cannot be used in a way that disrupts ongoing treatment, e) In urgent medical situations, the nearest emergency room should be visited instead of remote healthcare services, ARTICLE 9: Informing the patient (continue): g) The fee for the remote health service, the scope of the service to be provided, whether any health insurance will cover the service, h) It is prohibited to record audio or video regarding the provision of remote health services without the explicit consent of the parties; however, records regarding the health service received will be kept following the legislation on the processing of personal health data and will be transferred to the Ministry of Health information system by the personal data protection legislation and privacy, ı) In order for the remote health service to start, it may be requested to allow camera and/or microphone access to the remote health information system, i) In case the audio and/or video cannot be transmitted between the parties, the remote health service may not start, and if it has started, it may not be continued, j) The remote health service may be terminated at any time by informing the other party for medical or legal reasons, k) The person providing the remote health service is personally responsible for ensuring the security of the information systems, usernames, and passwords used in the provision of the remote health service, l) The nature and results of the health service to be provided, ARTICLE 12: Personal Data Protection: In the provision of remote healthcare services, the healthcare facility and healthcare professionals providing the service are responsible for protecting patient privacy and personal data. ARTICLE 14: Prohibitions and restrictions A health facility cannot provide remote health services without obtaining permission from the Ministry. A health facility cannot provide remote health services in an area where it is not authorized to provide health services. Health services not within this Regulation's scope cannot be provided through remote health services. A health facility cannot provide remote health services through a health professional without a work permit. ARTICLE 14: Prohibitions and restrictions (continue) Healthcare professionals who are not authorized to practice their profession in Turkey cannot provide remote health services. In the provision of remote health services, except for those provided abroad, those receiving remote health services cannot be allowed to use any medical device other than those registered by the Turkish Medicines and Medical Devices Agency. The remote health information system cannot be used for purposes other than its intended purpose. The healthcare facility and/or healthcare professional cannot act in a way that will force the person who will make an appointment to receive remote health services. The minimum medical requirements for the provision of healthcare services also apply to the provision of remote health services to the extent that they are applicable. Personal data obtained while providing remote health services cannot be processed or transferred outside the relevant legislation.
