BOCA RATON POLICE SERVICES DEPARTMENT Standard Operating Procedure 13.02 SUNPASS TRANSPONDERS Revised: March 20, 2023 I. PURPOSE: The purpose of this standard operating procedure is to ensure that SunPass transponders are properly accounted for and to establish procedures for requesting, issuing, using, and canceling SunPass transponders. II. PROCEDURE: A. GENERAL SUNPASS TRANSPONDER PROVISIONS: 1. The Florida Department of Transportation (DOT), through the Office of Toll Operations, establishes toll accounts with law enforcement agencies. 2. Florida State Statute 338.155(1a) states that any law enforcement officer (LEO) operating an official vehicle while on official law enforcement business is exempt from toll payment. 3. Driving to and from work does not constitute official business, unless: a. A LEO is operating an official vehicle and they assist other law enforcement officers when needed on toll roads (emergency-type situations.) 4. Utilizing a department vehicle personally during documented on-call shall NOT be considered toll exempt travel. 5. A LEO operating a department vehicle for department approved law enforcement related training shall constitute official law enforcement business. B. PORTABLE SUNPASS TRANSPONDER USE: 1. Portable SunPass transponders are for the use of authorized employees during travel on official business. 2. Use of a portable SunPass transponder results in payment being issued by the Department. The administrative assistant responsible for travel and training manages the portable SunPass transponders and he/she is responsible for the following: a. Issuing portable SunPass transponders. b. Maintaining accurate records of portable SunPass transponder assignments. c. Maintaining a log for Department employees to sign out portable SunPass transponders. d. Processing invoices and payments related to the use of portable SunPass transponders by employees. e. Replacing stolen, lost, or damaged portable SunPass transponders. Assigned employees must properly document stolen, lost, or damaged transponders. f. Acquiring replacement portable SunPass transponders. The administrative assistant will send a memo or form/letterhead by mail or FAX to the Florida Department of Transportation or purchase portable SunPass transponders online. g. Maintaining a list of all portable SunPass transponders issued to the Department and to all individual employees. D. PORTABLE SUNPASS TRANSPONDER INVENTORY: 1. At least annually, the administrative assistant responsible for travel and training shall inventory the portable SunPass transponders and verify this record for accuracy. E. PERMANENT SUNPASS NON-REVENUE TRANSPONDER PROVISIONS: 1. Permanent SunPass non-revenue transponders may be installed in department vehicles that are operated by an LEO. a. For any travel on toll roads that is NOT exempt per Florida State Statute 338.155(1a); employees operating a department vehicle with a permanent SunPass non-revenue transponder installed shall utilize a second, portable SunPass transponder to pay tolls. i. When a department vehicle is being used for personal travel that is authorized (such as during documented on-call), the second portable SunPass transponder used to satisfy a toll payment shall be personally owned. Effective: March 6, 2001 Revised: March 20, 2023 Toll Cards and SunPass Transponders SOP No. 13.02 Page 2 of 3 F. PERMANENT SUNPASS NON-REVENUE TRANSPONDER RESPONSIBILITIES: 1. The department’s Fleet Manager will manage the permanent SunPass nonrevenue transponders, and he/she is responsible for the following: a. Adding and/or removing vehicles/license plates from the department’s non-revenue SunPass account in coordination with the SunPass Non-Revenue Accounts Administrator. b. Procuring, issuing, and installing permanent SunPass non-revenue transponders in vehicles operated by a LEO. c. Replacing damaged or inoperable permanent SunPass non-revenue transponders. d. Acquiring replacement permanent SunPass non-revenue transponders from the SunPass Non-Revenue Accounts Administrator. e. Maintaining accurate records of vehicles with permanent SunPass nonrevenue transponders installed to include the transponder number. f. Removing permanent SunPass non-revenue transponders from vehicles when they are no longer being used by a LEO or are taken out of service. G. PERMANENT SUNPASS NON-REVENUE TRANSPONDER INVENTORY: 1. At least annually, the Fleet Manager shall audit permanent SunPass non-revenue transponders to verify each active transponder is only installed in a vehicle used by a LEO.
