Org Structure]** - The Chief's Office receives, channels, and assures response to citizen inquiries or complaints related to all police services. - SIB manages lawsuits, assembling documents and scheduling officer testimony. - SIB investigates allegations of serious misconduct by department members. - SIB investigates incidents that may result in civil actions against the department or city. - SIB does backgrounds of PD and Fire hires. - SIB inspects and investigates liquor license establishments, vending machines and others regulated by state or local laws. - Inventories department equipment, maintenance, repairs to equipment and building. - Provides representation for Risk Management and Emergency Management. - Payroll, budget and Overtime. - Disability, New Hires, Retirements, Resignations. - Admin maintains in-car cameras, building security, **[video storage]**, and **[FOIA requests]** for videos. - *ADMIN Monitors FALSE ALARMS.* - Monitors case law changes and informs department. - Coordinates all outside schools, seminars, and conferences with feedback. - Records employee's employees in training programs to ensure they are current by the records retention schedule. - Collects, maintains, and distributes reports of crimes, incidents, crashes, and other matters required by law, interest of the public, or needed for police operations. - Responds to all **[DOCUMENT]** requests for the Freedom of Information Act (**[FOIA)]** - Maintains files on warrants, confiscated property, impounds, handgun purchase records, lab evidence, and conducts auctions. - Manages the Quick Response Team and facilitates target locations to respond to and offer services. - Backs up P.I.O. - Oversees the LGBTQ liaisons - Maintains Accreditation. - Conducts follow-up investigations for crimes involving suspects 18 years of age and older. - Initiates the arrest of persons for whom warrants are issued. - Conducts follow-up investigations for crimes involving suspects and victims 17 years of age and younger. - Investigates all drug law violations involving suspects 18 years of age and older. - Conducts covert investigations of gambling, prostitution, and other vice crimes. - Conducts focused directed patrols, in plain clothes, in the areas of surveillance, gathering intelligence, and, where appropriate, taking enforcement action, to identify, arrest, successfully prosecute, and otherwise deter criminal activity. - Conducts forensic analysis of electronic devices including phones, computers, and tablets. - Suppresses criminal activity through random and directed patrols. - Conducts preliminary investigations of reported crimes. - Coordinates the department's participation in special events (i.e., art fairs, parades) that occur in the community. - Coordinates and maintains a Field Training Officer program for new hires. **[2.01 Direction of Personnel]** - Electronic documents stored within this program WILL NOT be stored in a physical copy. - Documents in Power DMS need to be reviewed a maximum of 5 YEARS - Designated administrators (Administration Captain and Accreditation Manager) - Have oversight of the program, which includes adding/removing users, and documents, as well as making assignments. - As documents are modified, the prior version will be "archived" within the program. A site administrator can recall the archived versions of documents if needed. - Officers who may be on long-term sick/injury are required to stay current with assignments related to documents needing signatures. - Upon a police officer being promoted to the rank of Sergeant they should (based on class availability) successfully complete a basic supervisor course within one year of the appointment date. - Lieutenant completes a mid-management course - Captain completes an executive management course **[3.01 Working hours & Adjust for Leave Time]** - All trades or changes shall be limited to employees of the **[same shift and bureau]**. **[Inter-bureau and inter-shift trades will not be permitted]**, unless written authorization is obtained from the affected Division Commander(s). - Sick time can't be used for weather issues, other time needs approval - Seniority rights do not apply to probationary Officers - Assigned OT -- Equalized OT prevails, except during an emergency - Shift Vacation list has priority over single vacation days - Single vacation days, request must be submitted at least (2 weeks) prior for seniority rights to take place - Chief shall post the available positions at least 10 days before - If no interest, least seniority command officer must fill spot - 60 days written notice to be given to all affected members of a transfer - Vacation, comp and personal time to be used in increments of 1 hour - Equalized OT by seniority if dept has at least 72 hours' notice - [Minimum of 2 command officers] (1 Operations Officer) & (1 street level) - **If forced**, no longer than ***5 HOURS* for Command** - If Officer is on leave time or sick time, not allowed OT for shift shortages - Command responsible to check Kronos at beginning & end of each shift - Notify office of the Chief ASAP if selected for jury duty - Chief can petition court to relieve officer of jury duty in certain instances - Employees [will not lose pay for jury duty]. They will go to day shift and not be compensated for their time at the court on their SLDs. Must provide a copy of the check from the court within 5 days of issuance to the PD. There an adjustment is made to offset their court compensation - OT is not paid for jury duty. Must submit court compensation to get pay. - Must have subpoena to attend court, [will not be paid for off-duty court] - Missing court goes to SIB and then ultimately to the Chief's disposition - If you cannot attend court, document in book at front desk (OO) & notify the court. This is monitored by a supervisor. Reported to division commander in writing. - SIB to notify court if Officer is on suspension and cannot make it - Records has a register for payments. \$100 to be maintained in register. Any more will be forwarded to the treasurer's office. - Evals shall be completed within 10 days of the Officer's Anniversary - [Personal Characteristics]: *INTEGRITY, DEPENDABILITY, ACCURACY, GOOD JUDGMENT, COURTESY, INITIATIVE*. - [Personal Traits]: *PROFESSIONALISM, LOYALTY, PRIDE, RESPECT, DEDICATION, COURAGE.* - [Halo Effect] -- remembering 1 thing they did - [Lenient/Harsh Effect] -- too easy going naturally or too difficult - [Central Tendency Effect] -- Tendency to "play it safe" - [Similar-to-me Effect] -- RELATED TO HALO, reminds evaluator of self - [Contrast Effect] -- Looking good or bad by comparison of others - [1^st^ or Last Impression Effect] -- CLOSELY RELATED to HALO, doing well in beginning of eval or end which stands out - [Stereotype Effect] -- Unconscious behavior in evaluating, very difficult error - All performance docs shall be maintained in shift file, secured inside shift commander's office - If it is not in the shift file, it can only be rated as "Meets Expectations" - No longer than 30 calendar days - **On-Duty Death** - [Escort, Honor Guard, Pass in review, Firing party, Bugler, Drummer] - 6 Officers as pallbearers - 2 Honor Guard members (1 at head/ 1 at feet) - They are relieved every 15 minutes - Honor Guard also present at viewing - Hat badge, breast badge and weapon is not buried with Officer - American flag folded in/near casket or draped over casket while body in view - Department provided Flag draped so that stars are over the left shoulder - **Off-Duty Death** - Escort, Honor Guard, Pass in Review - **Retired Officer Death** - Escort, Honor Guard 1 Hour prior to service, Pass in Review - No pallbearers - Notifications NEVER done alone and NEVER from a porch - Family should go to hospital in police vehicle/If refuse, we go in their car - Name of deceased shall NEVER be released to media before family - ANY COMS OF THE NOTIFICATION SHALL BE OVER THE TX IF POSSIBLE - If media gets Officer name, request them to withhold info for next of kin - If possible, for family to visit Officer before death, they should do so - More than half of widows are expected develop PTSD - [Color Guard Display] -- 4-8 members including 2 riflemen. Carry the colors of the United States, State of Michigan, City, and Honor Guard Flag - [Interment Flag] -- A cotton flag of the U.S. to drape over the casket - [Honcho] -- The designate whom calls out commands in a firing line - [Rifle Squad] -- Firing party not less than 3 or more than 9 riflemen plus a Honcho. - [Flag Detail] -- 8-member unit charged with removing/folding flag at burial - Honor guard Officers allowed a **maximum of 2 unexcused absences** - **[Minimum 4 Officers for other departments]** - 10 incidents have occurred with same employee in 1 year - Severity of the incidents can also trigger a review - Stages of Discipline - Informal discussion/training - Verbal Reprimand/Employee Supervisory Counseling - Written Reprimand - Suspension or punitive action - If suspended, they are relieved of their firearm, badge, ID and key fob to building - Cannot wear their uniform - Forbidden on Police grounds - All command has the authority to suspend an Officer under their command ONLY for the remainder of their shift, pending investigation - Employee shall receive written notice within 30 days of investigation - All members have access to their file/written copies - Once violation reported, Department has **[90 days]** to address - Debriefing -- Min 2 Peer Support team members and mental health professional **[within 10 days of incident]**. - Officers can be ORDERED to attend debriefing - Supervisor is to notify the Captain through the chain of command to recommend the Officer receive mental health assistance - Job security and promotional opportunities **SHALL NOT** be jeopardized - Only the Chief can order mandatory counseling - **RADAR & LIDAR every 5 years** - Minimum 72 hours notice for training for Officers - Minimum 14 days notice for Command - To attend training, 14 days in advance required, 21 days notice if traveling overnight - All receipts for travel must be submitted within 5 working days - Captain of Administration serves as training coordinator - FTO program modeled after DeWolf & Associates in San Jose CA - All probationary Officers evaluated for minimum of 14/17 weeks from steps 1 through 4, except: - Limbo Week (Non-Evaluated) - 2 Week Shadow Phase - 15 weeks that make up steps 1-3 can only be increased by 80 hours - **There is no additional training in step 4** - Step 5 is probationary period - **7** possible ratings in evaluation with **31** categories - Must attend quarterly meetings - Hierarchy - Program Coordinator - Team Leader - Team Members - Defusing takes place immediately after a critical event and generally lasts no longer than 1 hour. - Debriefing should occur **24-72 hours, but no later than 10 days after** - Debriefing attendance is **MANDATORY** - All conversations are privileged except: - Information of a crime. - Danger to self or others. - Psychological warning signs that employee is not fit for duty **[Off Duty Employment]** - Extra duty -- work done for another job while on duty at SHPD is prohibited - Cannot own business that sells or delivers alcoholic beverages. - Cannot privately assist in preparation of the defense in a criminal case. - Cannot make wages while on paid sick leave. - Cannot use employee weapons, radios, LEIN or police records with other employment. - Cannot work another job while taking a sick day. - No outside employment while on light duty unless approved by Chief. - If sick or injured and unable to work with City, cannot work other job. - Officers are provided with liability protection for the on-duty and off-duty performance of official duties. - Off-duty Officer can arrest when: - Arresting officer is not personally involved in incident. - Immediate need for prevention or apprehension of suspect. - Misconduct is clearly an arrestable offense. - Arresting Officer in possession of badge and ID card - Responsibility of every officer to immediately report criminal activity to on-duty authorities - Chief of police shall appoint a Board of Review with 1 LT, 2 Sgts, 2 Patrol Officers - Citation of Valor -- extraordinary act risking one's life **HIGHEST LEVEL** - Blue/White/Red - Chief's Citation -- Officers who are injured from felonious assaults - Purple/White/Purple - Department Citation -- courageous act protecting life/property, serious crime was prevented/felon apprehended. - Gold/Blue/Gold **[Explorers Program]** - At least 14 years old. - Completed 8^th^ Grade. - No older than 20 years old. - Must maintain 2.0 GPA - 3x/Mo Meetings - Eligible for ride along if: - Completed 3-month probation - 16 years old - Proper ID & weeklong MLEYAC academy or 40 hours of community service - Shall immediately terminate ride-along if: - Vehicle pursuit - Weapons or potentially assaultive parties - Hostage or barricaded gunman - Riots - Sick/contagious people **[General Orders 4.01 Personal Grooming]** - Hair shall be neat and clean and cannot be long enough to cover eyebrows/fall over any portion of the ear/extend over the collar or extend outside of a hatband longer than ½ inch. - Hair cannot be dyed multiple colors - Sideburns cannot extend past the point of the ears, nor have lambchop style. Must have horizontal cut at bottom. - Mustaches cannot extend beyond ¼ inch of the corners of the mouth. Shall not exceed ½ inch in depth or appear bushy. Ends cannot be waxed or twisted. - Beards cannot be longer than the rest of facial hair. Cannot exceed ½ inch. Neck must be clean shaven. Must be worn with mustache. - Fake eyelashes shall not be worn. - Cannot have dental ornamentation - Contact lenses must be clear (no color) - Cannot wear external armor with Class A uniform - 4 items of Molle gear - In addition, can have a knife and flashlight - Personal body armor shall provide a minimum **LEVEL 2** ballistic **[GENERAL ORDER 6.01 OPERATIONS OFFICER & COMPLAINT DESK RESPONSIBILITY]** - Assume full responsibility for the operation and condition of the house. - Oversee operation of the backup emergency warning system counsel. - Emergency warning system, OO will immediately notify City Manager, Chief of PD, Chief of FD, DPW director and PIO via email of activation. - Supervise operation of the complaint desk. - Review and evaluate all arrests to determine validity, proper charge, need for medical treatment, eligibility for release, set bond amounts. - Accept and document complaints against personnel. - Maintain written Operations log. - Check property area by jail elevator at beginning and end of shift. **[OPERATIONS OFFICER, DESK, RECORD & INFORMATION]** - Adult arrests - Arrestee's name, DOB, charge, amount of bond, Officer's name. - Release of arrested persons. - Disposition of prisoners transferred out of the detention facility. - All special attentions or extra checks shall be entered in the log. - Ensure television in lobby is on and operating the slide show. **[FOOT PURSUITS 6.03]** - Officers must consider initiating or continue in foot pursuit - Availability of backup. - Saturation of area with patrol personnel. - Containment of the area. - Availability of canine support. - Availability of air support/drones. - Availability of thermal imaging equipment. - Identity of the suspect being established. - Single officer shall NOT engage in foot pursuit of fleeing suspect from a vehicle while other occupants are in that same vehicle. - Training Sergeant will complete a yearly annual review of foot pursuits. **[CRITICAL INCIDENT RESPONSE PLAN 6.05]** - Department will function under the Macomb Emergency Operations Plan located on the Z drive. - Hostage or barricaded subjects shall request SRT through the chain. - Operations levels - Level 1 -- incident that does not require activation of mutual aid. - Level 2 -- more serious requiring mutual aid. - Level 3 -- Highest level activating the Emergency Preparedness Plan. - Command post will be established at every level. - Incident Commander established and controls: - Operations team. - Planning Team. - Logistics Team. - Finance/Administration team. - Debriefing **[MEALS AND BREAKS 6.06]** - Not exceed 30 minutes. - Not more than 2 coffee breaks (15 minutes per shift each). - Shall specify location of meal break. - Cannot take meal breaks during 1^st^ or last hour of shift. - Clerical personnel get 1 hour meal breaks & (2) 15 minute breaks. **[SEARCH WARRANTS 6.07]** - Lists where to search. - What to search for. - Orders Officers to seize same. - 4 copies (Judge, left on scene, PD, Prosecutor) - Affidavit - Officer gives reason for PC. - Relates Officer's experience. - How Officer obtained information. - Private citizen or security guard can be on affidavit. - Information must be sworn before a judge. - Tabulation sheet. - Lists what items were seized. - Who seized the items and where. - Witness to seizure. - Other Officers present. - Search warrant - Can be drafted by assistant prosecutor or police officer. - Must be sworn before judge or magistrate. - May not be issued by law enforcement, only by detached judicial officer. - District courts have statewide authority to issue warrants. - Threat assessment (Threat Matrix) form - Shall be issued by OIC. - OIC shall complete Search Warrant Operations form. - Shall wear body armor when issuing warrants. - Must knock and announce before forcing the door open. - No-Knock when harm or danger to officer. - Items named on warrant may be seized if immediately apparent that items are contraband or evidence. - Furniture, stereos, televisions, etc, may not be moved for serial numbers. **[HANDLING UNKNOWN SUBSTANCES 6.08]** - Double-gloving is suggested with chemical compounds. - Do not use alcohol or hand sanitizer due to absorption. - Officers shall NOT sniff/smell, taste, feel without gloves, eat/drink. - Field testing, sorting or packaging shall be conducted by a Tech in the lab under the range hood. - Narcan - Shall be carried in every vehicle bag and by all command. - Placed at front desk. - Evidence tech lab. - Locker rooms. - Detective bureau. - Operations bureau. - All roll call rooms. - Replenished by Administration **[SAFE DELIVERY OF NEWBORNS 6.09]** - Accepting an infant - 1\) Surrendering Parent's Rights sheet. 2) Voluntary Medical Background form. 3) Voluntary Release for Adoption form. **[OPERATION OF POLICE VEHICLES 6.10]** - Complete an inspection of their assigned vehicle beginning & end of shift. - OO notified of damage shall - Document in spreadsheet titled Quartermaster Vehicle Log. - Transport of private persons in dept vehicle requires approval. - Department vehicles are no authorized to tow other vehicles. - Only vehicles with push bumpers are permitted to push vehicles. - K-9 and Evidence Techs can keep cars running if locked. **[VEHICLE PURSUITS 6.11]** - Motorcycles & Unmarked vehicles are not pursuit authorized. - Pursuits factors are: nature of offense, vehicle and ped traffic, location of pursuit, time of day, road and weather conditions, speeds, other people in vehicles, performance capabilities of vehicles, knowledge of offender's ID, familiarity with the area. - Shall obtain approval from on-duty supervisor to reinstate pursuit. - Intra-jurisdictional pursuits - Outside agency that started pursuit is responsible for progress. - SHPD only gets involved when directed by a supervisor. - Other agency must request assistance. - Total roadblocks are prohibited unless lethal force is needed. - Partial roadblocks, officers should no pull alongside, pass fleeing vehicle. - Intentional collisions is prohibited, unless lethal force is needed. - Discharging firearm from moving vehicle prohibited unless other vehicle is using deadly force on Officer or other people. - Training Bureau shall provide pursuit policy annually. - Officer initiating pursuit must notify dispatch, location, vehicle, direction, violation, speed and any changes that occur. - Secondary Officer notify dispatch immediately and will be responsible for all radio communications with updates if requested by primary. - OO shall notify captain of pursuit and hold debriefing at station. **[COMFORT DOG PROGRAM 6.12]** - Undergo demonstration of efficiency every year. - Only handler can give commands to dog. - Comfort dog supervisor shall ensure training is conducted and records are maintained by the handler. **[DETECTIVE CALL-IN PROCDURE 6.13]** - Shall be duty of OO to notify the on-call CID supervisor any time of day. - Responsibility of on-call CID supervisor for their name posted at desk. - Upon arrival at scene, CID detective assumes responsibility/authority. - Superior Officer from another division may not intervene in investigative process, unless failure to do so results in gross error. **[OCCUPATIONAL TRAFFIC CRASHES 6.14]** - Shall notify dispatcher ASAP. - Officer involved shall no write handwritten witness statement. - UD10 will have same case number as report. - UD10 not required if (ALL APPLY): - No injuries. - Single motor vehicle crash. - Damage under \$1,000. - Private property. - Private vehicles - Codes \#1 & \#8 shall NOT be used on UD10. - City vehicles by non-officers - UD10 always (even private property)/Enter code \#6 & \#8. **[INVESTIGATIVE DETENTIONS & PAT-DOWN SEARCHES 6.17]** - Justification for pat-down - Only when officer has reasonable suspicion that they are armed. - Conducted by at least 2 Officers (1 for search/1 for cover). - Documenting victim/witness interviews - All victim/witness statements in station shall take place at desk. **[STRIP SEARCHES 6.19]** - Person arrested/detained for misdemeanor shall not be strip-searched unless BOTH occur: - Person arrested is being lodged in facility by order of court or reasonable cause to believe they are concealing weapons. - Has prior authorization from Chief or his designee. - Cavity searches not authorized without VALID SEACH WARRANT (unless certain circumstances). **[ENFORCEMENT OF TRAFFIC LAWS 6.20]** - Special classes of offenders: - Foreign diplomats, their families, official staff/servants have unlimited immunity criminally and civilly. - Consular officers have limited immunity from arrest or detention, except for commission of grave crimes. - US Armed Forces: - Active service in excess of **7 DAYS/6 MONTHS AFTER** - Shall confiscate and destroy suspended/revoked MI operator licenses. **[ARREST PROCEDURES 6.21]** - A fleeing man not in custody yet is not resisting but is avoiding. - Supervisors are equipped with special restraints for arms and legs. - Used if they are in danger or harming themselves, others, property. - MUST BE IN SEATED POSITION, NOT ON STOMACH. - Hog-tied techniques are NEVER to be used. - Alternatives to custodial arrest (special circumstances) - Minor Misd traffic offense on busy day taking officer off the road. - Offender is known and can be apprehended later. - Serious physical impairments, medical conditions, childcare. - Immunity from Civil arrest: - Civil process - Senate or House or Reps, in actual attendance of duties. - Party going to/returning from place required to attend. - Officer of court record (jurors) to and from court. - Immunity from Criminal arrest: - Anyone in route to appear at a criminal proceeding. - Person passing through state to appear to summons. - Congressional immunity: - Federal or state legislators while in transit to congress. - Diplomatic immunity - Exemptions to arrest immunity: - Treason. - Felony. - Breech of the peace, where necessary for public order. - Canadian citizens do not need passport or green card to enter U.S. - If unable to be restrained for physical reasons, use ambulance. - SHPD may arrest statewide if: - In possession of valid warrant. - Working with other agency and they are present. - In HOT PURSUIT.
