**Florida State Statutes:** **F.S.S. 901.15 Arrest without a warrant** **-**If information relayed from fellow law enforcement officer on ground or in the air that person violated 316 statute may arrest driver. -May arrest if probable cause suspect violated injunction or protection order for domestic, repeat violence, dating violence, or vulnerable adult. -May arrest if probable cause suspect committed act of domestic or dating violence has occurred. (Do not need consent from victim). -May arrest if probable cause suspect committed act of child abuse, luring or enticing child (does not require consent of victim). -May arrest for battery, criminal mischief, violation of safety/security zone, street racing, exposure of sexual organs, and sexual cyber harassment **F.S.S. 901.151 -- Stop and Frisk law** **-**Officer reasonably believes a person has committed, is committing or is about to commit a violation of law, the officer can temporarily detain the person to ascertain their identity and the circumstances surrounding the persons presence. -Cannot detain them "**LONGER THAN NECCESSARY"** to determine what was going on and shall not extend beyond the place where it was effected or the immediate vicinity thereof. -If the officer has probable cause to believe the person is armed, the officer can **"SEARCH"** the person. **F.S.S. 741.28 Domestic violence; definitions** **-**Domestic violence is any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment or any other criminal offense resulting in physical injury or death of family or household members. -Family or household member means spouses, **former spouses**, persons related by blood or marriage, residing together as if a family or who have resided together in the past as if a family, persons who are parents of a child in common. With exception of persons with child in common, the family members must be currently living **or in the past lived together as a family**. **F.S.S 1006.12 Safe School Officers at public school** -Each district school board and school district superintendent shall partner with law enforcement agencies or security agencies to establish or assign one or more safe-school officers at [each school] facility within the district, including charter schools. -A district school board must collaborate with charter school governing boards to facilitate charter school access to all safe-school officer options available under this section. -Each school must have one of the following: School resource officer, School safety officer, School guardian, School security guard. **-**Each safe-school officer who is also a sworn law enforcement officer shall complete mental [health crisis intervention] training using a curriculum developed by a national organization with expertise in mental health crisis intervention. -Only resource officers and school safety officers has law enforcement authority. **GENERAL ORDERS** **GO 1000.01 Supervisor Inquiry/Administrative investigations** -Any sheriff's office member, sworn or civilian, who observes, suspects, or is informed of misconduct by a member shall report the alleged or suspected violation(s) to a [supervisor or directly to the Internal Affairs Unit]. -Internal Affairs investigation: **STEP 3** or higher disciplinary action. Includes (**[Written Reprimand Level II, suspension, demotion, or dismissal]**). Examples: criminal misconduct, excessive force, unlawful arrest, sexual misconduct, missing property or money etc. -Supervisory inquiries: **STEP 2 OR LOWER** disciplinary action. Includes (**[Written Reprimand Level I, formal or informal counseling]**). Examples: rudeness or unprofessional conduct, minor conduct violations -member will informed of investigation and complainants prior to interview. -member will not be threatened with transfer, dismissal, or disciplinary action. -Any Sheriff's Office property may be searched at any time under direction of appropriate **[supervisor.]** \- Release of information regarding active IA only approved by **[Lieutenant of IA or Higher. ]** -Investigations are not concluded until **[Director/Undersheriff]** recommends final discipline. -Complaints against the agency can be received by what authority? **[Watch Commander or IA representative.]** -Complaints received by non-supervisor will be forward to **[appropriate supervisor,]** who will enter into blue teams. -who may conduct initial fact finding after receiving complaint? **[Watch commanders/lieutenants.]** -from the date a complaint is received, supervisor inquiry shall be completed within **[45 calendar days]**. Certain exceptions 180 day may be tolled. Closed investigation may be reponed for up to **[90 days.]** -complaints of bias policing will be forward to **[appropriate supervisor immediately.]** -Early warning system: -3 or more UoF within 365 days -3 or more vehicle damages, pursuits, or crashes within 365 days. -3 or more reports of on duty injury within 365 days -3 or more admin investigations within 365 days -3 or more supervisor inquires within 180 days -5 or more combined incidents within 180 days. -**[Supervisor]** will notate in Blue Team early warning notification reviewed with member. **GO 1000.02 -- Code of Conduct** **-**Member given an order that is in conflict with pervious orders, shall respectfully inform the ranking member issuing the order in conflict. If the superior member issuing order does not alter it, the member shall comply unless it violates law. -If a member is subject of criminal investigation, it will be handled by **[Integrity Section]**. -**[Public and internal support/cooperation]** of Sheriff's Office activities is imperative and generated through satisfactory **[public and interpersonal contacts]**. -If requested by public, member must identify themselves by name, rank and ID number. -If a member has to initiate law enforcement action against any member of another LEO agency, they must notify their **[supervisor]** who will notify the **[watch commander]**. -In public, when addressing each other, members will use **[title and last name]**. -Members shall not act as correspondent to any media unless authorized by **[the Sheriff.]** -Complaints against LEO or related agencies will be channeled through member's **[chain of command]**. -Members will not reveal the identity of a complainant or informant to a private person unless directed to do so by their **[supervisor]**. -Members will not use tobacco while on duty and in public view or off duty in uniform. They will not use tobacco inside agency vehicle. -When taking medications that impair or could impair performance, the member will notify **[supervisor.]** Members will do so **[prior to starting duty]**. -Members shall furnish notification in writing of their intent to file a suit arising out of their official duties in any court of law to the Sheriff **[not less than 5 days]** before the **[actual filing date]**. -Members who have a damage suit filed against them by reason of acts performed by them in line of duty shall notify their **[supervisor]** in writing who will notify the **[sheriff via chain of command.]** -Members requesting to speak to any public or private group as a representative of the sheriff's office shall be referred to their **[division chief]**. -Traffic or Misdemeanor citation may only be voided by **[issuing member and LT or higher.]** Recommendation to void must be reviewed and approved by **[division chief.]** \- acts by members which brings the Sheriff's Office which reflects discredit upon a member or impairs operation shall be considered **[unbecoming conduct.]** -members who feel discredited or injured by superior shall initiate grievance in writing via **[chain of command to the Sheriff. ]** \- [ ] **GO 1000.07 -- Recording Law Enforcement Activity** **-**Recording in public places is **[First Amendment]** right. -**[Act of recording]**, in itself is not grounds for detention. -If probable cause to believe evidence of serious crime has been recorded, consult **[supervisor]**, ask for consent to view the recording -under **[exigent circumstances]**, member may temporarily seize the recording equipment and obtain a search warrant. -If it is **[objectively reasonable]** to believe immediate viewing is necessary to **[prevent death or serious injury]** the recording device can be seized and viewed. -If an arrest is going to happen to a person recording or if device is going to be seized, **[a supervisor]** will be summoned. **GO 2000.04 -- Mutual Aid** **-**Signed local FDLE and Florida Sheriffs' Association mutual aid agreements are held by **[General Counsel]**. -Mutual aid agreements are in effect for **[4 years]** (think Sheriff's election term). -Situations requiring member respond to another jurisdiction if the other jurisdiction requests assistance, it goes through **[Watch Commander]**. -Mutual aid assistance request, the **[Sheriff]** or designee shall be the contact person. -Mutual aid assistance request, submitted by **[Sheriff or designee]**, via **[teletype]** and include needed resources. **GO 2000.08 -- Supervisor Responsibilities** **-newly promoted first line supervisor will receive supervisory training no later than [12 months] of appointment.** **-**Supervisors will not perform tasks of subordinates unless for training purposes or if needed. -Supervisor will not look to higher authority to initiate investigations within the **[scope of their authority,]** unless case warrants involvement of the **[Public Integrity Unit, or IA.]** -If an order is given is contrary to written directives, the member will report it to the Sheriff through chain of command. -Span of control is **[5-15]** members per 1 supervisor with the optimal number being **** -If giving an order to a member outside of their normal supervisor, the person giving the order will inform their **[supervisor asap]**. -On-duty watch commander has authority to act for the Sheriff during their watch. **GO 3000.01 -- Line of Duty Death or Injury** **-[Timely notification takes precedence]** over protocol in death notification. **-**Sworn member on scene is responsible for notifying the **[on-duty watch commander]** of death notification. -Death notification must be made to **[next of kin]** shortly after or same time as command notifications. -Only **[the Sheriff]** or designee may release death or injury information to media. -**[Directors]** will ensure notification to members within their command -Responsibility of making the notification or designating a notification officer remains with the **[watch commander]**. -the **[watch commander]** will assign at least **** other member to accompany notification officer. -Family should be driven to the hospital in an **[agency vehicle]**. If the family refuses to be transported then a member should accompany them in their vehicle. -if children are present in the home, **[victim advocate]** can be called. -The **[hospital liaison]** will be notified when the family is enroute. -The Critical Incident Stress Management (**[CISM) Team leader]** will be notified immediately by the communications section supervisor after consultation with the **[watch commander]**. -The **[Honor Guard Coordinator]** will be notified to activate the Honor Watch. -**[Watch commander]** will appoint hospital liaison member. -**[On-duty supervisor]** can initiate a Florida Blue Alert. -All criteria for Florida Blue Alert: -LEO killed, seriously injured, assaulted with deadly weapon, or missing. -Offender fled, posses imminent threat to public or other LEO. -Offender vehicle, tag, partial tag, or other means of escape are known -**[The Sheriff]** will assign a family liaison officer. -**[Sheriff's Office Liaison]** can initiate home watch for member's family for **[6-8 weeks]**. **GO 3000.02 -- Mission, Values, and Code of Ethics** **-[VISION:]** what the future would be like because of what we do every day. (**[Foster a safe community where families and businesses thrive]**). -**[MISSION STATEMENT:]** the purpose and intent of CCSO. (**[selflessly serve community with honor and courage)]**. -**[VALUES:]** are beliefs, convictions, or acceptance that certain things are true and real. Provide moral basis for our decisions. (**[Integrity, caring, excellence, teamwork]**.) **GO 2100.02 -- Appearance** **-Hair color can only be [natural colors.]** **-**Members fingernails can't be longer than **[¼ inch.]** -Men's hair cannot be longer than 1.5 inches long. -Sideburns will not extend below **[bottom of ear opening]** and not exceed **[1 inch]** in width. -Sideburns cannot be more than **[¼ inch]** in depth. -Female hair cannot go past **[uniform collar]**. -If female hair exceeds collar, must be placed in **[braids or bun.]** -Mustache/beard thickness no more than **[1 inch depth (\#8 guard).]** -no tattoos above **[collar bone.]** -Appropriateness of tattoos determined by **[Director of Admin and Business.]** -Facial Jewelry is **[prohibited.]** -Regulation issued uniform, insignia, and brass will be worn unless approved by **[supervisor]** or higher. -under shirt must be **[black]** if visible above collar. A **[sixth]** can be used and that is **[Intelligence/investigations]**. \*\*\*\*(**[COPLFI]**)\*\*\*\* -**[ICS]** is standardized approach to the command, control and coordination of on-scene incident management that provides common hierarchy within which personnel from multiple organizations can be effective. **-[National incident management system (NIMS]**) is a national approach to incident management. ICS is a component of NIMS. -All members will receive NIMS training consisting of **** FEMA courses: **[IS-100, IS-200, IS-700.]** -Responsibility for expanding and contracting ICS and EOC is with the **[incident commander and EOC Director]**. -Responsibility of subordinate functions defaults to **[next higher supervisor]** until delegated by supervisor. -**[Unified Command:]** no one jurisdiction has primary authority. No **["1" commander]** but managed by jointly approved objectives. \- ICS span of control is **** supervisor to **** subordinates. -The **[sheriff]** will exercise command and control over all involved LEO personnel if it effects whole county. -**[Resource unit leader:]** maintains a list of sworn members available to deploy. -**[Division Chiefs]** will provide list of unassigned members to resource unit leader. -members will inform their **[supervisor]** of any special family needs. -**[First member on scene]** should attempt to accomplish **[3 tasks:]** perform initial assessment of incident, identify the contaminated area/hot zone, establish perimeter, control and contain incident if possible. (**[PIE]**) or **[(AIP)]** -First on scene supervisor will accomplish **[6 tasks]**: will obtain verbal **[situation report]** from first on scene member face to face is possible, **[limit and control access]** to incident area, establish **[incident command post]**, secure 1 or more radio talk groups for the incident and **[broadcast locations]** (command post, staging area and media staging area), establish **[staging area]**, and assess **[resources]**. (SLIBSR) -**[First on scene Lieutenant]** will assume incident commander and determine if meets criteria. -Factors to determine ICS criteria: Nature of incident, jurisdiction, workforce and needs, number of victims/suspects, community and first responder safety, likelihood of cascading events, political sensitivity, and hazardous material. -If additional off duty assets needed, **[lieutenant]** will request staff page. I.E. SWAT, CNT, Dive. -**[Incident Command Post (ICP)]**: location of tactical level command, located near incident site. -**[Staging area]**: location where assets await assignment. Dispatch resources at a **[section chief request.]** -Primary radio channel is for the incident and move all normal traffic to a TAC channel if it is rapidly evolving. If not rapidly evolving, keep on TAC channel. -**[After Action Evaluation/Report]** will be conducted after activation of ICS used. **GO 3000.09 -- Response to Resistance** **-[Medical clearance]** anytime force is applied and there are signs of injury, complaints of injuries, or unconsciousness during or following UoF or when a sworn member reasonably believes an individual is in need of medical evaluation. -If a member witnesses excessive force they will step in and stop it and report it to their **[supervisor]** asap. -**[Lieutenant]** and below will carry **** less lethal options. -Use of OC Spray, Individual should receive medical attention if symptoms do not clear in **[45 minutes-1 hour]**. -Member will notify communication when subject is sprayed with OC spray and note the time the person was sprayed, decontaminated and who they were turned over to in the arrest report. -Must have **[active physical resistance]** to use taser. -Each discharge of a taser is considered an **[additional use of force.]** -Upon receiving subject who has been tased, detention will begin a **[15 minute observation]** period which will continue a **[minimum 4 hours]**. -Medical staff/EMS will also conduct vital sign checks every **[30 minutes]** during **[4 hour]** observation. -when discharging firearm, members will give verbal warning when feasible. -No discharging firearm from or into moving vehicle unless preventing death or great bodily harm, fleeing felon who presents imminent threat, or approved by **[watch commander]** or higher. -incidents of OIS, **[supervisor]** will respond to the scene, ensure watch commander notified, ensure medical treatment administered, and start ICS -Member who uses deadly force will be placed on admin leave for **[3 days]** and participate in psychological evaluation. -Incidents of OIS, **[watch commander]** will notify Assistant Chief of Patrol, ensure scene integrity, assign uninvolved support deputy to member involved. -Member will have follow-up within **[60 days]** after shooting. -**[Assistant Chief of HR]** will notify member of their duty status post OIS. -**[Watch commander]** will respond, investigate, and complete RTR for member discharging firearm at an animal. -Aggressive animal response, EDC is not preferred option. -RTR will be reviewed and approved by **[immediate supervisor]** and forward to **[Division Chief.]** -RTR incidents reviewed **[annually]** by **[Professional Oversight Lieutenant.]** **GO 3000.11 -- Agency Vehicle-Vessel Crash Damage & Review Board** **-**The **[Sheriff]** will review the findings of the crash review board. -A member involved in a crash will contact their **[supervisor]** **[immediately]**, who will respond to the scene. -**[Supervisor responsibility]** during member involved crash: collect all reports and take photographs of the scene for submission to **[chain of command]**. -The vehicle/vessel report will be conducted by the member **[within 24 hours]** of the crash. -The supervisor who responded to the scene will notify the **[chain of command]** by email. -**[Within 36 hours]** an appointment will be made with fleet to have vehicle assessed. -The incident type will be **[vehicle damage report]** and the disposition code is **[Code 0]** -members supervisor may request **[Patrol Division Supervisor]** to respond to crash involving injury to member. Request made through **[on duty watch commander.]** -Crashes involving criminal charges, death, or serious bodily injury are investigated by **[FHP]**. The **[watch commander]** will notify members chain of command and **[general counsel.]** -citations issued to a member, will be issued by **[command staff]**, assistant chief or higher. -For crashes involving sheriff's office members with no injuries or criminal charges, **[supervisor]** will investigate. If one is not available, the **[chief of patrol]** will authorize a member to investigate. -Crashes outside of county, member will notify **[supervisor or watch commander]** asap. -Designated insurance adjustor will be contacted for serious loss by the **[watch commander.]** Includes fatalities, serious bodily injury, or significant damage from pursuit. -Crash review board consists of **** Chiefs or assistant Chiefs. -The **[Chief of services]** is always the chairman, and any 4 of the other chiefs. -Crash review board will meet no less than **[once a quarter]** unless no crashes previous quarter. -Discipline will be issued **[within 7]** business days -**[Chairman]** can dispose case without board hearing if clearly not due to negligence. -**[Chargeable]** finding: crash resulted form negligence. -Improper (Action): crash is **[1-4 points]**. -Willful violation **[is 5-8 points]** -Reckless driving is **[9-12 points]**. -Vehicle neglect is **[2-6 points]**. -Board recommendations based on crashes within last **[3 years]**. -1 to 2 points: informal counseling -3 to 5 points: min-formal counseling, max-written reprimand -6 to 7 points: min-written reprimand, max- 5 day suspension w/out pay, demotion, loss of take home car for 90 days. -8 to 10 points: min- 3 day suspension w/out pay, max- 10 day suspension, loss of take home car from 1 year to 6 months. -11+ points: Min- 10 day suspension w/out pay, Max- termination. **GO 3100.02 -- Line Inspections** **-[Supervisors]** are responsible for inspections. Inspections are on-going activity. -Members will undergo line inspection **[quarterly]** by their supervisor. It will be documented on a quarterly vehicle/line inspection form. -Members with minor deficiencies will be re-inspected within **[10 working days]**. **GO 5300.01- Equal Employment Opportunity** -**[Supervisors]** are responsible for preventing harassment from occurring. They do not need complainant to investigate suspected harassment. -**[Supervisors]** responsibility to ensure all discrimination/harassment is investigated. -**[EEO Coordinator]** will be notified of all suspected discrimination/harassment. -Harassment becomes unlawful when: becomes condition of continued employment, and creates hostile work environment. -EEO Coordinator is designated as **[Assistant Chief of HR and Training]** and the **[Human Resources Manager.]** -Age discrimination is **[40 or older.]** -Respective department **[Director/Division Chief/Assistant Chief]** may investigate complaint unless involved. If unable to resolve in department, shall pass complaint to **[the Sheriff.]** **Standard Operating Procedures** **SOP 2140.01- Civil Process** **-**Sworn member serves process by delivering copy with time, date, initials and ID number of sworn member making the service. -Can do a drop service with anyone whom the respondent lives, but person must be **[at least 15 years old]**. -Usually cannot execute a service on Sunday of any writ, process or judgement unless its authorized **[by court order or an injunction for protection]**. -**[Orders of the court and temporary protection orders]** must be personally or individually served. -If **[two attempts]** to serve owner have been made at place of business, can do a substitute service during regular business hours by serving person in charge of business. -Minors who are or have **[been married]** are to be served as if they were adults. -If the person is incompetent, serve **[2 copies]** to the person who has care and read the order to the incompetent person. -A corporation must keep registered office open from **[1000-1200]** every day, except Saturdays, Sundays and holidays. -Possession of residential or non-residential premises where tenant cannot be found, eviction summons may be served if at least **[2 attempts]** made. Attempts must be at least **[6 hours]** apart. -Clay County SO does not serve non-enforceable process issued out of the state, unless required by **[Federal Law.]** -Foreign processes must be **[domesticated]** by plaintiff/petitioner through FL jurisdictional court. -Sworn member criminal witness subpoena not required to accept if appearance is less than **[5 days]** from date of service. -Service process addressed to the Sheriff or executive command will be served on **[general counsel.]** -If baker act or marchman act ex-parte order is received and not served by the end of civil process unit shift, it will be placed in a civil process unit mailbox and the civil sgt will notify the **[patrol watch commander or SGT in charge]**. -Execution of Marchman/Baker act order, member shall place information for the Ex-parte order in the **[notes]** and disposition **[code B-1]** indicating transport only. -if unusual circumstances or force used to serve Ex-Pate order, **[incident report]** required. -If not served by patrol, it will be put back in civil process mailbox at end of shift no later than **[0700 hours Monday-Friday]**. If not served on weekend, patrol will hold until civil returns back to work. -The order will be valid only until person is delivered or the period on the order is specified, whichever comes first. **[If no time limit, valid for 7 days]** after date that order was signed. -If it is a child custody order, **[supervisor]** will be present when it is served and it will be read to the person being served. -Required language for Child Custody Order, **["The Sheriff Shal, will, or is directed to."]** -Injunctions for Protection not served by Civil Unit, Civil Supervisor will notify **[Watch Commander. ]** -If any questions, the patrol SGT will contact civil SGT or judicial security lieutenant. -Writ of possession posted [Monday-Friday 0800-1700] and given **[24 hours]** before executing -**[Writ of possession]** takes priority over all other orders except risk protection orders, ex parte baker act, injunction for protection and enforceable child custody orders. -Civil process unit allows plaintiff up to 30 minutes of a sworn members presence if needed. refuse to cooperate, member cannot search without a **[warrant, unless exigent]**. -DCF refers to runaways as **[Children in Need of Supervision (CINS).]** -Circumstances justifying search of Missing Vice Versa applies in Clay County. -Under Cops w/out borders, **[suspects with warrants]** must give opportunity to go to the county jail in which they are arrested. -Under Cops w/out borders, **[violent felony suspects w/out warrant]**, shall be transported to Clay Jail. **SOP 3000.35 -- Death Investigations** **-**Order of priority in unnatural death: **[stabilizing scene]** to prevent further injury, **[attend to injured]**, **[apprehending]** suspects, protecting **[evidence]**, **[detaining]**/separating witnesses, **[obtaining information]** for reports- SAAPDO. -During unnatural deaths, **[Supervisor]** shall respond and request RHU. **-**Unnatural deaths the **[deputy]** will do a supplement. **[RHU detective]** will complete incident report. -Deputies will not enter scene of fire or hazmat till **[Ranking Fire Official]** declares it safe. -During fire related death, **[RHU Supervisor]** will coordinate with Fire Marshall's. -During boating accident death, **[Homicide detective or FWC]** will be called to scene. -**[Traffic Homicide Detective]** will be called or unnatural traffic accident deaths. -Deputy will record name of public safety agency, **[station, engine and rescue numbers]**. -Detective will be called out to any **[unnatural deaths, accidental deaths, unnatural infant deaths or if there is no attending physician]**. -Medical examiner cases are (**[Poison, suicide, accident, criminal violence, criminal abortion, actions in prison, suspicious or unusual circumstances, sudden death when in good health, disease constituting threat to public health, disease from employment, unattended by physician or police custody deaths]**). -RHU detective called out is responsible for contacting **[body transport, M.E.'s office, SAO in all juvenile deaths and deaths of criminal actions and contacting DCF for juvenile deaths]**. -Deputy does code 1 if death is **[natural]**, not requiring medical examiner, and **[physician will sign death certificate]**. -Once deputy as determined death is natural, they will contact funeral home of family's choice and give them business card containing Funeral home name, contact number, person deputy spoke with, funeral home response time and deputy contact information. -If there's no physician then it is a **[ME case]**. The **[Detective Supervisor]** should be contacted. -If a physician cannot be reached, **[ME]** will be contacted and advise if it meets criteria. -If death meets ME criteria, the deputy will call **[body transport]** through comms. -If there is no next of kin or indigent it is transferred **[to RHU and Code 1 completed]**. -Death involving Hospice do not require an incident report for the following: **[-over 18YO, in Hospice Program, and not indigent.]** **[-In Hospice and declared terminally ill.]** **[-Doctor agreed to sign prior to death. ]** -Deputy should call **[Community Hospice or Haven Hospice]** to verify if patient was under care of hospice. -Death involving Assisted Living, no incident report required for **[attended death.]** -Criteria for attended death: **[under care of medical staff/licensed doctor, not from accident, no suspicious circumstances. ]** -Natural deaths at Assisted Living and Hospice, **[Call notes]** should be entered with pertinent info. -Deaths involving Pedcare Program do not require Incident Report when: -**[Child under 18, in Pedscare program, and not indigent.]** **[-PedsCare declared them terminally ill]** **-[Doctor agreed to sign prior to death. ]** [ ] -Deputy should call **[Community Hospice or Pedscare]** to verify child was under pedscare program. -If death is ruled homicide/suspicious, **[property]** will stay on the body and transported to ME office. List property on incident report. -If case is involving prescribed medications**[, Photograph/collect meds, inventory them and submit into evidence.]** -During RHU Response, minimum of **** Homicide Supervisor and a **[homicide team]** will respond. -It is the responsibility of the **[homicide detective]** to ensure homicide supervisor is notified. -**[Homicide detective]** is responsible for inner perimeter and evidence collection. -If death is non-medical examiner case, SO member should not handle personal property unless needed. -On an outdoor crime scene a minimum **[100 foot]** perimeter is recommended. -Detectives will coordinate with **[Homicide Supervisor]** for interagency assistance. -Names of all persons who enter crime scene will be included in homicide supplement report. -**[RHU supervisor]** will coordinate with SAO to determine if sworn statement will be completed by the State Attorney. -On scene **[homicide supervisor]** determines when to release the scene. -Local death notification non detective callout, On duty patrol **[supervisor]** and **** deputy will make next of kin notifications. -Next of kin notification will be made **[in person]**. -Life threatening cases, next of kin should be directed to **[hospital]** where **[notification]** will be made. -The **[Chaplain, FOP President, and EAP Administrator]** will be notified of all deaths involving a member, or family member of CCSO. -If death happens in detention facility, next of kin will be responsibility of **[FDLE.]** \- Once next of kin notification complete for Detention death, the **[RHU detective]** will then notify the **[on-duty watch commander]**. **SOP 3000.46 -- Response to Unusual Occurrences** Chief of narc and special operations is in charge of equipment which will be inspected annually. Chief of narc and special operations office maintains copy of Clay County Comprehensive Emergency Management Plan for the county. The Sheriff is the ultimate command of all members The Director of investigations and special operations is the Crisis Management Event Incident Commander The chiefs are in charge of tactical operations EOC personnel consists of Chairman of the county commission, Sheriff, utility representatives, director of Emergency Management and their assistants as listed in the comprehensive emergency management plan. Tactical Operation Center is designated by the Sheriff or event director. It will be physically separated from the emergency operations center and command post. Tactical operations center is operated from the Communications Section, mobile command post, Sheriff's conference room or other area with command staff present. Situational Maps are located in mobile command post. Food plan maps are available through chief of narc Response planning gives direction and guidance for reaction to and controlling unusual occurrences. Crisis response plans are located on Emergency Prepardness sharepoint page. Watch commander will initiate agencys first response Supervisor will maintain notification information for their subordinates both on and off duty. Emergency recall list and an automated list will be utilized by all supervisors and will be updated every 3 months. Test of emergency recall plan will be conducted semi annual basis. Level 1 can be handled my watch commander and members Level 2 requires activation of one or more special teams. Level 3 activation of one or more special teams and use of additional existing and off duty members. Activation of the scene commander procedure and tactical command post. Level 4 complete and total activation of the Crisis Management Response Plan. PIO or watch commander responsible for press release. Response members shall be assigned as 2 units to patrol area. Watch commander or higher will order traffic control for particular routes. Exact time barricades are placed and traffic posts manned will be determined by on-scene supervisor. If an arrest is made and cant identify them, they will be listed as John Doe **SOP 3000.50 -- Eyewitness Identification** -Live lineup consist of minimum **** people including suspect. -When the functional equivalent procedure is used in sequential photo lineup, suspect placed in **[random place]** in each lineup by **[shuffling folders]**. -Per FSS, lineups must be conducted by **[an independent administrator.]** -Both **[sequential]** and **[simultaneous]** methods of photo lineup are authorized for use. -Non-independent administrator Sequential photo array requires at least **[2 blank]** photos. Total of 8 folders. -When sequential photo array not presented by independent administrator, **[number photos or folders]** after shuffling them. -When being administered by independent administrator for photo array at least two blank photos introduced following **[6^th^]** photo. -Must have **[probable cause]** to move suspect's location. -Moving suspect without PC violates their **[4^th^ amendment.]** -During Show ups, witnesses will **[be brought to suspect location.]** **SOP 3310.03 School Resource Program** The agency has established a department known as School Safety and Youth Programs (SSYP). The school resource officer/school safety officer concept is a nationally accepted program involved in the placement of law enforcement officers within the educational environment. School Resource Officers (also known as School Safety Officer) are assigned to all Clay County schools. Cases can be reassigned to the SRO unit with approval. A sworn member wishing to transfer a case to an SRO must review the case with their immediate supervisor to ensure all the required guidelines have been met. If a sworn member wishes to retain the case and work to a logical conclusion, the sworn member must obtain the approval of their immediate supervisor, who will forward a copy of the report to SSYP for information purposes. The function of the School Safety and Youth Programs (SSYP) Department is to ensure a safe environment for learning and to educate children and their parents on Florida laws upon request. Once selected as an SRO, the member will have one (1) year to obtain Crisis Intervention (CIT), and School Resource Officer Certification. Long guns will be secured in the member's assigned patrol vehicle. B. Members shall move their rifle into their assigned school office to secure in the office gun safe after the first bell has rung to avoid causing a distraction to parents or to the student population. **SOP 5300.05 -- Domestic Violence** Deputy will write an incident report on every case when a crime has been committed or an allegation of violence. If it is witnessed by minors or involves minors, DCF will be called. Domestic violence detectives will work with Quigley house, DCF and SAO. Domestic Violence detectives report to SVU SGT. Suspect classification A rating is 4 or more domestic violence related offenses or if the offender has a violent record including domestic violence, use of weapon in DV incident, Violation of protection order, violated no contact or pretrial injunction. B rating upon third charge of domestic violence related offense or violation of prohibited behavior as a C rated offender. C rating upon second charge of Domestic violence offense. D rating if offender has 1 previous domestic violence charge within 3 years or a person is the subject of 3 incidents documented in domestic disturbance without violence FIR within 3 years, or if the reviewing deputy, detective or SVU SGT believe the potential for violence exists, or 4 domestic incidents within 3 years. Deputy should not arrest both parties for DV unless absolutely necessary. Deputy should find primary aggressor and make arrest if probable cause exists. If no contact is made at a residence, deputy will call SGT who will determine if forced entry should be made. If any recent arrests were made call Jail booking to see if any pretrial release orders are being violated. If the victim refuses to go to the Quigley house, deputy will contact SGT and request a step-up list until suspect is brought before a judge or no contact order obtained. Deputy will read the offender the Domestic Violence Offender Focus Notification and indicate in the Code 1 they did so. Cases can be transferred to SVU if the offender is gone and cant be found, felony case or repeated case. If retained by patrol they must be completed within 4 calendar days and the SGT will email the SVU supervisor a notification with case number. Deputy will complete DV Probable Cause Affidavit for Subject Not in Custody (DVPCA) by end of shift for any acts of domestic violence. Deputy will check NCIC/FCIC for previous conviction of battery, Agg Batt or felony battery due to it being a 3^rd^ degree felony for second or subsequent offense. A rated offenders receive face to face contact quarterly or more. B rated receive face to face as needed. C rated get face to face at time of the arrest, before pretrial release, on probation visit or on follow-up visit. D rated get a letter from DV unit. If the offender has moved they will get a letter or phone call. If obtaining a warrant it must be done within 48 hours. If responding to case involving CCSO member, deputy will contact watch commander or designee who will respond. Supervisor will contact public integrity.
