Free of any grammar error. (2 points) Clarity: Simple and easy to understand Republic Act 9293 - An Act Amending Certain Sections of RA 7836 With the passage of the RA 9293, the following are provisions that were amended in RA 7836: 1. "The changes in Section 15, (e) (3) of Republic Act No. 7836 provide that a graduate of a school college or university recognized by the government and possesses the minimum educational qualifications is qualified to take the exam as long as s/he is a holder of a bachelor's degree in early childhood education (BECED) or its equivalent for pre-school teachers; a bachelor's degree in elementary education (BSEED) or its equivalent for elementary teachers; a bachelor's degree in education or its equivalent with a major and minor, or a bachelor degree in arts and sciences with at least eighteen (18) units in professional education for secondary teachers; and a bachelor's degree in the field of specialization or its equivalent, with at least eighteen (18) units in professional education for teachers of vocational and two-year technical courses." (Section 1) Republic Act 9293 - An Act Amending Certain Sections of RA 7836 2. "Teachers who were holders of certificates of eligibility issued by Civil Service Commission and the DECS and those registered professional teachers with the National Board for Teachers under PD 1006 are exempted from the taking the exam." (Section 2) Republic Act 9293 - An Act Amending Certain Sections of RA 7836 3. "Professional teachers who have not practiced their profession for the past five(5) years shall take at least twelve (12) units of education courses, consisting of at least six (6) units of pedagogy and six (6) units of context courses or the equivalent training and number of hours to be chosen from a list of courses to be provided by the Board and the Department of Education, before they can be allowed to practice their profession in the country." (Section 2) Republic Act 9293 - An Act Amending Certain Sections of RA 7836 4. "Those who have failed the licensure examination for professional teachers, with a rating of not lower than five percentage points from the passing general average rating, shall be eligible as para-teachers upon issuance by the Board of a two-year special permit, renewable for a non-extendible period of two (2) years. The para- teachers shall be assigned to areas where there is a shortage or absence of a professional teacher, as identified and provided by the Department of Education and the Autonomous Region for Muslim Mindanao (ARMM) education department to the Board for professional teachers and to the Commission. The special permit shall indicate the area of assignment of the para-teachers." (Section 2) Republic Act 9293 - An Act Amending Certain Sections of RA 7836 5. "A special permit may also be issued by the Board to a person who has excelled and gained international recognition and is a widely acknowledged expert in his or her respective field of specialization." Unjustified or willful failure to attend seminars, workshops, conferences and the like or the continuing education program prescribed by the Board and the Commission Philippine Professional Standards for Teachers (PPST) Professional standards are important in the continuing professional development and advancement of teachers as articulated in DepEd Order 42, s. 2017, titled, "National Adoption and Implementation of the Philippine Professional Standards for Teachers (PPST)," it shall serve as framework for teacher quality and teacher development. Philippine Professional Standards for Teachers (PPST) Specifically, PPST is designed to set out clear expectations of teachers along well defined career stages of professional development from beginning to distinguished practice, engage teachers to actively embrace a continuing effort in attaining proficiency, and apply a uniform measure to assess teacher performance, identify needs, and to provide support for professional development. Philippine Professional Standards for Teachers (PPST) The PPST defines teacher quality in the Philippines. It has seven domains and 37 strands that pertain to more specific dimensions of teacher practices. Philippine Professional Standards for Teachers (PPST) Domain 1, Content Knowledge and Pedagogy - emphasizes the importance of mastery of content knowledge and its interconnectedness within and across curriculum areas, coupled with a sound and critical understanding of the application of theories and principles of teaching and learning. Teachers apply developmentally appropriate and meaningful pedagogy grounded on content knowledge and current research. They display proficiency in Mother Tongue, Filipino, and English to facilitate the teaching and learning process, as well as exhibit the needed skills in the use of communication strategies, teaching strategies and technologies to promote high-quality learning outcomes. Philippine Professional Standards for Teachers (PPST) Domain 2, Learning Environment - refers to learning environments that are safe, secure, fair and supportive in order to promote learner responsibility and achievement. Teachers create an environment that is learning-focused and efficiently manage learner behavior in a physical and virtual space. They utilize a range of resources and provide intellectually challenging and stimulating activities to encourage constructive classroom interactions geared toward the attainment of high standards of learning. Philippine Professional Standards for Teachers (PPST) Domain 3, Diversity of Learners - highlights the establishment of learning environments that are responsive to learner diversity. Teachers respect learners' diverse characteristics and experiences as inputs to the planning and design of learning opportunities. They encourage the celebration of diversity in the classroom and the need for teaching practices that are differentiated to encourage all learners to be successful citizens in a changing local and global environment. Philippine Professional Standards for Teachers (PPST) Domain 4, Curriculum and Planning - focuses on the interaction with the national and local curriculum requirements. Teachers translate curriculum content into learning activities that are relevant to learners and based on the principles of effective teaching and learning. They apply their professional knowledge to plan and design well-structured and sequenced lessons that are contextually relevant, individually or in collaboration with colleagues, responsive to learners' needs and incorporate a range of teaching and learning resources. They communicate learning goals to support learner participation, understanding and achievement. Philippine Professional Standards for Teachers (PPST) Domain 5, Assessment and Reporting - deals with the application of a variety of assessment tools and strategies in monitoring, evaluating, documenting and reporting learners' needs, progress and achievement. Teachers use assessment data in a variety of ways to inform and enhance the teaching and learning process and programs. They provide learners with the necessary feedback about learning outcomes that informs the reporting cycle and enables teachers to select, organize and use sound assessment processes. Philippine Professional Standards for Teachers (PPST) Domain 6, Community Linkages and Professional Engagement - focuses on the establishment of school-community partnerships aimed at enriching the learning environment, as well as the community's engagement in the educative process. Teachers identify and respond to opportunities that link teaching and learning in the classroom to the experiences, interests and aspirations of the wider school community and other key stakeholders. They understand and fulfill their obligations in upholding professional ethics, accountability, and transparency to promote professional and harmonious relationships with learners, parents, schools and the wider community. Philippine Professional Standards for Teachers (PPST) Domain 7, Personal Growth and Professional Development - emphasizes teacher's personal growth, professional development and high personal regard for the profession by maintaining qualities that uphold the dignity of teaching such as caring attitude, respect, and integrity. They value personal and professional reflection and learn to improve their practice. They assume responsibility for personal growth and professional development for lifelong learning. Philippine Professional Standards for Teachers (PPST) Moreover, PPST offers four career stages. Career Stage 1 or Beginning Teachers are those who have gained the qualifications recognized for entry into the teaching profession. Teachers at this stage are supported to reach Career Stage 2 within two to three years. Career Stage 2 or Proficient Teachers are professionally independent in the application of skills vital to the teaching and learning process. This stage shows the acceptable standards for all teachers, which should be reached within the first two or three years of teaching. Philippine Professional Standards for Teachers (PPST) Career Stage 3 or Highly Proficient Teachers consistently display a high level of performance in their teaching practice. They are accomplished practitioners who mentor and work collegially with other staff. This is the stage that Master Teachers are expected to be at. Career Stage 4 or Distinguished Teachers embody the highest standards for teaching grounded in global best practice. They are recognized as leaders in education, contributors to the profession and initiators of collaborations and partnerships. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers I.DECLARATION OF POLICY COVERAGE Sec. 1. Declaration of Policy. It is hereby declared to be the policy of this Act to promote and improve the social and economic status of public school teachers, their living and working conditions, their terms of employment and career prospects in order that they may compare favorably with existing opportunities in other walks of life, attract and retain in the teaching profession more people with the proper qualifications, it being recognized that advance in education depends on the qualifications and ability of the teaching staff and that education is an essential factor in the economic growth of the nation as a productive investment of vital importance. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 2. Title Definition. This Act shall be known as the "Magna Carta for Public School Teachers" and shall apply to all public school teachers except those in the professorial staff of state colleges and universities. As used in this Act, the term "teacher" shall mean all persons engaged in classroom teaching, in any level of instruction, on full-time basis, including guidance counselors, school librarians, industrial arts or vocational instructors, and all other persons performing supervisory and/or administrative functions in all schools, colleges and universities operated by the Government or its political subdivisions; but shall not include school nurses, school physicians, school dentists, and other school employees. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers II. RECRUITMENT AND CAREER Sec. 3. Recruitment and Qualification. Recruitment policy with respect to the selection and appointment of teachers shall be clearly defined by the Department of Education: Provided, however, That effective upon the approval of this Act, the following shall constitute the minimum educational qualifications for teacher-applicants: (a) For teachers in the kindergarten and elementary grades, Bachelor's degree in Elementary Education (B.S.E.ED.); REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers (b) For teachers of the secondary schools, Bachelor's degree in Education or its equivalent with a major and a minor; or a Bachelor's degree in Arts or Science with at least 18 professional units in Education. (c) For teachers of secondary vocational and two years technical courses, Bachelor's degree in the field of specialization with at least 18 professional units in education; (d) For teachers of courses on the collegiate level, other than vocational, master's degree with a specific area of specialization; REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Provided, further, That in the absence of applicants who possess the minimum educational qualifications as hereinabove provided, the school superintendent may appoint, under a temporary status, applicants who do not meet the minimum qualifications: Provided, further, That should teacher-applicants, whether they possess the minimum educational qualifications or not, be required to take competitive examinations, preference in making appointments shall be in the order of their respective ranks in said competitive examinations: And provided, finally, That the results of the examinations shall be made public and every applicant shall be furnished with his score and rank in said examinations. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 4. Probationary Period. When recruitment takes place after adequate training and professional preparation in any school recognized by the Government, no probationary period preceding regular appointment shall be imposed if the teacher possesses the appropriate civil service eligibility: Provided, however, That where, due to the exigencies of the service, it is necessary to employ as teacher a person who possesses the minimum educational qualifications hereinabove set forth but lacks the appropriate civil service eligibility, such person shall be appointed on a provisional status and shall undergo a period of probation for not less than one year from and after the date of his provisional appointment. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 5. Tenure of Office. Stability on employment and security of tenure shall be assured the teachers as provided under existing laws. Subject to the provisions of Section three hereof, teachers appointed on a provisional status for lack of necessary civil service eligibility shall be extended permanent appointment for the position he is holding after having rendered at least ten years of continuous, efficient and faithful service in such position. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 6. Consent for Transfer Transportation Expenses. Except for cause and as herein otherwise provided, no teacher shall be transferred without his consent from one station to another.Where the exigencies of the service require the transfer of a teacher from one station to another, such transfer may be effected by the school superintendent who shall previously notify the teacher concerned of the transfer and the reason or reasons therefor. If the teacher believes there is no justification for the transfer, he may appeal his case to the Director of Public Schools or the Director of Vocational Education, as the case may be. Pending his appeal and the decision thereon, his transfer shall be held in abeyance: REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Cont.… Provided, however, That no transfers whatever shall be made three months before any local or national election. Necessary transfer expenses of the teacher and his family shall be paid for by the Government if his transfer is finally approved. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 7. Code of Professional Conduct for Teachers. Within six months from the approval of this Act, the Secretary of Education shall formulate and prepare a Code of Professional Conduct for Public School Teachers. A copy of the Code shall be furnished each teacher: Provided, however, That where this is not possible by reason of inadequate fiscal resources of the Department of Education, at least three copies of the same Code shall be deposited with the office of the school principal or head teacher where they may be accessible for use by the teachers. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 8. Safeguards in Disciplinary Procedure. Every teacher shall enjoy equitable safeguards at each stage of any disciplinary procedure and shall have: a. the right to be informed, in writing, of the charges; b. the right to full access to the evidence in the case; c. the right to defend himself and to be defended by a representative of his choice and/or by his organization, adequate time being given to the teacher for the preparation of his defense; and d. the right to appeal to clearly designated authorities. No publicity shall be given to any disciplinary action being taken against a teacher during the pendency of his case. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 9. Administrative Charges. Administrative charges against a teacher shall be heard initially by a committee composed of the corresponding School Superintendent of the Division or a duly authorized representative who should at least have the rank of a division supervisor, where the teacher belongs, as chairman, a representative of the local or, in its absence, any existing provincial or national teacher's organization and a supervisor of the Division, the last two to be designated by the Director of Public Schools. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers The committee shall submit its findings and recommendations to the Director of Public Schools within thirty days from the termination of the hearings: Provided, however, That where the school superintendent is the complainant or an interested party, all the members of the committee shall be appointed by the Secretary of Education. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 10. No Discrimination. There shall be no discrimination whatsoever in entrance to the teaching profession, or during its exercise, or in the termination of services, based on other than professional consideration. Sec. 11. Married Teachers. Whenever possible, the proper authorities shall take all steps to enable married couples, both of whom are public school teachers, to be employed in the same locality. Sec. 12. Academic Freedom. Teachers shall enjoy academic freedom in the discharge of their professional duties, particularly with regard to teaching and classroom methods. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers III.HOURS OF WORK AND REMUNERATION Sec. 13. Teaching Hours. Any teacher engaged in actual classroom instruction shall not be required to render more than six hours of actual classroom teaching a day, which shall be so scheduled as to give him time for the preparation and correction of exercises and other work incidental to his normal teaching duties: Provided, however, That where the exigencies of the service so require, any teacher may be required to render more than six hours but not exceeding eight hours of actual classroom teaching a day upon payment of additional compensation at the same rate as his regular remuneration plus at least twenty-five percent of his basic pay. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 14. Additional Compensation. Notwithstanding any provision of existing law to the contrary, co-curricula and out of school activities and any other activities outside of what is defined as normal duties of any teacher shall be paid an additional compensation of at least twenty-five percent of his regular remuneration after the teacher has completed at least six hours of actual classroom teaching a day. In the case of other teachers or school officials not engaged in actual classroom instruction, any work performed in excess of eight hours a day shall be paid an additional compensation of at least twenty-five percent of their regular remuneration. The agencies utilizing the services of teachers shall pay the additional compensation required under this section. Education authorities shall refuse to allow the rendition of services of teachers for other government agencies without the assurance that the teachers shall be paid the remuneration provided for under this section. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 15. Criteria for Salaries. Teacher's salaries shall correspond to the following criteria: (a) they shall compare favorably with those paid in other occupations requiring equivalent or similar qualifications, training and abilities; (b) they shall be such as to insure teachers a reasonable standard of life for themselves and their families; and (c) they shall be properly graded so as to recognize the fact that certain positions require higher qualifications and greater responsibility than others: REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Provided, however, That the general salary scale shall be such that the relation between the lowest and highest salaries paid in the profession will be of reasonable order. Narrowing of the salary scale shall be achieved by raising the lower end of the salary scales relative to the upper end. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 16. Salary Scale. Salary scales of teachers shall provide for a gradual progression from a minimum to a maximum salary by means of regular increments, granted automatically after three years: Provided, That the efficiency rating of the teacher concerned is at least satisfactory. The progression from the minimum to the maximum of the salary scale shall not extend over a period of ten years. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 17. Equality in Salary Scales. The salary scales of teachers whose salaries are appropriated by a city, municipal, municipal district, or provincial government, shall not be less than those provided for teachers of the National Government. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 18. Cost of Living Allowance. Teacher's salaries shall, at the very least, keep pace with the rise in the cost of living by the payment of a cost-of-living allowance which shall automatically follow changes in a cost-of-living index. The Secretary of Education shall, in consultation with the proper government entities, recommend to Congress, at least annually, the appropriation of the necessary funds for the cost-of-living allowances of teachers employed by the National Government. The determination of the cost-of-living allowances by the Secretary of Education shall, upon approval of the President of the Philippines, be binding on the city, municipal or provincial government, for the purposes of calculating the cost-of- living allowances of teachers under its employ. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 19. Special Hardship Allowances. In areas in which teachers are exposed to hardship such as difficulty in commuting to the place of work or other hazards peculiar to the place of employment, as determined by the Secretary of Education, they shall be compensated special hardship allowances equivalent to at least twenty-five percent of their monthly salary. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 20. Salaries to be Paid in Legal Tender. Salaries of teachers shall be paid in legal tender of the Philippines or its equivalent in checks or treasury warrants. Provided, however, That such checks or treasury warrants shall be cashable in any national, provincial, city or municipal treasurer's office or any banking institutions operating under the laws of the Republic of the Philippines. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 21. Deductions Prohibited. No person shall make any deduction whatsoever from the salaries of teachers except under specific authority of law authorizing such deductions: Provided, however, That upon written authority executed by the teacher concerned, (1) lawful dues and fees owing to the Philippine Public School Teachers Association, and (2) premiums properly due on insurance policies, shall be considered deductible. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers IV.HEALTH MEASURES AND INJURY BENEFITS Sec. 22. Medical Examination and Treatment. Compulsory medical examination shall be provided free of charge for all teachers before they take up teaching, and shall be repeated not less than once a year during the teacher's professional life. Where medical examination show that medical treatment and/or hospitalization is necessary, same shall be provided free by the government entity paying the salary of the teachers. In regions where there is scarcity of medical facilities, teachers may obtain elsewhere the necessary medical care with the right to be reimbursed for their traveling expenses by the government entity concerned in the first paragraph of this Section. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 23. Compensation For Injuries. Teachers shall be protected against the consequences of employment injuries in accordance with existing laws. The effects of the physical and nervous strain on the teacher's health shall be recognized as a compensable occupational disease in accordance with existing laws. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers V. LEAVE AND RETIREMENT BENEFITS Sec. 24. Study Leave. In addition to the leave privileges now enjoyed by teachers in the public schools, they shall be entitled to study leave not exceeding one school year after seven years of service. Such leave shall be granted in accordance with a schedule set by the Department of Education. During the period of such leave, the teachers shall be entitled to at least sixty percent of their monthly salary REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Cont.… : Provided, however, That no teacher shall be allowed to accumulate more than one year study leave, unless he needs an additional semester to finish his thesis for a graduate study in education or allied courses: Provided, further, That no compensation shall be due the teacher after the first year of such leave. In all cases, the study leave period shall be counted for seniority and pension purposes. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Cont.… The compensation allowed for one year study leave as herein provided shall be subject to the condition that the teacher takes the regular study load and passes at least seventy-five percent of his courses. Study leave of more than one year may be permitted by the Secretary of Education but without compensation. REPUBLIC ACT NO. 4670The Magna Carta for Public School Teachers Sec. 25. Indefinite Leave. An indefinite sick leave of absence shall be granted to teachers when the nature of the illness demands a long treatment that will exceed one year at the least. Sec. 26. Salary Increase upon Retirement. Public school teachers having fulfilled the age and service requirements of the applicable retirement laws shall be given one. range salary raise upon retirement, which shall be the basis of the computation of the lump sum of the retirement pay and the monthly benefits thereafter. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act The criteria for assistance includes: 1. tuition fees charged by the schools; 2. socio-economic needs of each region giving priority to the Social Reform Agenda; 3. over-all performance of the schools; 4. academic qualifications and financial needs of the students and teachers; Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act The criteria for assistance includes: 5. financial needs of the schools; 6. geographic spread and size of student population; and 7. the students must be enrolled in schools which have accredited programs or applying for accreditation. "Preference shall given to students whose family income is not more than Seventy-two thousand pesos (P72,000.00)..." Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act *programs of assistance to students and teachers of private post- secondary vocational and technical institutions and higher educational institutions shall likewise be extended to students and teachers of community colleges in degree and non-degree programs. Implementation of the program shall encourage students to undergo post-secondary vocational and technical and higher education courses in the same region where their families reside." The financial assistance shall be extended only to students who are citizens of the Philippines. (Section 3) Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 4 - Forms of Assistance. The forms of assistance to students in private education are the following: "1)Tuition fee supplements for students in private high schools, including students in vocational and technical courses; 2)High School Textbook Assistance Fund 3)Expansion of the existing Educational Service Contracting [ESC] Scheme; 4)The voucher system of the Private Education Student Financial Assistance Program (PESFA); Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 4 - Forms of Assistance. The forms of assistance to students in private education are the following: 5)Scholarship grants to students graduating as valedictorians and salutatorians from secondary schools; 6)Tuition fee supplements to students in private colleges and universities; and 7)Education Loan Fund."College Faculty Development Fund. “ (Section 4) Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 4 - Forms of Assistance. The government also provides assistance for high school textbooks. The Department of Education (DepEd) shall establish a High School Textbook Assistance Fund so that assistance can be given to each student enrolled in private schools. The textbook assistance shall be granted only to the beneficiaries of tuition fee supplements and educational service contracting scheme. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 7 - Expansion of the Existing Educational Service Contracting (ESC) Scheme With regard to the Educational Service Contracting Scheme (ESC), DepEd "shall continue to enter into contracts with private schools whereby the government shall shoulder the tuition and other fees of high school students who shall enroll in private high schools under this program." DepEd "shall also enter into contracts with private schools in communities where there are no public high schools, in which case the Department shall shoulder the tuition and other fees of students who shall enroll in said private schools." Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act It is emphasized that "the amount of assistance to be given by the government shall not exceed that determined as the per student cost in public high schools." and "The Department shall fully pay the subsidized amount to participating schools not later than one hundred eighty(180) days from the close of the registration period." Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 8 - Assistance to College Freshmen1. Voucher system of Private Education Student Financial Assistance [PESFA) Program.This assistance covers degree and non-degree vocational or technical courses including all qualified enrolling first year students. "Such financial assistance shall be granted to deserving underprivileged students, who shall be selected on the basis of family income, geographic spread and results of competitive examinations to be given by the CHED for degree courses and the TESDA for non- degree vocational/technical courses in all secondary schools in coordination with the DECS. The program shall be equitably allocated to provinces and cities in accordance with regional and national plans to priority courses as determined by the CHED and the TESDA." Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Under the law, an underprivileged students is referred to as "whose gross income, if any, and that of the combined annual gross income of his parents do not exceed Seventy-two thousand pesos (P72,000.00).“ "Private post-secondary vocational and technical institutions and higher educational institutions shall provide for full or half tuition waivers for five percent (5%) of the entering freshmen, which shall include among others, valedictorians and salutatorians of both public high schools and private high schools: Provided, That those valedictorians and salutatorians meet admission tests of the schools concerned." Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act 3. In addition to tuition waivers granted by the school concerned, the valedictorians shall be entitled to allowances from the government as provided to PESFA grantees, provided they shall enroll in priority courses. Likewise, other honourees in case that the graduating class is composed of more than 250 students, all salutatorians and first honorable mention graduates may also be entitled to the allowance. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 10 - Education Loan Fund The Students' Loan Fund which will be administered by the Commission on Higher Education (CHED) and the Technical Education and Skills Development Authority (TESDA) to finance the educational loans to cover matriculation and other school fees and expenses like books and board and lodging through the "Study Now, Pay Later" program. " Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Amounts covering payments for tuition and other school fees shall be paid directly to the school concerned. Any loan granted shall be paid by the student-debtor after he has finished the course or profession for which the proceeds of the loan was expended, but only after a period of two (2) years from the time he has acquired an employment: Provided, however, That interest at the rate of not more than six percent (6%) per annum shall accrue on the balance thereof." The Social Security System shall also give assistance to its members and to private schools for school buildings and improvement of their facilities. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 11 - Condition for the Disqualification Any student who fails for one school year in the majority of the academic subjects in which he has enrolled during the course of his study shall not be qualified to avail of the benefits of this law, unless such failure is due to some valid cause beyond his control. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 12 - In-service Training Fund DepEd shall establish an Inset Fund to provide for the upgrading of technical know-how, pedagogical skills and competencies as well as the use of multimedia and ICT skills of teachers. The Inset Fund shall only be available to licensed teachers in participating private schools. Another condition is that the amount of Inset Fund available to private secondary education shall not exceed what is available to public secondary education on a per capita basis. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 13 - College Faculty Development Fund In both TESDA and CHED, there shall be a "College Faculty Development Fund to provide for scholarships for graduate degree, degree and non-degree workshops or seminars for faculty members in private post-secondary vocational and technical institutions and higher educational institutions: Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Cont.… Provided, That faculty member recipients of such scholarships shall serve as many number of years return service for every year of scholarship availed of as may be determined by the State Assistance Council in conformity with prevailing National Economic and Development Authority (NEDA) policies on return service of government scholars. The scholarship shall be in priority courses as determined by the TESDA and the CHED and cannot be awarded to promote or inhibit sectarian purposes." Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec 14 - Teacher's Salary Subsidy Fund Teachers' Salary Subsidy Fund aims to grant government subsidy to teachers in private high schools participating in the programs of assistance, provided: 1. That the total monthly salary which includes the subsidy to be received by such private high school teachers shall not be more than eighty percent (80%) of the salary of his counterpart in the public sector; Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Cont.… 2. That the amount of monthly subsidy shall not exceed the amount of any monthly salary increase that teachers in public high schools shall, after the effectivity of this Act hereinafter, receive; 3. That private high school teachers qualified to receive subsidy under this Act are duly licensed by the Professional Regulation Commission; Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Cont.… 4. That the government shall provide them with a voucher for the salary subsidy which shall be reimbursed directly to the teachers within 60 days after the close of the school year upon submission of proof of qualification and actual teaching service in a participating private high school; 5. That the present allocation out of increases from tuition and other income shall be maintained; and 6. That in case of insufficiency of funds, priority shall be given to married teachers supporting a family. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Sec. 15 - Program Administration/Rules and Regulations The main actor in the implementation of this financial assistance is the State Assistance Council, which "shall be responsible for policy guidance and direction, monitoring and evaluation of new and existing programs, and the promulgation of the rules and regulations, while the Department of Education, Culture and Sports, the TESDA and the CHED shall be responsible for the day to day administration and program implementation for the programs of assistance to private secondary education, post-secondary vocational and technical education and higher education, respectively. Republic Act 8545 - Expanded Government Assistance to Students and Teachers in Private Education Act Cont.…. Likewise, it may engage the services and support of any qualified government or private entity for its implementation. " The State Assistance Council is headed by the DepEd Secretary as chair, the Chairpersons of CHED and TESDA as co-chairs, representatives from National Economic and Development Authority (NEDA), Department of Budget and Management (DBM), Department of Science and Technology (DOST), representatives from duly organized nationwide associations of teachers, students, parents, and school administrators concerned with secondary, post-secondary vocational and technical education and higher education as members. A representative each from the Committees on Education of both Houses of Congress shall be designated resource persons to the Council. Republic Act 7687 - Science and Technology Scholarship Act of 1994 The grant of any scholarship award shall be applied only in the field of science, mathematics, engineering, and such other areas in the undergraduate or postgraduate courses as may be provided for in the rules and regulations to be promulgated by the Department of Science and Technology (DOST) and the Department of Education, Culture and Sports (DECS): provided, however, that the scholarship grant for the postgraduate level shall not be limited to those scholars or recipients who are graduates of the undergraduate scholarship program. (Section 6) Republic Act 7687 - Science and Technology Scholarship Act of 1994 The grantee of the scholarship program is entitled to financial assistance which may include tuition and other school fees, outright grant for prescribed textbooks and essential school supplies, outright grant for prescribed military science and physical education uniform, transportation expenses, and monthly living allowance: provided, however, that in the granting of financial assistance, the availability of funds, purchasing power of the peso and rate of financial assistance given under other government scholarship programs must be considered. (Section 7) Republic Act 7687 - Science and Technology Scholarship Act of 1994 In order to qualify for the scholarship program, the applicant must be: 1. a member the top five percent (5%) of the high school graduating class, regardless of gender, religion, and cultural affiliation; 2. a resident of the municipality for the last four years prior to availing of the scholarship, as attested by the school records; and 3. of good moral character and in good health. (Section 8) The scholarship program shall be supported by appropriate courses for value formation of scholars that will inculcate in them the virtues of nationalism, industriousness, honesty, commitment to national development and an effective work ethic. (Section 9) Republic Act 7687 - Science and Technology Scholarship Act of 1994 Sec. 10 - Distribution of Scholarship Slots DOST shall provide for a proportional and equitable allotment of slots for identified fields of science and technology to attain a balanced distribution of manpower in terms of number and expertise. DOST shall also organize a program geared toward enlisting at least two scholars in each municipality of the Philippines and at least 10 scholars for those congressional districts without municipality. Qualified members of the cultural minority in appropriate cases shall be given due preference. Republic Act 7687 - Science and Technology Scholarship Act of 1994 Sec. 12 - Place of Study Outside the Home Country The scholarship grant provided herein shall not be limited to studying only in any school in this country but would include scholars who can be granted the opportunity to study abroad in schools specializing in courses stated therein: provided, however, that a grantee who has qualified for study abroad must execute an undertaking binding himself to return to the country to fulfill his service obligation on the basis of the length of his scholarship. The Department of Foreign Affairs (DFA) is hereby directed to give full assistance in enforcing such undertaking. Republic Act 7687 - Science and Technology Scholarship Act of 1994 Sec. 13 - Service Obligation Immediately upon completion of a Bachelor of Science course, a scholar shall serve the country on full-time basis only along his field of training for a minimum period equivalent to the length of time a scholar enjoyed the scholarship by rendering service to his province or municipality by organizing technology-based livelihood activities or enterprises, teaching, or such other service related to the course or training he has completed, and, for this purpose, requiring the execution of a contract between the Government and the scholar incorporating the details of the said service obligation. Republic Act 7687 - Science and Technology Scholarship Act of 1994 Any recipient of the program who has not completed his course shall render service to the country equivalent to the number of years he enjoyed the scholarship. Any scholar who violates the service obligation imposed under this section shall be liable to reimburse the Government of the fund assistance received in full or pro tanto asthe case may be. Republic Act 7687 - Science and Technology Scholarship Act of 1994 Sec. 14 - Post Scholarship Incentives In order to encourage graduates of the scholarship program to serve in fulfillment of their service obligation and entice them to continue to stay and serve in the country even beyond their service obligation, they shall be entitled to the following incentives: a. priority for job placement in the Government or in the private sector in positions appropriate to their area of education or training; b. grants-in-aid and access to government research facilities in the conduct of research and development projects, and other service and technology activities; Republic Act 7687 - Science and Technology Scholarship Act of 1994 Cont.…. C. access to credit with liberal terms from government banks and financial institutions; d. payment of hardship and/or hazard allowance to those who are engaged in research and other science and technology activities that posed danger and caused hardship to their well-being; ande. travel and accident insurance coverage. Republic Act 7687 - Science and Technology Scholarship Act of 1994 Sec. 16 - Implementing Body The scholarship program herein provided shall be directly implemented by the DOSTthrough the Science Education Institute. Republic Act 8248 - An Act Further Strengthening the Science and Technology Program of the Government and Amending for the Purpose RA 7687 Sec. 16 - Implementing Body The scholarship program herein provided shall be directly implemented by the DOST through the Science Education Institute. Section 1 of RA 8248 provides an amendment of Section 4 of RA 7687 by creating a Science and Technology Human Resource Development Council which shall be chaired by the Secretary of the DOST and shall be composed of the following members: 1. The Chairman of the Commission on Higher Education (CHED); Republic Act 8248 - An Act Further Strengthening the Science and Technology Program of the Government and Amending for the Purpose RA 7687 Cont.… 2. The Secretary of the Department of Education, Culture and Sports (DECS); 3. The Director-General of the Technical Education and Skills Development Authority (TESDA); 4. The Secretary of the Department of Budget and Management Authority (DBM); and 5.The President of the Philippine Association of State Universities and Colleges (PASUC). Republic Act 8248 - An Act Further Strengthening the Science and Technology Program of the Government and Amending for the Purpose RA 7687 The Council shall perform the following functions: 1. Coordinate science and technology human resource development programs; 2. Formulate a medium and long-term science and technology human resource development plan in accordance with the national medium- term plan; 3. Formulate broad policies for the allocations of science and technology scholarships; 4. Formulate policies on advanced degree programs for science and technology; Republic Act 8248 - An Act Further Strengthening the Science and Technology Program of the Government and Amending for the Purpose RA 7687 The Council shall perform the following functions: 5. Formulate a career system for technologists and technicians to complement the scientific career system; 6. Formulate programs to train and retrain scientists, engineers, researchers, and technologists and encourage them, through various incentives, to return and practice their professions in the Philippines, to enhance and accelerate the technological development of the country; and 7. Perform other functions necessary to effectively implement the provisions of this Act. Republic Act 8248 - An Act Further Strengthening the Science and Technology Program of the Government and Amending for the Purpose RA 7687 The science and technology human resource development plan shall be submitted to the president six months after the effectivity of this Act. The Council shall have a term of four years commencing from the effectivity of this Act, unless otherwise extended by Congress. (Section 1) Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The objective of the law is to strengthen the country's science and technology education by fast tracking graduates in the sciences, mathematics, and engineering who shall teach science and mathematics subjects in secondary schools throughout the country. Toward this end, scholarships shall be provided to finance the education of talented and deserving students in their third year of college, and pursuing a degree or training in the areas of science and technology, and to provide incentives for them to pursue a career in teaching in high schools, especially in their home regions. (Section 3) Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The scholarship program builds on the current Science and Technology Scholarships offered by DOST, through its Science Education Institute (SEl), as provided for in Republic Act 7687 (Science and Technology Scholarship Act of 1994). It envisions a fast tracking of more science, technology, and engineering graduates by offering scholarships to deserving students in these courses in their third year of undergraduate study, based on their competitiveness and merit. It also offers additional incentives to attract the graduates of this scholarship program into teaching science, mathematics, and technology courses in a public or private high school. (Section 4) Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The following are qualifications for the scholarship with teaching incentive. Applicant must: 1. be a Filipino citizen; 2. be a regular third-year college student at the time of award; 3. be currently enrolled in any of the state universities or colleges, or in private universities, especially in Commission on Higher Education (CHED)-compliant programs, under any of the identified priority S&T courses; have a general weighted average (GWA) of eighty-three percent (83%) or better during their first and second year of college; and Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 5. qualify in the Junior-Level Science Scholarship Examination. (Section 5) Section 7 provides for the duration of the scholarship. The recipients shall be entitled to an award for the last two years of undergraduate study, or the last three years for those enrolled in five-year courses such as engineering, while matriculating in an approved program. Section 8 states that the recipients shall pursue degrees in science, technology and engineering, as identified and approved by DOST as priority S&T courses. Applicants who are currently enrolled under such courses under the CHED-compliant programs will be given priority. Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 Sec. 9 - Terms and Conditions The applicants for the scholarships must execute a service contract in which they: 1. Agree to teach as their return of service (ROS); 2. Agree to any of the approved ROS conditions; and 3. Agree to repay the amounts disbursed plus interest pursuant to the terms of their service contract. Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 Sec. 9 - Terms and Conditions After the completion of scholarship, the return of service provides that the recipients must teach full-time high school subjects) in Mathematics, Biology, Chemistry, or Physics; or Information, Agricultural, Aquaculture, or Fisheries Technology, both in the university and technical-vocational tracks in the secondary education curriculum, for a minimum of two years, in a public or private high school. (Section 10) Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The incentives granted to qualified graduates who shall teach at a public or private high school for a minimum of two years are: 1. a starting salary grade equivalent to that of a Special Science Teacher I in the Philippine Science High School System; 2. priority for job placement in any high school, public or private, of their choice within the country, with first priority in their home province; 3. a one-time relocation allowance should they be assigned in a place other than the permanent residence; Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The incentives granted to qualified graduates who shall teach at a public or private high school for a minimum of two years are: 4. scholarships in identified teacher education institutes for Science Education courses; and 5. pass the Licensure Examination for Teachers (LET) within five years of hiring.(Section 11) Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The law provides for the training of teachers in Section 12. The Philippine Normal University (PNU), being the National Center for Teacher, Education per Republic Act 9647 (Philippine Normal University Modernization Act of 2009), and its network of universities in teacher education, like the National Network of Normal Schools (3NS), as well as CHED-compliant programs in teacher education and centers for teacher training recognized by CHED and DepEd, are hereby tasked to provide training for hired teachers under this program. Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 For this purpose, 1,000 scholarships are made available every year to these hired teachers to be sourced from DepEd, to be coordinated with their implementation of the teacher education and training provision of Republic Act 10533 (Enhanced Basic Education Act of 2013). The graduates of science, technology, engineering and mathematics courses and professionals, who are not recipients of the scholarship program provided for in this Act, may also apply to teach science, mathematics, or technology subjects in a public or private high school. Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 However, applicants must: 1. be a Filipino citizen; 2. have graduated with a science, technology, engineering, or mathematics degree, with a GWA of eighty-three percent (83%) or better from a reputable university; 3. be at least 40 years of age at the time of application; and 4. not have a service obligation under another program in conflict with DOST-SEI obligations. (Section 13) Republic Act 10612 - Fast-Tracked S&T Scholarship Act of 2013 The implementing agencies of the scholarship program, or the DOST- SEl, shall be the main implementing agency. The SEl shall be responsible for evaluation, award-giving and monitoring of scholarship grants and awardees. The Institute is also tasked with coordinating with other relevant agencies. (Section 14) DepEd is hereby tasked to ensure job placement and hiring of qualified graduates under this program as secondary school teachers in science, mathematics, and related technology courses, and to ensure that these teachers are hired at Special Science Teacher salary grade levels. The Department is also tasked with the evaluation and monitoring of hired teachers under this program. (Section 15)
