BARANGAY CHAPTER 1. – ROLE AND CREATION OF THE BARANGAY SECTION. 384. Role of the Barangay. ​ The barangay is the basic political unit, acting as the primary planning and implementing unit of government policies, plans, projects and activities of a community and a forum for community dispute resolution. SECTION. 385. Manner of Creation. ​ A barangay can be created, merged, divided, or abolished by law or ordinance, of the Sangguniang Panlalawigan or Sangguniang Panlungsod (conducted by the comelec) by a plebiscite. SECTION. 386. Requisites for Creation. ​ Population Requirement: ○​ At least 2,000 inhabitants certified by the National Statistics Office ○​ For Metro Manila and highly urbanized cities, at least 5,000 inhabitants ​ Territorial Requirement: ○​ The barangay must have identifiable boundaries. ○​ Non-contiguous territories may include islands. ​ Consolidation or creation must ensure the original barangay retains the minimum population requirement. ​ CHAPTER 2 - BARANGAY OFFICIALS AND OFFICES SECTION. 387. Chief Officials and Offices. There shall be in each Barangay: ​ Punong Barangay (Barangay Captain) ​ 7 Sangguniang Barangay members (Councilors) ​ Sangguniang Kabataan (SK) Chairperson ​ Barangay Secretary ​ Barangay Treasurer ○​ There shall also be in every Barangay a Lupong Tagapamayapa (as sec 388, persons on authority stated, the are all considered persons in authority within their jurisdiction) CHAPTER 3 - THE PUNONG BARANGAY SECTION. 389. Chief Executive: Powers, Duties, and Functions. The Punong Barangay shall: “ENMAPP-O-CAP” E - Enforces laws and ordinances N - Negotiates , enter into, and sign contracts in behalf of brgy M - Maintains public order in the brgy and assist city/municipal mayor. A - Appoints and replace barangay appointive officials (treasurer, secretary or other a.o) P - Presides over meetings and assemblies. P - Promotes barangay welfare. O - Organizes emergency groups on occasions of emergency or calamity C - Conducts annual palarong Barangay A - Approves fund disbursement vouchers. P - Presides over Katarungang Pambarangay CHAPTER 4 - THE SANGGUNIANG BARANGAY ( the legislative body of the Barangay) SECTION. 391. Powers, Duties, and Functions The Sangguniang Barangay, as the legislative body of the Barangay, shall: "EN-SHARP" E - Enact ordinances to promote general welfare. N - Negotiate or authorize contracts through the Punong Barangay. S - Support cooperatives to improve residents’ economic well-being. H - Handle and regulate the use of multi-purpose halls and public spaces. A - Accept donations, funding, and voluntary labor for public works. R - Raise funds for Barangay projects and ensure transparency. P - Provide allowances, per diems, and compensation to officials. CHAPTER 5 - APPOINTIVE BARANGAY OFFICIALS SECTION. 394. Barangay secretary: Appointment, Qualifications, Powers and Duties. The Barangay secretary shall be: ​ of legal age, a qualified voter and an actual resident of the Barangay concerned. ​ NOT a a Sangguniang Barangay member, a government employee, or a relative of the Punong Barangay within the fourth civil degree of consanguinity or affinity. The Barangay secretary shall: "K-PASS" K - Keep custody of records of Sangguniang Barangay and assembly. P - Prepare and keep minutes of all meetings. A - Assist in preparing forms for elections and plebiscites. S - Submit reports on the number of Barangay residents. S - Store and maintain updated records of all Barangay inhabitants. SECTION. 395. Barangay Treasurer: Appointment, Qualifications, Powers and Duties. The Barangay treasurer shall be: ​ of legal age, a qualified voter and an actual resident of the Barangay concerned. ​ NOT a a Sangguniang Barangay member, a government employee, or a relative of the Punong Barangay within the fourth civil degree of consanguinity or affinity. The Barangay secretary shall: "C-D-SR" K - Keep custody of Barangay funds and properties. D - Disburse funds according to financial procedures. S - Submit statements on income and expenditures. R - Render an annual accounting report on funds and properties. CHAPTER 6 - BARANGAY ASSEMBLY SECTION. 397. Composition; Meetings ​ Composition: All residents of the barangay for at least six (6) months, aged 15 years and above. ​ Meetings: Held at least twice a year to discuss barangay activities and finances. The Barangay assembly shall: "I-D-H" I - Initiate legislative processes by recommending measures. D - Decide on adopting initiatives for direct voter proposals. H - Hear and pass the semestral report on activities and finances. CHAPTER 7 - KATARUNGANG PAMBARANGAY SECTION. 399. Lupong Tagapamayapa Lupon Tagapamayapa: ​ Mediates disputes between barangay residents. ​ Composed of the Punong Barangay as chairperson and 10-20 members. CHAPTER 8 - SANGGUNIANG KABATAAN (youth council in each Barangay) SECTION. 423. Creation and Election. Composed of: ​ a chairman, ​ seven (7) members ​ a secretary ​ treasurer SECTION. 424. Katipunan ng Kabataan. The Katipunan ng Kabataan is made up of: ​ Citizens aged 15 to 21, residing in the Barangay for at least six (6) months. ​ They must be duly registered in the SK or Barangay list. SECTION. 426. Powers and Functions of the Sangguniang Kabataan.The Sangguniang Kabataan shall: "PICE-FUNDS" P - Promulgate resolutions to carry out youth objectives. I - Initiate programs to enhance youth development. C - Create committees for program implementation. E - Exercise powers and duties as delegated or prescribed by law. F - Fund-raise for youth activities (proceeds go to general fund). U - Submit annual and end-of-term reports to the Sangguniang Barangay. N - Consult and coordinate with youth organizations for policy. D - Coordinate with national agencies for youth programs. S - Submit reports on youth development projects. SECTION. 427. Meetings of the Sangguniang Kabataan. ​ The SK meets regularly once a month. Special meetings may be called by: ​ The SK Chairman. ​ Any three (3) members. A quorum is established with the majority of members present. SECTION. 428. Qualifications. To be an elective SK official, one must: ​ Be a citizen of the Philippines. ​ Be a qualified voter of the Katipunan ng Kabataan. ​ Be a resident of the Barangay for at least one (1) year before the election. ​ Be at least 15 years old but not more than 21 years old on the day of the election. ​ Be literate in Filipino, English, or the local dialect. ​ Not have been convicted of any crime involving moral turpitude. SECTION. 429. Term of Office. ​ SK officials (Chairman and members) serve a term of three (3) years. ​ They may be removed earlier for cause, incapacitation, death, or resignation. SECTION. 430. Sangguniang Kabataan Chairman. ​ The SK Chairman is elected by the voters of the Katipunan ng Kabataan. ​ Upon election, the Chairman becomes an ex-officio member of the Sangguniang Barangay. ○​ As an ex-officio member, the Chairman exercises the same powers, duties, and privileges as other members of the Sangguniang Barangay. ​ The Chairman also heads the Committee on Youth and Sports Development in the Sangguniang Barangay. SECTION. 431. Powers and Duties of the Sangguniang Kabataan Chairman. Sangguniang Kabataan chairman shall: "CIPp” C - Call and preside over all meetings. of the Katipunan ng Kabataan and the Sangguniang Kabataan. I - Implement policies, programs, and projects in coordination with the Sangguniang Barangay. P - Appoint officers with the concurrence of the Sangguniang Kabataan. Observance of Linggo ng Kabataan. - (a) Every Barangay, municipality, city and province shall, in coordination with the pederasyon ng mga Sangguniang Kabataan at all levels, conduct an annual activity to be known as the Linggo ng Kabataan on such date as shall be determined by the Office of the President. THE MUNICIPALITY CHAPTER 1 - ROLE AND CREATION OF THE MUNICIPALITY SECTION. 440. Role of the Municipality ​ municipality consisting of a group of Barangays ​ general purpose government responsible for coordinating and delivering basic services and ensuring effective governance for its inhabitants within its territorial jurisdiction. SECTION. 441. Manner of Creation ​ A municipality may be created, altered, or abolished or its boundary substantially altered through an Act of Congress and must be approved by a plebiscite, conducted by the Commission on Elections (COMELEC), within 120 days from the Act's effectivity. SECTION. 442. Requisites for Creation A municipality must meet three key criteria: ​ Minimum Income: At least ₱2.5 million annual income for the last two consecutive years. ​ Population: A minimum of 25,000 inhabitants as certified by the National Statistics Office ​ Territorial Size: A contiguous territory of at least 50 square kilometers as certified by the Lands Management Bureau CHAPTER 2 - MUNICIPAL OFFICIALS IN GENERAL SECTION. 443. Officials of the Municipal Government There shall be: ​ municipal mayor, ​ municipal vice-mayor, ​ Sangguniang Bayan members ​ secretary to the Sangguniang Bayan ​ municipal treasurer, ​ municipal assessor, ​ municipal accountant, ​ municipal budget officer ​ municipal planning and development coordinator ​ municipal engineer/building official ​ municipal health officer ​ municipal civil registrar. The mayor may appoint a: ​ municipal administrator, ​ municipal legal officer, ​ municipal agriculturist, ​ municipal environment and natural resources officer, ​ municipal social welfare and development officer, ​ municipal architect, ​ municipal information officer. Sangguniang Bayan (Municipal Legislative Body): This body has the authority to create, maintain, or consolidate municipal offices as necessary CHAPTER 3 - OFFICIALS AND OFFICES COMMON TO ALL MUNICIPALITIES Article One. - The Municipal Mayor SECTION. 444. The Chief Executive: Powers, Duties, Functions and Compensation. ​ General Supervision: The mayor oversees all municipal programs, services, and activities. ○​ This includes implementing the development plan, proposing policies, and presenting projects to the Sangguniang Bayan. ​ Appointments: The mayor appoints officials whose salaries are funded by the municipality. ​ Representative Role: The mayor represents the municipality in business transactions, signs contracts, and other documents made pursuant to law or ordinance ​ Emergency Powers: The mayor can implement emergency measures in times of disasters. ​ Visit component Barangays of the municipality at least once every six (6) months to deepen his understanding of problems and conditions therein ​ Conduct a palarong bayan, in coordination with the Department of Education, Culture and Sports, as an annual activity which shall feature traditional sports and disciplines included in national and international games ​ Submit to the provincial governor the following reports (annual report) ​ Compensation: The mayor receives a minimum salary according to Salary Grade 27 prescribed under R.A. No. 6758 Article Two. - The Vice Mayor SECTION. 445. Powers, Duties and Compensation The vice-mayor shall: Legislative Role: The vice-mayor presides over the Sangguniang Bayan and handles administrative duties for the municipal government. Succession: The vice-mayor assumes the role of the mayor in cases of vacancy (either permanent or temporary). Compensation: The vice-mayor receives a minimum salary corresponding to Salary Grade 25 as prescribed under R.A. No. 6758 Article Three. - The Sangguniang Bayan (the legislative body of the municipality) SECTION. 446. Composition. shall be composed of: ​ municipal vice-mayor as the presiding officer ​ the regular sanggunian members ​ the president of the municipal chapter of the liga ng mga Barangay, ​ the president of the pambayang pederasyon ng mga Sangguniang Kabataan, and ​ the sectoral representatives SECTION. 447. - Powers, Duties, Functions and Compensation. ​ shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the municipality and its inhabitants In other words: ​ Legislative Powers: The Sangguniang Bayan is responsible for enacting ordinances, passing resolutions, and appropriating funds for the municipality's welfare. ​ Maintain peace and order: enact measures to maintain peace and order, including addressing lawlessness, disorder, and various public disturbances (kapag may gulo), and can impose fines or penalties for violations ​ Disaster: enact ordinances to protect inhabitants from the effects of disasters (natural or man-made) and ensure relief and rehabilitation efforts. ​ Protect environment: authority to protect the environment and impose penalties for illegal activities such as illegal fishing, logging, and other practices harmful to the environment. ​ Employee Management and Compensation: The Sangguniang Bayan determines the salaries, allowances, and benefits for municipal employees, and ensures the proper conduct of government programs and projects. ​ Legal Assistance for Barangay Officials: provides legal assistance to Barangay officials facing legal proceedings related to their duties, and offers insurance coverage for Barangay officials and their service units when financially feasible. ​ Regulate activities: relative to the use of land, buildings and structures within the municipality in order to promote the general welfare The members of the Sangguniang Bayan shall receive a minimum monthly compensation corresponding to Salary Grade twenty-four (24) as prescribed under R.A. 6758 Pero, For municipalities located in the Metropolitan Manila Area and other metropolitan political subdivisions, minimum monthly compensation corresponds to Salary Grade 25 THE CITY CHAPTER 1 - ROLE AND CREATION OF THE CITY SECTION. 448. Role of the City. ​ The city, consisting of more urbanized and developed Barangays ​ general purpose government responsible for coordinating and delivering basic services and ensuring effective governance for its inhabitants within its territorial jurisdiction. SECTION. 449. Manner of Creation ​ A city may be created, altered, or abolished or its boundary substantially altered through an Act of Congress and must be approved by a plebiscite, conducted by the Commission on Elections (COMELEC), within 120 days from the Act's effectivity. SECTION. 450. Requisites for Creation A municipality or a cluster of Barangays may be converted into a component city if: ​ It has an annual income of at least Twenty million pesos (Php20,000,000) for two consecutive years. It meets one of the following: ​ A contiguous territory of at least 100 square kilometers. ​ A population of at least 150,000 inhabitants. SECTION. 451. Cities, Classified ​ A city may either be component or highly urbanized ​ The classification and corporate status of existing cities will remain unaffected by this provision SECTION. 452. Highly Urbanized Cities Highly urbanized cities must have: ​ A population of at least 200,000 inhabitants. ​ An annual income of at least Php50,000,000. ​ Voters in highly urbanized cities do not vote for provincial officials ​ Cities which do not meet the above requirements shall be considered component cities of the province in which they are geographically located. ​ If a component city is located within the boundaries of two (2) or more provinces, such city shall be considered a component of the province of which it used to be a municipality. SECTION. 453. Duty to Declare Highly Urbanized Status ​ -It shall be the duty of the President to declare a city as highly urbanized within thirty (30) days after it shall have met the minimum requirements , upon proper application therefor and ratification in a plebiscite by the qualified voters therein CHAPTER 2 - CITY OFFICIALS IN GENERAL SECTION. 443. Officials of the City Government There shall be: ​ mayor, ​ vice-mayor, ​ Sangguniang Panlungsod members ​ secretary to the Sangguniang Panlungsod ​ city treasurer ​ city assessor ​ city accountant, ​ city budget officer ​ city planning and development coordinator, ​ city engineer ​ city health officer, ​ city civil 202 registrar ​ city administrator ​ city legal officer ​ city veterinarian ​ city social welfare and development officer ​ city general services officer The mayor may appoint a: ​ city architect ​ city information officer ​ city agriculturist ​ city population officer ​ city environment and natural resources officer ​ city cooperatives officer The appointment of a city population officer shall be optional in the city Sangguniang Panlungsod (City Legislative Body): This body has the authority to create, maintain, or consolidate city offices as necessary CHAPTER 3 - OFFICIALS AND OFFICES COMMON TO ALL MUNICIPALITIES Article One. - The City Mayor SECTION. 444. PROVINCE CHAPTER 1 - ROLE AND CREATION OF THE PROVINCE SECTION. 440. Role of the Province ​ The province, composed of a cluster of municipalities, or municipalities and component cities ​ political and corporate unit of government, ​ mechanisms for developmental processes and governance, focusing on coordinating and enhancing local government units within their territory. SECTION. 460. Manner of Creation ​ A province may be created, altered, or abolished or its boundary substantially altered through an Act of Congress and must be approved by a plebiscite, conducted by the Commission on Elections (COMELEC), within 120 days from the Act's effectivity. SECTION. 461. Requisites for Creation A province must: ​ Have an average annual income of at least Php20,000,000 based on 1991 prices, certified by the Department of Finance. ​ Meet at least one of these: 1.​ Contain a contiguous territory of at least 2,000 square kilometers. 2.​ Have a population of no fewer than 250,000 residents. SECTION. 462. Existing Sub-Provinces. ​ Existing sub- provinces are hereby converted into regular provinces upon approval by a majority of the votes cast in a plebiscite to be held in the said subprovinces and the original provinces directly affected. ​ The plebiscite shall be conducted by the Comelec simultaneously with the national elections following the effectivity of this Code. Ai generated toh kasi di ko magets kainis Conversion to Regular Provinces ​ Sub-provinces are converted into regular provinces upon approval in a plebiscite. ​ The plebiscite must be conducted by the Commission on Elections (Comelec) alongside the next national elections after the effectivity of the Local Government Code. Converting Sub-Provinces into Provinces ​ Sub-provinces (smaller provinces) will become regular provinces, but this will only happen if people in those areas agree to it by voting "yes" in a plebiscite (a public vote). ​ The vote will happen during the next national elections. Representation in Congress ​ While waiting for the next elections to choose new representatives, the existing representatives of the original districts will continue to represent the area in Congress. What Happens to Current Officials ​ Officials already working in the sub-provinces will stay in their jobs until June 30, 1992. ​ If the vote does not favor conversion, or if an official’s term ends, the President of the Philippines will appoint people to fill those positions temporarily. ​ After the conversion, if no governor or other key officials have been chosen, the President will also appoint them temporarily. Employees in the Sub-Provinces ​ People working in government offices (like clerks, administrators) will keep their jobs under the rules of civil service law. ​ CHAPTER 2 - PROVINCIAL OFFICIALS IN GENERAL SECTION. 443. Officials of the Provincial Government There shall be: ​ Governor, ​ Vice-governor ​ members of the Sangguniang Panlalawigan ​ Secretary to the Sangguniang Panlalawigan ​ provincial treasurer, ​ provincial assessor ​ provincial accountant ​ provincial engineer ​ provincial budget officer ​ provincial planning and development coordinator, ​ provincial legal officer ​ provincial administrator ​ provincial health officer ​ provincial social welfare and development officer ​ provincial general services officer ​ provincial agriculturist ​ provincial veterinarian. The governor may appoint a: ​ a provincial population officer ​ provincial natural resources and environment officer ​ provincial cooperative officer ​ provincial architect ​ provincial information officer Sangguniang Panlalawigan (Provincial Legislative Body): This body has the authority to create, maintain, or consolidate provincial offices as necessary SECTION. 464. Residence and Office. ​ During the incumbency of the governor, he shall have his official residence in the capital of the province. ​ All elective and appointive provincial officials shall hold office in the provincial capital ○​ However, officials may temporarily work in other municipalities or cities within the province for up to 7 days per month if approved by the Sangguniang Panlalawigan CHAPTER 3 - OFFICIALS AND OFFICES COMMON TO ALL MUNICIPALITIES Article One. - The Provincial Governor SECTION. 444. Composition. shall be composed of: ​ cityl vice-governorr as the presiding officer ​ the regular sanggunian members ​ the president of the city chapter of the liga ng mga Barangay, ​ the president of the pambayang pederasyon ng mga Sangguniang Kabataan, and ​ the sectoral representatives SECTION. 447. - Powers, Duties, Functions and Compensation. ​ shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the municipality and its inhabitants In other words: ​ Legislative Powers: The Sangguniang Bayan is responsible for enacting ordinances, passing resolutions, and appropriating funds for the municipality's welfare. ​ Maintain peace and order: enact measures to maintain peace and order, including addressing lawlessness, disorder, and various public disturbances (kapag may gulo), and can impose fines or penalties for violations ​ Disaster: enact ordinances to protect inhabitants from the effects of disasters (natural or man-made) and ensure relief and rehabilitation efforts. ​ Protect environment: authority to protect the environment and impose penalties for illegal activities such as illegal fishing, logging, and other practices harmful to the environment. ​ Employee Management and Compensation: The Sangguniang Bayan determines the salaries, allowances, and benefits for municipal employees, and ensures the proper conduct of government programs and projects. ​ Legal Assistance for Barangay Officials: provides legal assistance to Barangay officials facing legal proceedings related to their duties, and offers insurance coverage for Barangay officials and their service units when financially feasible. ​ Regulate activities: relative to the use of land, buildings and structures within the municipality in order to promote the general welfare The members of the Sangguniang Panlalawigan shall receive a minimum monthly compensation corresponding to Salary Grade twenty-seven (27) as prescribed under R.A. 6758
