Unit 2: Rights and Freedoms Mr. DeZilva Lesson 3: The Canadian Constitution and “Constitutionality” LO: This lesson will give students a more thorough and in depth understanding of the Constitution The Lesson You will see that the next few slides contain Headings and subheadings. You will use Pages 156 to 166 in your text book to take notes on these subheadings. There may be moments where you have to do extended research, but I will note that These notes will not be checked, but are crucial to your notes for tests and for your eventual harkness/debate. This lesson certainly acts a bit more like Canadian History, but the application and understanding of the Constitution is crucial in understanding how to apply the law to the Charter Legislative Supremacy What is the principle of Legislative Supremacy? What did law look like before and after the Canadian Charter of Rights and Freedoms? ○ What power shifted? ○ What is the relationship between the Charter and the Constitution? What is Section 33 ? (make sure you have a good understanding on this one) What does it mean to “Amend the Constitution”? ○ What is the Amending Formula ? ○ Examples of the formula being used (or potentially used) “Constitutionality” Case Study On Page 156 and 157, you will see a case study “Asking Key Questions” on The Constitutionality of Canada’s Marijuana Law Give this a read and summarize how the laws that criminalized marijuana were called into question for not being “constitutional” *Please note, marijuana is no longer criminalized.
