The Constitution The political system of UAE is a constitutional federation The constitution was ratified in July 18, 1971 The constitution contains 152 articles distributed among 10 parts IV. The Constitution The constitution has 10 parts: 1. The Federation and its aims 2. Social and economic basis 3. Public freedoms, rights and duties 4. Federal authorities 5. Federal legislations 6. The Emirates 7. Allocation of legislative, executive and international jurisdiction between the federation and the emirates 8. Financial affairs 9. Armed and security forces 10. The Constitution We will focus now on part 7 of the Constitution Allocation of legislative, executive and international jurisdiction between the federation and the emirates Definitions Legislative: making laws Executive: putting laws into effect Jurisdiction: (within their jurisdiction = within their legal authority) V. Part 7 of the Constitution Part 7 of the constitution delimits the boundaries between Federal and Local authorities (Articles 120‐125) V. Article 120 The Federation shall have exclusive jurisdiction over the following affairs: 1) Foreign affairs 2) Defense and federal armed forces 3) federal Security 4) Security, order, and governance in the capital 5) Federal employees and judiciary 6) Federal finance, taxes, fees, and dues 7) Federal public loans 8) Postal, telegraphic, telephone, and wireless services 9) Building of federal roads 10) Aeronautic control and issuance of airplane and pilots licenses 11) Education 12) Public health and medical services 13) Exchange and currency 14) Measures, dry measures, and weights 15) Electricity services 16) Federal nationality, passports, residence and immigration 17) Federal property 18) Consensus and statistics related to federal matters 19) Federal information V. Article 121 (added in 2004) The Federation shall have exclusive jurisdiction over the following affairs: 1) Labor relations and social security 2) Real estate and expropriation in the public interest 3) Extradition of criminals 4) Banks 5) Insurance of all kinds 6) Protection of agriculture and animal wealth 7) Major legislations 8) Protection of intellectual, technical and industrial property and copyright 9) Printing and publishing 10) Import of arms and ammunitions 11) Other aeronautic affairs 12) Delimitation of territorial waters 13) Organizing free‐zone areas V. Article 122 “The Emirates shall have the jurisdiction in all matters not assigned to the exclusive jurisdiction of the Federation in accordance with the provisions of the two preceding articles.” VI. Federal and Local Governments It is from part 7 of the UAE Constitution that we have the delimitation of jurisdiction between federal and local governments. In the next session, we will learn about local institutions VII. Federal Institutions According to Article (45) of the UAE Constitution, there are five Federal branches.
