LEASE AGREEMENT 1.1 THIS LEASE It is mutuall y agreed upon b y Main Street Manag ement, (Landlor d's Agent) and <<T enants (Financiall y Responsible)>> , Lessee(s) t hatt he A gent shall lease t he follo wing described premises located at t he address belo w t o Lessee(s), jointl y and sever all y. <<U nit A ddress>> 1.2 AGENT Main S treet Manag ement ("Manag er/Agent") acts as t he agent of t he Landlor d under this Lease, and is aut horized to perform an y and all actions on behalf of t he Landlord, including but no t limited to, maintenance, collection of rents, and ser vice of process, as well as any and all o ther oblig ations of t he Landlor d as outlined in t his Lease.1.3 TERM The Lease ter m shall commence on <<Lease S tar t Date>> at 3pm and shall ter minate on <<Lease End Date>> at 12pm, unless ter minatedsooner in accor dance with the ter ms outlined in t his lease. Any gues t staying long er than 14 cumulativ e days and nights per mont hwill be considered an occupant and mus t complete an application, pa y appropriate fees as outlined in t he Lessee Fee Schedule, and be addedt o t he Lease. 1.6 PLACE OF PAYMENT P ayments under t his Lease must be made payable t o Main S treet Manag ement , and can be mailed, hand-deliv ered, or paid electronically viat he Lessee portal t o the f ollo wing address: 1270 Main S t. Suite #221 Green Ba y, WI 54302 . P ayments made t o any other location or address will no t be accep ted.1.7 UTILITIES The f ollowing utilities are included wit h rent:<<Utilities Included>> Lessee shall be responsible f or contacting and arranging for any necessar y utility ser vices. F ailure to ha ve t he utilities placed in Lessee's 1 name b y move-in da y may result in a $50 f ee. Additionall y, f ailure to maint ain the utilities will result in a $100 f ee. Ins tallation of additional cable outlets is prohibited wit hout Agent's per mission. Direct broadcas t satellite dishes may not be ins talled wit hout Agent's per mission. P ermission will be denied unless t he satellite dish is equal to or less than one meter in diameter , is located wholly within areas of Lessee's ex clusive use, and is necessar y to obtain a signal or ser vices that are no t provided b y the common rental antenna or cable. Lessee is responsible f or removing the satellite dish and res toring t he Premises t o its original condition upon mo ve-out. 1.8 DEPOSITS A Security Deposit and P et Security Deposit (if applicable) is t o be paid upon execution of this Lease.Security Deposit <<Secur ity Deposit Char ges>> P et Deposit $ P et Deposit Lessee has 7-10 da ys after the mo ve-in date t o notify A gent in writing of an y damages or defects in the premises. N o deductions will be madefrom Lessee's security deposit f or any damag es or def ects that are reported wit hin this time fr ame. Upon written reques t, Lessee will bepro vided wit h a written descrip tion of any charges t o the pre vious Lessee's security deposit, when such inf ormation is a vailable. Lessee shall no t appl y any portion of t he Security Deposit ag ainst unpaid R ent. The reasonable cos t of repairing any damages caused b y Lessee, ex cludingnor mal w ear and tear , will be deducted from t he security deposit. All remaining security deposit funds shall be retur ned to Lessee wit hin 21da ys af ter the Lease ter mination and t he return of any fobs, k eys, par king per mits, and g arag e opener(s) (if applicable). The security deposit and/or an itemized lis t of deductions will be eit her mailed to the f orwar ding address pro vided at the time of mo ve-out or emailed t o the email address on file. 1.9 PROPERTY NOTES <<A dditional Lease Inf ormation>> Property N otes 1.10 NOTICE OF TERMINATION A gent and Lessee mus t agree if t he Lease is t o be renewed. A minimum of 60 da ys written no tice is required prior t o the end of t he Leaseter m, if Lessee wishes t o vacate at t he end of t he Lease Term or an y extended Lease T erm. The no tice must be given 2 full calendar mont hsin adv ance. During an y period of hold-o ver , Lessee shall be deemed t o be occupying the Unit as a Lessee on a mont h-to-mont h basis, subject t o all t he ter ms and conditions of t his Lease, except that A gent ma y increase t he Rent for the mont h-to-mont h periods wit h a 28 day notice t o Lessee. Suite 221 Green Ba y, WI 54302 b y noon oft he las t day of t he ter m upon v acating the Unit. 1.11 INSPECTION OF UNIT As per W isconsin S tate Statute 704.05(2), A gent ma y enter t he Unit occupied b y Lessee, at a reasonable time wit h at least 12 hours adv anceno tice t o Lessee, t o inspect t he Unit, mak e repairs, sho w the U nit to prospectiv e lessees or purchasers, or com ply wit h applicable la ws or regulations. A gent ma y enter wit hout advance notice upon consent of Lessee or when a healt h or safety emer gency exis ts, or if Lessee is absent and A gent belie ves entr y is necessar y to pro tect the Unit or t he Premises on which it is located from damag e. Agent shall also ha ve t he right t o exhibit t he Unit and t o display the usual “f or sale”, “for rent” or “v acancy” signs on t he Unit, as necessar y. The right of entr y ata reasonable time wit h 12 hours advance notice shall also exis t for t he pur pose of remo ving placards, signs, fixtures, alter ations or additionst hat do no t conform t o this A greement or t o any res trictions, r ules or regulations affecting t he Unit. 1.12 ABANDONMENT BY LEESEE(S) If Lessee is absent from t he Unit for 2 consecutiv e weeks wit hout pro viding A gent wit h written no tification of such absence, A gent, at t heir sole discretion, ma y deem the Unit to be abandoned. Breach of Lease liability will appl y if proper notice and/or expir ation of Lease has no toccurred. 1.13 DISPOSITION OF PERSONAL PROPERTY If Lessee v acates the Unit and lea ves personal property (ex cluding prescription medication or prescrip tion medical equipment) behind,Lessee shall be deemed t o have abandoned t he personal property and A gent shall ha ve t he right t o immediatel y dispose of t he propertyin an y manner t he Agent, in its sole discretion, deter mines appropriate. NOTICE IS HEREB Y GIVEN TO LESSEE THA T THE AGENTWILL N OT S TORE ANY ITEMS OF PERSON AL PROPERTY THA T LESSEE LEA VES BEHIND WHEN LESSEE V ACA TES THE PREMISES, EX CEPT AS SET F ORTH BEL OW . If t he personal property t hat Lessee leaves behind is prescrip tion medication or prescrip tion medical equipment, the Agent shall hold t heproperty f or 7 days from t he date on which t he Agent disco vers t he property . After t hat time, t he Agent ma y dispose of t he prescriptionmedication or prescrip tion medical equipment in t he manner that the A gent deter mines appropriate, but shall prom ptl y retur n the property t o Lessee if t he Agent receiv es a reques t for its retur n before the A gent disposes of it. If Lessee abandons a manuf actured or mobile home or 2 a titled v ehicle, Agent will giv e Lessee and an y other secured party t hat Agent is a ware of, written no tice of intent to dispose of the propertyb y personal ser vice, regular mail or certified mail t o Lessee’s last kno wn address. 1.14 BREACH OF LEASE If Lessee, or an y of Lessee's family, in vitees, licensees, or gues ts, violates any of the ter ms and conditions of t his Lease or any other documents ref erenced or attached heret o through an y act or omission, Lessee shall be considered t o be in breach of this Lease. (A breach b y one Lesseeshall be considered a breach b y all Lessees in cases where there is more than one Lessee). In t he event of such a breach, A gent ma y, at t heir discretion, ter minate this Lease in accor dance with applicable la ws. 1.15 DAMAGE BY CASUALTY In t he e vent of a casualty t hat renders the Unit uninhabitable, A gent shall ha ve t he right t o determine wit hin 10 da ys whether to repair t he U nit. If A gent chooses no t to repair t he Unit or t he Unit canno t be repaired wit hin a reasonable time, Lessee shall ha ve t he op tion to terminate t his Lease. 1.16 NON-ASSIGNMENT OF LEASE Lessee ag rees not to assign t his Lease or t o sublet any part of Lessee’ s Unit, nor t o allow any other person t o live there o ther t han named as abo ve, wit hout firs t receiving written per mission from Agent. 1.17 SMOKE AND CO DETECTORS Pursuant t o Wisconsin s tate law, A gent is responsible f or providing smok e detect ors and C O detectors in the Premises. Lessee is responsible f or maintaining t he functionality of an y smoke detect ors and C O detectors located wit hin the U nit. 1.18 CRIMINAL ACTIVITY/NOTICE OF DOMESTIC ABUSE PROTECTIONS Criminal activity is s trictly prohibited on t he Premises and wit hin the U nit. The A gent reser ves t he right t o terminate t his Lease if a crime is committed on t he Premises that the Lessee could ha ve reasonabl y prevented, unless t he Lessee or a person leg ally residing wit h the Lessee is t he victim of said crime. A ccor ding t o Wisconsin s tate law, a Lessee ma y have a def ense ag ainst eviction if t hey can pro ve t hat t he A gent kne w or should ha ve kno wn t hat t he Lessee w as a victim of domes tic abuse, sexual assault, or s talking and that the eviction action is based on conduct related t o suchincidents committed b y: • A person who w as not an in vited gues t of the Lessee • A person who w as an invited gues t of the Lessee, but t he Lessee has tak en steps t o seek an injunction ag ainst the person or pro videdwritten no tice to the A gent t hat t he person will no long er be an invited guest and has no t subsequentl y invited t hem back. A dditionall y, a Lessee who is a victim of domes tic abuse, sexual assault, or stalking may have t he right t o terminate t his Lease under certain limited circums tances, as outlined in section 704.16 of t he Wisconsin s tatutes. If t he Lessee has an y safety concer ns, they are encour aged t o reach out t o a local victim ser vices provider or la w enforcement ag ency for assis tance. Please no te that t his no tice is intended as a summar y of the Lessee's rights, and t he specific language of the statutes will go ver n in all cases. 1.19 MEGAN'S LAW As required b y Megan's La w, w e are pro viding no tice to new residents about t he availability of inf ormation on sex offenders in t heirneighbor hood. This inf ormation can be obtained b y contacting the Wisconsin Department of Corrections at www .parentsformeg ansla w.or g or b y phone at 1-888-275-7365. It is im portant to stay inf ormed and a ware of po tential risk s in your community .1.20 MISCELLANEOUS This Lease shall be go ver ned and cons trued accor ding to the la ws of t he State of W isconsin. If an y provision of t his Lease is deemed in valid or unenf orceable, it will no t affect the remaining pro visions of the Lease. The co venants, oblig ations, and conditions outlined in t his Leasewill be binding on t he parties, their heirs, leg al representativ es, and assigns. The headings used in t his Lease are for convenience and should no t affect t he interpretation of t he rights and oblig ations of the Agent or Lessee. 1.21 REMOVAL OF LANDLORD'S PROPERTY If an y property belonging t o the landlor d is removed from t he rental unit wit hout the express written consent of t he landlord, Lesseeag rees t hat the landlor d has the right t o take legal action, including, but no t limited to, filing criminal char ges f or t heft and civil char ges f or des truction of property . 3 1.22 ADDITIONAL PROVISIONS This lease ag reement and an y attachments or appendices heret o constitutes t he entire ag reement betw een Agent and Lessee and supersedes an y and all prior or contem poraneous ag reements or unders tandings, whether oral or written, betw een the parties heret o. This Lease ma y beex ecuted in counter parts, each of which shall be deemed an original, but all of which t ogether shall cons titute one and t he same instrument. RULES AND REGULATIONS 2.1 LESSEE AGREES TO THE FOLLOWING: Lessee ag rees to com ply wit h all r ules and regulations reg arding t he premises, or t he building of which t he premises are a part. A gent, in its reasonable judgment, ma y create and/or modify these rules from time t o time, provided that Lessee shall ha ve receiv ed written no ticet hereof. 1. C ONDUCT T OW ARDS A GENT AND FELL OW RESIDENTS: Lessee’ s conduct tow ar d A gent and residents is t o be reasonable andrespectful. Lessee shall no t harass A gent, t hose acting on behalf of A gent, such as s taff members, subcontr actors, or v endors, or residents of t he community . Verbal, written, electronic or ph ysical communications with the intent t o frighten, intimidate, t hreaten, abuse or harassand/or of t hose using prof ane obscene or le wd language are prohibited.2. C OMMUNIC ATION: Lessee unders tands that Agent will use Lessee’ s provided phone number , including text and email f ormats as met hods of communication. It is Lessee’ s responsibility to ensure Agent has up t o date contact inf ormation. 3. PETS: N o pets are allo wed at an y time, including visiting pets, ex cept as specificall y allowed b y Agent in writing and no ted in the attached P et A ddendum. 4. INDOOR AIR QU ALITY/HUMIDITY: It is Lessee’s responsibility t o control the indoor air quality and humidity wit h Lessee’s unit by doing t he follo wing: Using exhaus t fans when sho wering or using s to v et op. Open windo ws when necessar y to reduce indoor humidity . Usedehumidifier/air conditioning t o reduce humidity. Wipe mois ture from windo ws if condensation or milde w occurs. Notify A gent of an y w ater leak s as soon as Lessee is a ware. F ailure t o notify A gent ma y result in incurred cos ts to Lessee f or damages.5. ODORS: During LESSEE’ s residency or at the time of move out, offensiv e and/or excessive odors are no t permitted inside or outside t hedw elling. Including but no t limited to odors such as, cooking/spice, smoking, pet, candle/incense, etc. If at t he time of move out an y such odors are present in t he unit, costs associated t o the odor remedy 6. VEHICLES/G ARAGE: Lessee ag rees to com ply wit h the sno w remo val policy and par king regulations of t he Premises. Only one vehicle per U nit is allo wed, unless o ther wise appro ved b y Agent in writing. Lessee mus t notify A gent if gues ts will be par king for long er than one da y. U naut horized v ehicles ma y be tow ed at t he owner's expense. All v ehicles must be licensed, regis tered, and in operational condition.An y v ehicle t hat has no t moved in fiv e days ma y be tow ed at t he owner's expense. Gar age doors mus t be closed when no t being used toenter or exit. V ehicles may only be par ked in t he garag e or on t he designated par king areas. Vehicles are no t to be par ked or driv en on grassy areas. 7. EMER GENCY MAINTEN ANCE: Emer gency maintenance ser vice is available 24 hours a da y. N on-emer gency maintenance will be done during regular business hours. R epairs caused by Lessee's neglig ence or misuse will be billed t o Lessee. Negligence or misuse includes, but is no t limited t o, clogged drains, disposals, and t oilets. Service call char ges v ary accor ding to time spent and/or special conditions. 8. TRASH REMO VAL: R ecycling and g arbage bins are located in t he designated areas of t he Premises. Furniture, appliances, tires, electronics, etc. shall no t be left outside of tr ash bins or dum psters. T rash is no t allowed t o be lef t in the hallw ay/common area f or any amount of time. 9. C ARPET CLEANIN G: Carpets mus t be cleaned b y a licensed, insured car pet cleaning professional. If a pet caused damag e, the contr acted person mus t be able to black-light and repair or recommend replacement. A paid receip t must be lef t at the time of v acating as proof t hecar pet cleaning w as completed. 10. ENER GY C ONSER VA TION: Lessee is responsible f or conserving ener gy by keeping windo ws and doors closed when heat or air conditioning is in use. 11. FIRE HAZARDS/SMOKIN G: Smoking is not permitted in or on an y property with 4 units or g reater. For properties wit h 3 units or less, smoking is no t permitted in t he property . There are no ex ceptions. An y other flammables such as candles or incense are no t allowed. 4 Grills canno t be stored on t he balcon y/patio, or in under ground/indoor par king areas. Grills mus t be used 25 feet away from an y buildings tr ucture. W ood burning fireplaces are no t to be used. 12. RECREA TIONAL VEHICLES: Lessee shall no t park or s tore boats, tr ailers, unused, inoper able, or unlicensed vehicles on the Premises,inside t he garag e, or in an y parking area of t he Premises for any lengt h of time. Lessee shall no t repair vehicles on t he Premises, inside t heg ar ag e, or in an y parking area of t he Premises. An y unauthorized v ehicles ma y be tow ed at t he vehicle o wner's expense. 13. W ALLS/CEILIN GS/FLOORS: Lessee shall use small nails or pins t o fasten t o walls or 3M hook s. Small wall anchors ma y be used whenneeded. U pon move out, Lessee shall remo ve all nails/f asteners from t he walls and patch t he holes. Lessee shall no t leave ex cess spackling material on t he walls or use an y fasteners on t he ceilings, baseboar ds, trim work, or floors. F ailure to do so ma y result in f ees deducted fromLessee's Security Deposit. 14. LIABILITY INSURAN CE: All residents are required t o have liability insur ance and must provide certificates of insur ance to the A gent at Mo ve-In. R enters insur ance is highl y recommended.15. C OMMON AREAS: Common areas, including hallw ays and s tairwells, shall no t be used as s tor ag e areas. Lessee shall no t leave an ything unattended in an y common area, and an y personal property left in common areas will result in remo val and s tor ag e f ees f or the Lessee. 16. B ALCONIES/P ATIOS: Balconies shall no t be used for stor ag e, ex cept for patio fur niture. Nothing shall be attached t o patio or balconyr ailings, and no placar ds, signs, or flags can be displa yed on t he patio/balcon y area. Plants are accep table.17. RESIDENTIAL USE: Lessee shall use t he Unit for residential pur poses only and shall com ply wit h local or dinances reg arding occupancy .N o businesses ma y be conducted on t he Premises.18. USE OF PREMISES: Lessee shall no t use or permit the Premises t o be used for any unla wful pur pose that will har m the reputation of t he A gent or t he Premises. Lessee shall no t use or keep in or about t he Unit an ything t hat would adv ersely affect insur ance cover ag e of t he Premises under a s tandard fire and extended insur ance policy.19. SIN GLE FAMILY/DUPLEX Y ARDS: Lessee shall k eep the front, back , and side yards free of clutter , temporary f encing, inoper able orunlicensed v ehicles, or an y other items deemed as clutter b y the A gent. 20. QUIET TIME: Lessee and t heir guests shall no t make excessiv e noise or eng age in activities t hat disturb neighbors or o ther lessees betw een 8am-10pm. Quiet hours are from 10pm t o 8am when more caution must be taken to reduce noise. S tereos, radios, tele visions, andsurround sound sys tems shall not be played loudl y enough t o affect other Lessees ’ rights to quiet enjo yment of the Premises, reg ardless of time of da y. Laundr y shall no t be done during quiet hours. If t he Agent receiv es 3 noise com plaints, the Agent ma y, at its sole discretion, deem t he Lessee t o be in breach of t he Lease on the 3rd com plaint. 21. BEHA VIOR: Lessee shall obe y all lawful or ders, rules and regulations of all go ver nmental aut horities.22. UNIT CLEANLINESS: Lessee shall k eep the Unit in a clean and habitable condition and in as good repair as at t he beginning of the Leaseter m, nor mal wear and tear ex cepted. 23. UNIT TEMPERA TURE: To prevent damag e to t he Premises, Lessee is responsible f or maintaining a minimum temperature of 60 deg reesF ahrenheit during cold w eather . Upon v acating, Lessee mus t leave t he heat on and set at 60 deg rees Fahrenheit. If damag e occurs due toLessee's f ailure to do so, Lessee will be held liable f or the damag es.24. REFRIGERA TOR: T o prevent odors and damag e, Lessee must ensure that the refrig erator is lef t plugged in and tur ned on, especiall ywhen v acating t he unit. 25. GENERAL: Lessee mus t obtain written consent from A gent bef ore taking an y of the following actions: painting, attaching signs or placar ds, altering t he unit or the Premises, attaching an ything t o the exterior of t he Premises, placing mats wit h spike style g rips on car peting, or displa ying any signs or placar ds in windows. Solicitation or political signs are no t allowed. 26. GUES TS: Lessee is no t permitted t o allow any gues ts or in vitees t o reside in t he Premises f or more than 14 cumulativ e days per mont hwit hout obtaining written consent from A gent. 27. AMENDMENT T O RULES AND REGULA TIONS: Agent reser ves t he right t o amend an y Rules and R egulations at an y time by providing written no tice to Lessee at leas t 28 days in adv ance. Any violation of t hese Rules and R egulations will be considered a breach of t he leaseag reement. 1. By initialing belo w, Lessee ackno wledg es and ag rees to the ter ms in Section 2. NON-STANDARD RENTAL PROVISIONS 3.1 LIABILITY All Lessees, if more t han one, shall be held jointl y and individually responsible for fulfilling all pa yment obligations outlined in t he leaseand an y additional pro visions.Initial HereX 3.2 LESSEE BENEFITS PACKAGE A $5 mont hly ser vice f ee is char ged b y Main S treet Manag ement to cover t he cos t of various ser vices, including online portal access, onlinepa yments, in-person cash pa yments at select retailers, online maintenance reques ts, electronic statements, and office manag er assistance during regular business hours. A dditionally, t he f ee g rants access t o credit building resources, and access t o local real estate agents for home purchasing. Initial HereX 3.3 UTILITIES The Lessee is responsible f or ensuring that all utilities are in t heir own name at t he start of t he lease ter m and for maintaining t hemt hroughout t he duration of t he lease. If t he Lessee is responsible f or paying f or utilities, t hey mus t use reasonable care t o manage the utility usag e and cos ts. Any unpaid utilities, w ater bills, fees, and final bills ma y be deducted from the Lessee's security deposit. A $50 f ee will beim posed if utilities are no t put in the Lessee's name b y move-in da y, and a $100 f ee will be imposed if utilities are no t maintained throughoutt he lease ter m. Additionall y, if a w ater bill is tr ansferred t o the property tax recor d in Nov ember , a $100 f ee will be im posed. Initial HereX 3.4 LEASE ADJUSTMENT FEE If Lessee reques ts any chang es to be made t o their account, such as adding or remo ving roommates or updating contact inf ormation, a $100 adminis trativ e fee will be char ged t o their account. A dditionally, if t he chang e requires a ne w lease to be generated, an application f ee may also be applied. These f ees must be paid in full bef ore the reques ted chang es can be made t o the account. Initial HereX 3.5 SUBLETTING Lessee ag rees not to assign t his Lease or sublet an y part of the rented U nit without obtaining written consent from t he Agent. An y unaut horized subletting will result in a $500 violation f ee, forfeiture of t he security deposit and e viction of the unauthorized subletters. This includes, but is no t limited to, scheduledinspections, repairs, maintenance, and sho wings. Repeat offenses ma y result in additional penalties or ter mination of the lease.Initial HereX 3.7 RESIDENT CHARGES/PAYMENTS Lessee ag rees to pay any and all cos ts associated wit h any necessar y repairs or maintenance t hat result from neglect, misuse, or damag ecaused b y the actions of Lessee, t heir guests, occupants, or in vitees within 30 days of being billed. These cos ts may include, but are no tlimited t o, vendor in voices, supplies, labor cos ts, loss, or damage. If any amount remains un paid after the 30-da y period, t he costs may be sent t o collections. A dditionally, Lessee ackno wledg es that such cos ts may be deducted from t heir security deposit if necessar y. Initial HereX 3.8 LATE FEES If Lessee’ s rental pa yment is no t made as set f orth in t he Lease, a late f ee will be assessed as f ollows: • A $50 late f ee will be char ged t o Lessee's account if pa yment is not received by the 5t h of each mont h.• A 5-da y pay or v acate no tice will be emailed, mailed and pos ted to Lessee's residence if pa yment is not received by the 6t h of each mont h. • An additional $10 f ee will be charged t o Lessee's account if a 5-da y pay or v acate is mailed and pos ted.These f ees are in addition t o any other remedies a vailable t o the A gent and ma y be deducted and wit hheld from the security deposit.A dditionall y, it is unders tood t hat all rental and o ther pa yments b y Lessee are due and pa yable on or bef ore the 1s t day of t he mont h, and time is of t he essence wit h respect to said payments. Initial HereX 3.9 BANK SERVICE CHARGE Lessee unders tands that if a check or electronic pa yment is tendered for payment of Lessee’ s current rent or o ther char ges is retur ned by t he bank un paid for any reason, t here shall be a $35 char ge in addition t o any late pa yment char ge described abo ve. A gent ma y require an ysubsequent rent pa yments to be paid b y cashier’s check or mone y order onl y, and shall no t be required t o accept payment b y check. Said char ge ma y be deducted and wit hheld from the security deposit. Initial HereX 3.10 KEYS/FOBS/GARAGE REMOTES U pon v acating t he Premises, Lessee shall retur n all property belonging to Agent, including k eys, f obs, par king per mits, and g arag e door openers. An y replacement cos ts for t hese items will be t he responsibility of Lessee and ma y be deducted from the security deposit. Lesseeis no t permitted t o change or install any locks on the premises wit hout Agent's appro val, and an y unauthorized chang es will result in a$60 f ee. A los t key or f ob will result in a $20 replacement cos t, a lost garag e remo te will result in a $50 replacement cos t, and lock codereprog ramming will result in a $20 f ee. 7 Initial HereX 3.11 HEAT/FURNACE FILTER Lessee is responsible f or maintaining a reasonable tem perature in t he unit during cold w eather t o pre vent damag e to t he premises. This includes setting t he thermos tat to at leas t 60 degrees Fahrenheit. If damag es occur as a result of f ailure to maintain a reasonable tem perature, Lessee will be held responsible and t he cost of repairs ma y be deducted from t heir security deposit. A dditionally, Lessee mus t replace thefur nace filter regular ly t o ensure proper function, wit h a recommended replacement schedule of e ver y t hree mont hs for s tandar d size filters 1" t hick and e ver y six mont hs for filters measuring 4-5" t hick.Initial HereX 3.12 GENERAL Lessee shall no t alter or make changes to the U nit or t he Premises wit hout written consent from A gent. This includes but is no t limitedt o attaching signs or placar ds, remodeling, driving nails or scre ws int o ceilings, floors, or w oodwork, altering cable, telephone or inter netoutlets, or affixing items t o the exterior of t he Premises. If a satellite dish is allo wed, it mus t be removed and t he affected property retur nedt o its original condition upon mo ve-out. An y damages incurred as a result of violation of t his provision ma y be deducted from t he securitydeposit. Initial HereX 3.13 SMOKING Lessee shall no t smoke or allo w any of Lessee’ s guests and in vitees to smok e within the unit common areas, or on an y part of the propertyif t he unit count is 4 or g reater. If the unit count is 3 or less, smoking is no t allowed in t he property , but is accep table on the property . If damag e results from smoking or cos ts are incurred for removing the smell of smok e, repairing damag es caused by smoke or by lit cig arettes, or cleaning up cig arette butts, Lessee shall be liable f or these damag e and/or cos ts, and the same ma y be deducted and wit hheld from thesecurity deposit. The f ee for smoking on t he property is $100.Initial HereX 3.14 OFFENSIVE ODORS U pon v acating t he Premises, Lessee shall ensure t hat the unit is free of an y unpleasant odors. If an y odors are present upon mo ve-out, Lessee shall be responsible f or any associated cos ts to remedy t he odor, including but no t limited to painting, cleaning, and use of an on-siteozonat or, which will be billed at $150 per use. These cos ts may be deducted from t he security deposit.Initial HereX 3.15 PEST CONTROL Lessee will be held responsible f or any exter mination or remo val cos ts of pes ts, insects, or rodents on t he Premises if they are caused b y 8 Lessee's neglect, f ailure to keep t he unit clean, im proper disposal of w aste, or misuse of t he Premises. Lessee will be char ged a $40 f ee for an y pes t control actions tak en by Agent. Initial HereX 3.16 CANDLES Prolong ed candle bur ning can cause damag e to w alls and ceilings from soo t buildup. Therefore, the use of candles t hat produce soot isprohibited and an y painting expenses resulting from soo t damage may be char ged t o the tenant and deducted from t he security deposit asper applicable la ws. Initial HereX 3.17 REPAIR DRAINS Lessee is responsible f or keeping all plumbing fixtures and appliances in good w orking or der and onl y using them for their intended pur pose. Lessee shall no t dispose of any wipes (even flushable), sanitar y products, debris, sand, or o ther materials t hat may cause blockag esin t he plumbing. An y damages or costs incurred due t o misuse of plumbing fixtures will be char ged t o Lessee's account per v endor's invoice. Alter natively, a $50 f ee will be assessed if A gent clears t he blockag e. Initial HereX 3.18 WATER LEAKS Lessee mus t promptl y report an y water leak s from plumbing fixtures, such as sink s, toilets, w ater heaters, w ashing machines, or visiblebasement plumbing, t o Agent wit hin 24 hours of disco ver y. F ailure t o do so ma y result in additional damag es for which Lessee will be held liable and char ged f or repairs. Initial HereX 3.19 GARBAGE DISPOSAL Lessee ag rees to proper ly use t he garbag e disposal b y only disposing of small, rinsed f ood scraps and no t disposing of prohibited items suchas eggshells, bones, g rease, and non-food items. Lessee will be responsible f or any damag e or repairs resulting from misuse of t he garbag e disposal and will be char ged accor dingly. Initial HereX 3.20 TRASH/RECYCLING Lessee shall be responsible f or properly placing and retur ning trash and recy cling carts as per t he schedule set by the municipality and retur ning t hem to their designated s tor ag e location wit hin 24 hours of pickup. An y fines received by the municipality due t o Lessee's failuret o do so will be t he responsibility of t he Lessee and may be deducted from t he security deposit. 9 Initial HereX 3.21 LOCKOUT/LOST KEY If Lessee becomes lock ed out of the unit and reques ts access from Agent, a $50 f ee shall be char ged t o Lessee’ s account. A gent is a vailable f or lock outs during business hours onl y and at Agent’ s discretion. The f ee shall only be charged if A gent unlock s unit. When A gent is una vailable, Lessee mus t contact a locksmith. If Lessee loses a k ey, a $20 f ee will be char ged f or replacement on t he follo wing mont h’s rent. Initial HereX 3.22 FAILURE TO VACATE If Lessee remains in possession of t he Unit wit hout A gent's consent af ter the expir ation of t he Lease or ter mination of tenancy , Agent ma y char ge Lessee f or damages suffered as a result. The minimum damag es will be calculated as twice the daily rental v alue for the time t hat Lessee remains in possession. These damag es may be deducted from t he security deposit.Initial HereX 3.23 GIVING NOTICE PRIOR TO TAKING RESIDENCY If Lessee decides t o terminate t he Lease bef ore taking occupancy , Lessee will f orfeit t he full security deposit and will no long er be bound byt he Lease ag reement. Initial HereX 3.24 LEASE VIOLATION NOTICES The A gent reser ves t he right t o impose a $25 f ee for an y lease violation no tices or notices receiv ed from local municipalities reg arding t he presence of pets on t he property. Lessee will also be responsible f or paying an y fines related t o the no tice, in addition t o the $25 lease violation f ee. Initial HereX 3.25 PETS Lessee shall be held responsible f or any damag es caused b y their pet(s) t o the premises, including but no t limited to: stains, scr atches, che wing, ex cessive hair, odor , and pet urine or ex crement. If the damage results in t he replacement of flooring or o ther materials, Lessee is responsible f or the full cos t of replacement. Lessee mus t have t he flooring prof essionally cleaned bef ore vacating and pro vide Agent wit h a cop y of t he receip t. If Lessee f ails to do so, A gent ma y incur t he cost and deduct it from t he security deposit or pet deposit. A $500 f ee willbe char ged and t he pet mus t be removed from t he property if Lessee k eeps a pet without a signed P et Addendum. 10 Initial HereX 3.26 UNAUTHORIZED PETS The penalty f or housing a pet(s) wit hout a signed Pet Addendum is $500 and t he pet must be removed from t he property immediatel y. Initial HereX 3.27 VACATING PRIOR TO END OF LEASE TERM If Lessee ter minates their Lease ear ly , t he y will be char ged a $500 relet f ee and will be responsible f or any cleaning or repairs needed in t he unit upon v acating. This fee will be char ged separ ately and canno t be withdrawn from t he security deposit. Lessee will also f orfeit t he remaining security deposit and an y rental concessions given will be charged t o their account and mus t be paid in full before vacating. Initial HereX 3.28 UNIT TRANSFER If Lessee wishes t o move t o a different unit wit hin Agent's portf olio, a $250 tr ansfer fee will be required and mus t be paid before the tr ansfer process can begin. A dditionally, a ne w security deposit will be required upon signing t he lease for the ne w unit. Initial HereX 3.29 INSPECTION Lessee is responsible f or ensuring smoke detectors and carbon mono xide detectors are in proper w orking or der and f or maintaining clean fur nace filters. If t hese items are f ound to be in non-com pliance during the annual inspection, Lessee will be char ged f or an y necessar yrepairs or replacements, including labor cos ts. A fee of $25 will be char ged f or Manag ement to replace a dirty 1" t hick filter, and $50 f or a 4"or 5" t hick filter .By initialing belo w, y ou ackno wledg e and ag ree to the ter ms in Section 3. Initial HereX 4. LESSEE FEE SCHEDULE 4.1 LESSEE FEE SCHEDULE The f ollowing f ees are part of t his Agreement. These char ges ha ve been put in place t o offset the cost and time in vol ved t o address each issue lis ted belo w on behalf of t he Lessee. Failure to pay these f ees when due will cons titute a breach of this Agreement: • LESSEE BENEFITS P AC KA GE ($5 per mont h) : A mont hly ser vice f ee of $5 is char ged b y Main S treet Manag ement to offset ser vice cos ts. This includes online portal access, online pa yments, cash payments at select retailers, online maintenance reques ts, electronic 11 s tatements, access t o office management during business hours, and drop bo x access at Main Street Management's office during business hours. The f ee also covers credit building ser vices and access to local realtors when the Lessee is ready t o purchase a home.• F AIL URE T O TRANSFER/C ONNECT UTILITIES ($50) : A f ee char ged when a Lessee f ails to connect utilities in t heir name by move- in da y, in addition t o any pror ated utility char ges o wed. • F AIL URE T O MAINT AIN UTILITIES ($100) : Lessee is required t o maintain utilities in t heir name and pay the balance o wed in full per billing period until t he termination of t he Agreement. F ailure to do so incurs an inspection, schedule f or utility re-connection, delayof needed repairs, and extr a accounting work. If a w ater bill is tr ansferred t o the property tax recor d in Nov ember , a $100 f ee will be char ged. • F AIL URE T O ALLO W ACCESS ($50) : If t he Lessee f ails to allo w Agent, v endor hired b y Agent, or A gent representativ e access to the unit af ter proper no tice, a $50 fine will be assessed f or each instance. • UN AUTHORIZED PET FEE ($500) : Lessee shall no t have an y pets on t he premises wit hout Agent's prior written consent.
