First | | | | edition 2023. | | | | TechFactors, Inc. | | +-----------------------+-----------------------+-----------------------+ **JUDICIAL BRANCH OF THE GOVERNMENT** **JUDICIAL POWER** - The power to resolve legal disputes is vested in the Supreme Court and the lower courts under its supervision. - **Judicial power --** the authority of courts to settle justifiable controversies or disputes involving rights that are enforceable and demandable or the redress of wrongs for violation of rights. - The new Charter introduced the provision giving the courts power to determine whether or not there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of any branch or instrumentality of the Government. - These courts exercise what is called judicial power.  - Taking and evaluating evidence;  - - - Required to investigate facts or ascertain the existence of facts, hold hearings, weigh evidence and draw conclusions from them as basis for their official action, and exercise of discretion in a judicial nature. Life; 2. Liberty and 3. Property. - - - - **In civil cases** the defendant is notified through the issuance of summons to which is attached a copy of the complaint. If the defendant does not file an answer despite notice, the court will issue an order declaring the defendant in default and proceed to hear the evidence of the plaintiff before deciding the case. - **Criminal cases** the prosecutor first conducts a preliminary investigation of the complaint against the accused, wherein the latter will be given an opportunity to file a counter-affidavit. During the trial, the court will receive the evidence in his or her behalf, or flees after being arraigned (where the information is read in a language known to the accused), the court will nevertheless render judgement based on the evidence presented and the applicable law.  - Technicalities are frowned upon in **administrative cases**. It is doctrinal that the essence of due process in administrative proceedings is the opportunity to explain one's side or seek a reconsideration of the action or ruling complained of. **Liberty and life --** a person may be lawfully deprived of liberty if he or she is: 1. A detention prisoner awaiting the completion of trial, or has been convicted of a criminal offense and is already serving the penalty imposed by the court. 1. An alien who illegally enter the country or violate the conditions of their stay, before these aliens are deported to their countries of origin. 1. Is caught in the act of committing crimes (in flagrante delicto).      \*If it is believed that there is no lawful cause for the detention of the individual, then a petition for habeas corpus is a writ of liberty. **Petitions for habeas corpus** --are not only filed against the government in case where it is alleged to be holding persons in custody without any lawful cause.  **Seizure of private property** -- if the State exercises its power of eminent domain, then it may take over private property by paying just compensation to the landowner. **Writ of possession --** authorizes the government to take possession of the condemned property so that it can immediately start the project (often infrastructure) covering the property. **Private property** can also be forfeited to the State if it is declared by a court as proceeds of a crime. Aside from imposing the penalty of imprisonment, the court hearing a criminal case may order the confiscation of the property found to be part of a criminal enterprise or activity.  ***[GRAVE ABUSE OF DISCRETION]*** **Abuse of discretion --** refers to the standard applied by the Supreme Court in reviewing a government offices or official's decision which is claimed to be grossly unsound, unreasonable, or illegal. **Writ to elevate records of abuse (the remedy of certiorari) --** is no longer limited to the "abuse of discretion" committed by judicial and quasi-judicial bodies, the writ also covers the acts of the executive and legislative branches which are considered unconstitutional or illegal. **Political question (non-justiciable question) --** is a question of policy that a court will not consider. It pertains to a question which, under the Constitution, is decided by the people in their sovereign capacity, or a question that involves the exercise of discretionary power by the executive or legislative branch of government.  - Courts maintain a "hands-off" policy with regard to political questions, that is, they will declare an issue a political question and refuse to resolve it.  **Grave abuse of discretion** has been described as "such capricious and whimsical exercise of judgement as its equivalent to lack of jurisdiction. There is a grave abuse of discretion: - When an act is done contrary to the Constitution, the law, or jurisprudence; - When it is executed whimsically, capriciously, or arbitrarily out of malice, ill will, or personal bias. **[POWERS OF THE SUPREME COURT]**  **Supreme Court --** is the highest court in the Philippines and it is composed of a Chief Justice and 14 Associate justices. - Sits en banc (one body) or in divisions of three, five, or seven members.  ***[Powers:]*** 1. Hear and decide cases affecting ambassadors, other public ministers and consuls, and over petitions for certiorari, prohibition, mandamus, quo warranto, and habeas corpus; 1. Review final judgements and orders of lower courts in: - all cases in which the constitutionality or validity of any treaty, international or executive agreement, law, presidential decree, proclamation, order, instruction, ordinance, or regulation in question; - all cases involving the legality of any tax, impost, assessment, or toll, or any penalty imposed in relation thereto; - all cases in which the jurisdiction of any lower court is in issue; - all criminal cases in which the penalty imposed is reclusion Perpetua or higher; - all cases with only an error or question of law is involved; c. Assign temporarily judges of lower courts to their stations as public interest may require. c. Order a change of venue or place of trial to avoid miscarriage of justice c. Promulgate rules concerning the protection and enforcement of constitutional rights, pleading, practice, and procedure in all courts, the admission to the practice of law, the integrated bar, and legal assistance to the underprivileged, and review rules of procedure of special courts and quasi-judicial bodies c. Appoint all officials and employees of the judiciary in accordance with the Civil Service law; c. Exercise administrative supervision over all courts and the personnel thereof. **[JURISDICTION]** **Jurisdiction-** is defined as the power of the courts to take cognizance of and decide cases. - May be original or appellate, exclusive or concurrent, general or special. 1. **Regional Trial Courts (RTC) --** exercise jurisdiction over all civil actions incapable of pecuniary estimation (like complaints for expropriation), actions involving the contract of marriage and marital relations, cases previously handled by the Juvenile and Domestic. - They also handle criminal cases not falling within the exclusive jurisdiction of any other court, except those within the jurisdiction of the Sandiganbayan, and exercise original jurisdiction in the issuance of the writs of certiorari, prohibition, mandamus, quo warranto, habeas corpus, and injunction. B. **[JUDICIAL REVIEW]** - - - **[REQUISITES OF JUDICIAL REVIEW]** The requirements before a litigant can challenge the constitutionality of a law are well-delineated. They are: **a. Earliest Opportunity** - - - **[CONSTITUTIONAL QUESTION]** - - **[QUALIFICATIONS OF MEMBERS OF THE JUDICIARY]** Based on the provision, a justice of **Supreme Court, Court of Appeals, Sandiganbayan, and Court of Tax Appeals** must be: 1. A natural-born Filipino citizen; 2. At least 40 years old; 3. With at least 15 years' experience as a judge or law practitioner in the Philippines. A judge of the **Regional Trial Court** must be: 1. A natural-born Filipino citizen; 2. At least 35 years old; 3. With at least 10 years' experience as a judge or law practitioner in the Philippines or in public office requiring admission to the practice of law. **Metropolitan Trial Court, Municipal Trial Court, and Municipal Circuit Trial Court:** 1. A natural-born Filipino citizen; 2. At least 30 years old; 3.
