HUMAN RESOURCE MANAGEMENT Magna Carta for Public Health Workers Act, 1992 Philippines Magna Carta for Public Health Workers (R.A. 7305) is a law in the Philippines, enacted in 1992 (though commonly referred to as the 1996 version due to amendments and implementations), aimed at promoting the welfare of public health workers by improving their working conditions, benefits, and rights. Its key objectives are to ensure that health workers are adequately compensated, protected, and motivated in their service to the public. Here are the key provisions of the act: a.) Republic Act Concerning Private Education (6728),1989 Philippines This Act grants government assistance to students and teachers in private education. Private school teachers who have meager earnings (mostly female) can avail themselves of scholarships to enable them to pursue higher education to qualify for more responsible positions. Labor Code of the Philippines, 1974 The Labor Code of the Philippines is the legal code governing employment practices and labor relations in the Philippines. Labor Code of the Philippines, 1974 Article 130 provides for a prohibition on women to be employed or permitted or suffered to work during the night, between ten o'clock in the evening and six o'clock in the morning with some exceptions from Article 131: o (a) In cases of actual or impending emergencies caused by serious accident, fire, flood, typhoon, earthquake, epidemic or other disasters or calamity, to prevent loss of life or property, in cases of force majeure or imminent danger to public safety; o (b) In case of urgent work to be performed on machineries, equipment or installation, to avoid serious loss which the employer would otherwise suffer; Labor Code of the Philippines, 1974 o (c) Where the work is necessary to prevent serious loss of. perishable goods; o (d) Where the woman employee holds a responsible position of managerial or technical nature, or where the woman employee has been engaged to provide health and welfare service; o (e) Where the nature of the work requires manual skill and dexterity of women workers and the same cannot be performed with equal efficiency by male work; o (f) Where the women employees are immediate members of the family operating the establishment or undertaking; [and] o (g) where increasing demand for work provide equal opportunities to work at night; and o (h) Under analogous cases exempted by the Secretary of Labor and Employment in appropriate regulations. Labor Code of the Philippines, 1974 According to Article 12, the Secretary of Labor must established standards that will ensure the safety and health of women employees, notably in relation to seats, separate toilet rooms and lavatories, nurseries, minimum age, and other standards for retirement. Labor Code of the Philippines, 1974 Article 135 strengthens the prohibition of discrimination against women with respect to terms and conditions of employment. Article 136 prohibits employers from requiring a woman employee to marry, deeming marriage as resignation or separation, or discriminating against her due to her marriage. According to Article 137, it is prohibited to discharge a woman on account of her pregnancy, or while on leave or in confinement due her pregnancy. It is also prohibited to discharge or refuse the admission of a woman upon returning to work for fear that she may be pregnant again. Labor Code of the Philippines, 1974 Under R.A No. 7655 (Act Increasing the Minimum Wage of House Helpers), house helpers who are receiving at least 1,000 pesos must be covered by Social Security System and are entitled to all the benefits provided thereunder.
