FAMILY LAW ASSESSMENT QUESTIONS THE ENGAGEMENT QUESTION 1 Discuss whether the following engagement contracts are valid: Refer to case law in you answer. (a) Mr X, a married man, promises to marry Miss Y after obtaining a divorce from his spouse. (5) (b) Mr X promises to marry Miss Y after she tells him that she is pregnant by him. It later becomes clear that Miss Y is not pregnant. (5) (c) Mr X and Miss Y agree to marry on a certain day. Mr X is later informed that Miss Y’s brother has served two years in jail for theft and that her uncle was recently executed for the murder of his wife. (5) QUESTION 2 Miss A, 16 years old, was engaged with the consent of her parents to Mr B, who breached the contract unlawfully and in a contumelios manner. Miss A in preparation of the marriage, has already purchased a number of articles for the future home. She now asks you, her lawyer to sue Mr B. Inform her what you will be claiming on her behalf and why. (10) QUESTION 3 Bobby and Sue, both aged 40, are engaged to be married. A week before the wedding Sue breaks off the engagement, telling their mutual friends and family at a braai that she has no desire to marry a boring, overweight and stupid man. Advise Bobby of his remedies against Sue. Assume that the parties intended marrying in community of property. Refer to case law. (10)
