Motivation There are different agencies who are mandated to conduct anti-illegal drugs operation, as police officer especially those assigned at anti-drug units, we must abide on the rules and procedure while conducting all forms of anti-illegal operations. This will help us to improve our operations in conducting buy-bust operations. Instructor Note: Ask the participants:”Who among in these class already been assigned in anti- illegal drug units”; “Can you share your experience in your previous unit?” III. Lesson Buy-Bust Operation as defined: A type of planned operation commonly used in anti-narcotics operation. In this type of operation the poseur-buyer in law enforcement agency pretends to buy illegal drugs from suspect/target. Who are agencies involve in conducting Buy-Bust Operation? 1. Philippine Drug Enforcement Agency-lead agency in the implementation of all forms of anti- illegal drugs operation. 2. PNP Anti-Illegal Drug Units- deputized agency authorized by the Philippine Drug Enforcement Agency to help them in implementation of all forms of anti-illegal drug operation A. PNP Drug Enforcement Group B. Regional Drug Enforcement Unit C. Provincial Drug Enforcement Unit D. District Drug Enforcement Unit E. Station Drug Enforcement Unit 3. NBI Anti-Illegal Drug Special Operations Task Group-deputized agency tasked to support the other units and the lead agency for the implementation of all forms of anti-illegal drug operations. Team Composition A. Team Leader- preferably a PCO, responsible for leading his team in the conduct of case build, raid, arrest, investigation, filing and monitoring of the case. B. Assistant Team Leader- responsible for giving assistance to the Team Leader and assuming all the responsibilities in the absence of Team Leader C. Poseur-Buyer-the police officer who is designated to pretend to be a civilian buyer of dangerous drugs for purposes of effecting the arrest of the suspect/target. D. Back-Up/Arresting Officer- personnel who secures the area of operation while conducting buy bust operation. E. Investigator on Case- responsible in the investigation, gathering of evidence and in the preparations of documents for purposes of Inquest or Direct Filing of the case before the prosecutor’s office. F. Seizing/Inventory Officer-designated to seize and inventory the evidence from the arrested suspect. G. Recorder- responsible for recording the actual operation (Note: The team composition may be modified as necessary based on the demand of the situation) What are the documents needed prior to the conduct of Buy-Bust Operation? 1. After Surveillance/Casing Report, After Test-Buy Report,After Contact Meeting Report: documents secured prior to the implementation of search warrant if the target is a big time pusher, it also attached in the Information Report of a High Value Individual. 1. Pre-Operational Report- a report in a standard form prepared form prepared by PDEA indicating details such as identity of subject/target, area of operation, composition, tactics and equipment of the operating unit and duration of operation. 2. Coordination Form-is a document issued by PDEA to anti-drug units prior the conduct of a planned anti-drug operation in compliance to section 86, para(a) of the Implementing Rules and Regulation of R.A 9165. It serves as a mechanism of the agency in monitoring the anti-drug operations of all anti-drug units. 3. Spot Report- a document submitted within six (6) hours every after positive operation. 4. Progress Report- a document submitted the soonest possible time upon the release of chemistry/laboratory reports and details of status of the case filed. 5. After Activity Report- a document submitted within twenty-four (24) hours after every termination of a negation operation.Further, operating units must state the underlying circumstances which yielded the operation negative. Tools for Marking 7. Masking Tape 8. Zip-lock Plastic Container 9. Tarpaulin with markings of Drug and Non-Drug Evidence indicating the name of Operating Unit 10. Camera Buy-Bust Phase ⚫ Reporting of the Informant ⚫ Surveillance and Casing of the team ⚫ Test Buy ⚫ Coordination with the lead agency and other territorial units ⚫ Briefing of the Team ⚫ Jump-Off ⚫ Actual Operation After Buy-Bust Operation Phase ⚫ Arrest of suspect/Target ⚫ Seizing of Evidences Recovered ⚫ Actual Markings and Inventory of Seized Evidence ⚫ Invitation of Mandatory Witnesses in compliance of section 21 of RA 9165 ⚫ Back to Police Station for documentation and Inquest proceeding of the suspect.
