# TEMA 18 - PARTE I ## El Ministerio de Sanidad **Estructura y competencias** - The declaration in March 2020 of the situation of emergency caused by the COVID-19 outbreak as a global pandemic by the World Health Organization, as well as the subsequent actions to control the disease by the Spanish Government, have marked a turning point in relation to the management of health policy and have highlighted the need to strengthen the Ministry of Health in the face of possible outbreaks of the disease, as well as in the face of the emergence of new potentially pandemic diseases. - In this regard, the Congress of Deputies has established the Commission for the Social and Economic Reconstruction of Spain following the COVID-19 pandemic. The Commission has debated a package of health measures, including the development of contingency plans to prevent and address potential outbreaks, the update of national and regional health legislation, or the strengthening of the National Health System, among other measures. - In order to implement these new measures effectively, and in order to address the increased workload of the Ministry of Health as a result of the pandemic caused by COVID19, it is necessary to strengthen the structure of the Department. - Therefore, in the last 3 years, the initial structure of the Department (Royal Decree 139/2020, which establishes the basic organic structure of ministerial departments) has been modified on several occasions, the last being in October 2021. - The current structure of the Ministry of Health is established by Royal Decree 852/2021, of October 5, which amends Royal Decree 139/2020 of January 28, which establishes the basic organic structure of ministerial departments, and Royal Decree 735/2020 of August 4, which develops the basic organic structure of the Ministry of Health, and amends Royal Decree 139/2020 of January 28, which establishes the basic organic structure of ministerial departments. - Any provisions of equal or lower rank that contradict the provisions of this Royal Decree are repealed, in particular, Royal Decree 454/2020 of March 10, which develops the basic organic structure of the Ministry of Health, and amends Royal Decree 139/2020 of January 28, which establishes the basic organic structure of ministerial departments. ### Organization Chart This document includes a diagram of the Ministry of Health's organization chart, but the actual organization chart cannot be reproduced here. The powers assigned to the Ministry of Health in this Royal Decree are understood to be coordinated and without prejudice to those assigned to other ministerial departments. - Under the overall leadership of the Ministry of Health, the Ministry of Health performs the following legal and regulatory functions through the following superior and executive bodies: - Is responsible for exercising the functions listed in Article 63 of Law 40/2015 of October 1, and the direction, impetus, and supervision of its dependent executive bodies and, where applicable, of the public bodies assigned to it. - Also, the Undersecretariat coordinates the Department's actions in relation to those matters referred to the Government's collegiate bodies. - **Specific functions:** - Managing staff (functionary, statutory, and labor), including the preparation of job descriptions, the draft of public job offers and employment plans, the calling and resolution of the selection processes for functionary and labor staff and the competition for functionary staff of the Department and its autonomous bodies; staff training and promotion, social assistance and relations with the staff -
