BH&IN-02 Volume III – Employers Requirements (RS) 1 Scope of the General Specification 1.1 General 1.1.1 This Specification covers the general aspects of the Tender viz., description of the Works, submittal requirements of Design & Drawings, Management Plans, Project Planning and Progress Monitoring, Site Management, Drafting and CAD Standards, and Contractor's obligations for safety and health etc. This General Specification shall be read in conjunction with the General Conditions of Contract (GC), Particular Conditions of Contract (PC), Technical Specifications, M&W Specifications and Instructions to Bidders. The abbreviations used in this General Specifications are given in Appendix IX to this Specification. 1.1.2 General Description of the Works. Bhopal Metro Project Bhopal Metro Rail Project sanctioned by Government of India comprises of two corridors. The total length of the project corridors is 30.95 Kms. One common depot has been planned near Subhash Nagar Station to cater to the needs of both Purple line and Red line. The depot at Bhopal shall include train stabling, washing / cleaning, inspection, maintenance, repairs and overhaul facilities. The depot will have test track. Indore Metro Project Indore Metro Rail Project sanctioned by Government of India comprises of Ring Line called yellow Line. The total length of the project corridor is 31.46 Kms. The depot will have test track. 1.1.3 Rolling Stock supply targets for these shall be governed as per the specified key dates schedule. 1.1.4 The delivery priority for the trains in Bhopal and Indore may also vary slightly. Corrigendum 7 1.1.5 The Scope of Works under this Contract covers design, manufacture, supply, testing and commissioning of passenger Rolling Stock and the training of operation and maintenance personnel for both Bhopal & Indore Metro Rail Projects of MPMRCL. The Scope also covers comprehensive maintenance of trainset for 15 years for both Bhopal & Indore Metro and maintaining agreed quantity of spares (maintenance, emergency, overhauling, UES etc.), consumables, tools, special tools, testing and diagnostics equipment, jigs, fixtures, gauges and test benches, etc. for maintenance, repair and overhaul of cars. The Contractor shall ensure that major overhaul (except mid-life refurbishment related activities) of all the systems of Rolling Stock have been performed at least once during the contract period. The Contractor shall ensure that major overhaul (except mid-life refurbishment related activities) of all the systems of Rolling Stock have been performed at least once during the contract period (including extension of 5 years as per PC 13.3.1(1)). The details of minor and major overhaul of all the system and sub system of the Rolling stock shall be submitted in technical bid. 1.1.6 The cars required for the corridors shall be of modern design, lightweight made of stainless steel / aluminium, with 3 phase AC drive having V.V.V.F control, regenerative braking and suitable for CBTC based ATP, ATO etc. provided by other Designated Contractors and shall be suitable for Unattended Train Operation conforming to Grade of Automation - ‘GOA4’ as specified in IEC 62290 latest version. The cars shall operate on 750V dc, third rail system for elevated, at-grade and underground sections. Bengali Sq. – Bhawarsala – 1 25 3 75 Airport – Palasia – Bengali Sq. 1.1.8 The Employer is in the process of developing Operation & Maintenance Plan for the Project concurrently with the progress of the Project implementation. The O&M Plan shall be progressively evolved and refined with inputs from various Project Contractors including Rolling stock contractor as well as other agencies. 1.1.9 The Project Owner (MPMRCL), by itself and/or through its representatives / consultants will exercise appropriate financial and technical oversight over the Bhopal & Indore Metro Rail Projects. The Contractor shall be required to send one copy of all its submissions to the Engineer, to the Project Owner also. The Project Owner may appoint independent quality and safety auditors for monitoring and ensuring quality and safety of the Works being executed. The Project Owner may require witnessing of any or all of the Tests, procedures, working methodology by its representatives with a view to assessing the suitability and the Contractor shall be responsible for extending required facilities / assistance for this purpose 1.1.10 The Contractor shall also carry out effective interface coordination with other Designated Contractors and other appointed Contractors by the Employer from time to time, during the Contract duration. 1.1.11 The Contractor shall carry out Integrated Testing and Commissioning of cars on the section in co-ordination with other Designated Contractors, under supervision of Engineer. He shall also carry out all statutory tests and trials on cars necessary for obtaining sanction of Competent/Statutory Authorities for opening the system for public carriage of passengers and provide assistance and information as required by the appropriate statutory authorities in India. 1.2 Indigenization Corrigendum 3 1.2.1 For manufacturing of cars, following mandatory conditions has to be fulfilled by bidder: i Minimum 75% of the tendered quantity of cars shall be manufactured indigenously with progressively increased indigenous content. ii For manufacture of these 75% cars, the contractor may either establish independent manufacturing facility in India or partner with a suitable Indian reputed manufacturer. In case manufacture is undertaken in the facilities of a local partner, Quality control (total) and testing at works shall be the responsibility of the member of consortium based on whose credentials the bidder has qualified for this bid. For the manufacture of the cars in the facilities of a local partner (holding/subsidiary/sister firm of the bidder or suitable Indian reputed manufacturer), in addition to the details submitted in the bid, the contractor shall submit proposal for approval by Employer within 6 months of award of contract. The proposal must include the complete details of the partner including details of technical capability and financial capability. Detailed plan for deployment of Contractor’s personnel in the partner’s works. Qualification procedures for key personnel including welders, crimpers, fitters etc. Detailed method statements for each activity including supply, manufacture, testing and commissioning. Details of method of welding to be followed for welding of roof of the car with side wall. Inspection procedures (stages as well as final) for sub-systems and complete car. Availability of M&Ps, Special tools, jigs, fixtures, gauges, test benches and diagnostic equipment etc. Details of transfer of technology to the partner including Engineering and manufacturing drawing or any other document required. Facilities for conducting factory acceptance tests of Rolling Stock as per IEC61133 latest version. The Tenderer are advised to survey manufacturing facilities already existing in India and make use of the same, if considered useful by them. While selecting the manufacturing facilities for the car body manufacturer, it shall be ensured that the car body manufacturing line shall be exclusively dedicated to stainless steel / Aluminium car body manufacture / welding and shall be physically totally partitioned from manufacturing related works with any other varieties of steel / Aluminium. This shall specifically be certified and committed while deciding local manufacture of car body and its components. Maximum number of 3-car trainsets that can be manufactured in the off-shore factory outside India is 13 trainset of 3-car each, i.e., 39 cars. Balance cars shall be manufactured in India (manufacture also includes assembly of Cars). For this, an essential condition for complying with the bid is that the Contractor shall establish facilities either independently or with an Indian Partner for local manufacture of coaches in India. In case local manufacture is undertaken in the facilities of the local partner, Quality control (total) and testing at works shall be the responsibility of the member of consortium based on whose credentials the bidder has qualified for this bid. The bidder shall submit detailed proposal indicating details of the Indian Partner (if any), the place of manufacture in India, work schedule etc in the bid. However, if not finalized at Pre-bid stage, the Contractor shall submit all these details within 06 (six) months of the Commencement date for approval by the Employer. For the manufacture of cars in India in addition to the details submitted in the bid, the Contractor shall submit detailed proposal for approval by Employer within 6 Volume III – Employers Requirement Page 19 of 404 Bhopal Metro Rail Project & Indore Metro Rail Projects Package BH&IN-02 Volume III – Employers Requirements (RS) (six) months of award of contract. The proposal must include complete details of Indian partner including details of technical capability and financial capability. Details of the Indian partner shall include, but not limited to, the following: - MoU indicating scope of work - Procedure for assuring Quality Standards - Detailed plan for deployment of Contractor’s personnel in Indian partner’s works - Qualification procedures for key personnel including welders, crimpers, fitters etc. - Detailed method statements for each activity including supply, manufacture, testing and commissioning. - Inspection procedures (stage as well as final) for sub-systems and complete car. - Availability of M & P, jigs & fixtures etc. - Details of transfer of technology to Indian partner. - Details of transfer of Engineering and manufacturing drawings. - Any other documents desired by Employer. Corrigendum 3 1.2.2 To facilitate ease in maintenance and easy availability of spares, MPMRCL is keen in standardisation and expects contractor to make efforts to source maximum number of equipments and materials from India. As per letter no. F.No. K-14011/10/2020-UT-V dated 7 th June,2021 issued by Ministry of Housing and Urban Affairs, Urban Transport Division (UT-V Desk), there is sufficient local capacity and competition and where public procurement shall be done only from local suppliers. The mandatory list of equipment/sub-systems is included in Table 1.1. The contractor (and the selected and approved OEMs) shall ensure that items listed in the Table 1.1 shall be mandatorily sourced from India either by establishing a wholly owned subsidiary in India or through a suitable Indian reputed manufacturer. The Contractor as well as the OEMs (as the case may be) shall arrange granting of unqualified licenses to their chosen Indian partners to manufacture and sell such indigenised items for other than BH & IN - 02 contract requirements also. The tenderer shall certify in its tender that the ‘Local Content’ (LC) shall meet the requirement for ‘Class-II Local Supplier’ as defined in the Order no. P-45021/2/2017-PP (BE-II) of Ministry of Commerce and Industry, Department for Promotion of Industry and Internal Trade, Government of India, dated 4th June 2020 for the items listed in Table1.1. During vendor approval stage, the Contractor shall also submit a commitment from the approved vendors that in case of any future procurement action by MPMRCL, they shall quote directly to MPMRCL. Contractor shall submit comprehensive proposal indicating details of the Indian Partner(s), the place of manufacture in India, work schedule etc. for the below identified items for indigenization within 6 months of the Commencement date for approval by the Employer. An approved comprehensive proposal for indigenisation of items indicated in ‘Table– 1.1’ shall be a pre-requisite for finalisation of Final Design. Maintaining quality standards, ensuring performance requirements and timely delivery shall be the sole responsibility of the contractor. Contractor shall ensure that indigenisation content in the train sets is progressively increased. MPMRCL expects that for all 156 cars for Bhopal & Indore metro the items given in Table 1.1 of Employer’s Requirements-General Specifications shall be sourced from India. Volume III – Employers Requirement Page 20 of 404 Bhopal Metro Rail Project & Indore Metro Rail Projects Package BH&IN-02 Volume III – Employers Requirements (RS) In case of any deviation on above, the Employer at his sole discretion on representation by the Contractor giving detailed reasons for not achieving indigenisation as per above may accord approval for waival subject to the condition that in case of non or partial accomplishment of indigenisation of any item(s) listed in Table 1.1 (except Consumables) for specified number of cars noted above, the contractor shall remit the cost of 20% of shortfall items (non-indeginised) to MPMRCL. The third rail having an aluminum alloy body designed with a stainless-steel wearing face is envisaged from high reliability and safety for the main line and Depot. The power system shall be suitable for regenerative braking of trains. 1.4 Climatic Conditions 1.4.1 The climatic conditions, which need to be taken into account by the Contractor for designing the Rolling Stock and the equipment provided therein, are furnished in the Employer’s Requirements - Technical Specification. 1.4.2 While designing and selection of the equipment and components, special care shall be taken for protecting these items against dust. As per the experience in India, high level of IP protection is required in order to ensure equipment reliability under severe dust conditions prevalent in Bhopal and Indore area and the same shall therefore be suitably considered during design. 1.5 Environmental Conditions in Tunnel 1.5.1 Tunnel ventilation is achieved primarily by the movement of vehicles inside the tunnel under normal working conditions. The relief of the piston effect generated by the train is achieved by means of draft relief shafts. Tunnel ventilation fans installed at each end of each station will be used to provide supplementary ventilation at times of high temperature, and under congested traffic or emergency conditions. These fans will provide reversible airflow and will intake from, and exhaust to the outside through ventilation shafts. The maximum design temperature inside the tunnel is expected to be 46°C under normal as well as congested conditions. Under emergency conditions of tunnel fire, the tunnel ventilation system will be used for smoke extraction by operating tunnel fans in push-pull mode. The allowable maximum temperature inside the tunnel during such smoke extraction will be below 60°C. 1.5.2 Track-way exhaust systems will be provided to extract a portion of train- generated heat while the train is within the bounds of a station. During normal conditions, under-platform exhaust as well as over-track-way exhaust fans will Volume III – Employers Requirement Page 25 of 404 Bhopal Metro Rail Project & Indore Metro Rail Projects Package BH&IN-02 Volume III – Employers Requirements (RS) operate. In addition, control of these fans shall be possible during congested and emergency conditions for the purpose of aiding tunnel ventilation and providing additional smoke removal capability for the station and tunnel. During emergency fire conditions within a station, the station air handling system will be operated to supplement smoke removal. 1.5.3 Tunnel walls may be wet and seepage water will normally be present in the invert. Rolling Stock supplied must therefore be capable of withstanding the effects of seepage and continue to operate in such wet and humid conditions. 1.6 Standards and Codes 1.6.1 Rolling Stock equipment and software shall be in accordance with the requirements of the standards and codes specified in the Employer’s Requirements Technical Specification. The Contractor may propose an alternative equivalent international standard during the design stage. The acceptance of the alternative standard will however be subject to review by Engineer. When a Standard or Code is referred to, it shall be assumed that the revision current on the date of tender submission or the revision made during the design finalization shall be applicable, unless otherwise stated. 1.6.2 Where no standard is identifiable, the Contractor shall make a proposal, based on the best international practice, which shall be subject to review by the Engineer. 1.6.3 During the preliminary design phase, the Contractor shall submit a consolidated list of all the standards that he intends to use for the design, manufacturing and testing and other phases of the Contract, for review of the Engineer. 1.6.4 During the design phase, the Contractor shall provide original copies of the English version (if not available translation shall be made available) of the standards used / referred, as part of the Contract. 1.6.5 The standards shall be provided in electronic format (soft copy). However, in case the same is not available, with the Engineer’s consent, original printed copy can be provided. 1.7 Units All drawings and design calculations submitted with the tender, or in accordance with the requirements of the Contract, shall use SI units. 1.8 Warranty (Defect Liability Period) 1.8.1 Warranty (Defect Liability) period shall start from commissioning of first train up to 24 months from the date of Taking Over of the last train after its introduction into revenue operation. Thus, the duration of the various trains under DLP shall vary. For example, if a train is taken over in month 24 th and last train is taken over in month 32nd, then the former train shall have DLP of 32 months and the DLP of the last train will be 24 months. 1.8.2 The Contractor shall be responsible for any defect or failure attributable to defective design, material or workmanship during the Warranty period. 1.8.3 Contractor shall also ensure that the technical support from Sub-Contractors / Vendors of following major equipment / subsystems shall be made available through suitable positioning of Sub-Contractor’s / Vendor’s staff at Depots for meeting DLP Volume III – Employers Requirement Page 26 of 404 Bhopal Metro Rail Project & Indore Metro Rail Projects Package BH&IN-02 Volume III – Employers Requirements (RS) obligations: i Propulsion system ii Auxiliary Power Supply system iii Brake and Pneumatic system iv Door v HVAC vi Bogie vii Any other system as advised by engineer 1.8.4 The repair and/or replacement of failed components and equipment and installation of repaired / replaced components / equipment shall be undertaken by the Contractor free of charge at depot at Bhopal & Indore. The Contractor shall bear custom duty, freight charges and all other expenses involved in collection of defective components and equipment from the depot, and transportation to the Manufacturer’s works for repairs / updating / modification etc. as the case may be and its return to depot after making it good for use. Further, should any design modification be required to any component or equipment as a consequence of failure analysis, the minimum period of DLP, i.e., 24 months shall recommence from the date when the modified part is commissioned into service in last train and modification shall be carried out free of charge. In all such cases, DLP will be applicable on complete sub-assembly; only when component has been modified / replaced / repaired due to design change / series manufacturing defect. Volume III – Employers Requirement Page 27 of 404 Bhopal Metro Rail Project & Indore Metro Rail Projects Package BH&IN-02 Volume III – Employers Requirements (RS) 2 Contractor’s Organisation and Superintendence 2.1 General 3 The Contractor shall staff the Project with manpower sufficient to achieve Completion by the Time for Completion. 4 Throughout the design and execution of the Works, and as long thereafter as is necessary to fulfil the Contractor's obligations, the Contractor shall provide all necessary superintendence to plan, arrange, direct, manage, inspect and test the work. 5 Superintendence shall be given by a sufficient number of persons having adequate knowledge of Hindi and the English language and any other language as may be appropriate, of the operations to be carried out (including the methods and techniques required and the hazards likely to be encountered and methods of preventing accidents), for the satisfactory and safe execution of the Works. 6 The Contractor's Personnel shall be appropriately qualified, skilled and experienced in their respective trades or occupations. 6.1 Organisation chart 7 Within 15 days of Commencement Date the Contractor shall submit the Contractor's mobilisation plan and organisation chart detailing his proposed management, design and technical staff organisation for the Contract for approval by the Engineer. 8 This organisation shall cover all aspects of the Contract and define the functions, responsibilities and authorities of each person represented. Lines of reporting and responsibility of subordinates shall be included in the chart. 9 Key Personnel shall be employed directly by the Contractor. The Contractor shall submit CV/Resume of all Key Personnel as mentioned in 2.3.1 for approval by the Engineer as a part of mobilisation plan and organisation chart. All Key Personnel shall be deployed by the Contractor at the site within stipulated time period as mentioned in 2.3.1 otherwise would attract penalty (as mentioned in ERGS clause 2.2.4) for delay of each month or part thereof. Corrigendum 10 10 In case of non-deployment of Key Personnel as mentioned in 2.3.1, the penalty shall be imposed pro-rata basis at the rate of Rs.2,00,000/- (Two lakh) per month for Key personnel with minimum 10 years of experience, Rs.2,40,000/- (Two lakh) per month for Key personnel with minimum 12 years of experience, Rs.3,00,000/- (Three lakh) per month for Key personnel with minimum 15 years of experience and Rs.4,00,000/- (Four lakh) per month for Key personnel with minimum 20 years of experience. It shall be deducted from Contractor’s interim payment applications. In case of non-deployment, for the part of the month, penalty shall be imposed on pro-rata basis. The decision of the Engineer in this regard, shall be final and binding. 11 The Contractor shall not remove, repatriate or replace any Key Personnel, without the prior approval of the Engineer. Any substitute Key Personnel should be suitably qualified and experienced for the duties of the position to which the Contractor intends to appoint them.
