CUSTOMS BROKERS TRAINING 2024 CUSTOMS BROKERS GOVERNMENT AGENCIES AGENCY DUTIES  OBJECTIVES  At the end of the sessions participants should be able to:  1. Identify all Government Agencies that has a restriction on imported commodities.  2. Distinguish between the different types of approval document issued by each Agency.  3. Identify the types of commodities restricted by each Agency.  4. Understand the legal authority and role of Customs in enforcing OGA restriction on imports and export.  5. Explain the process for the administrative approval for the importation of restricted commodity in the ASYCUDA System. Clearance GOVERNMENT AGENCIES  Supplies Control Unit  Public Utilities Commission  Forestry Department  Pesticide Control Board  Department of the Environment  Chief Pharmacist  Ministry of Health  BAHA PUBLIC UTILITY COMMISSION (PUC)  The PUC is the entity designated to restrict telecommunication and radio communication equipment.  The restriction is done using an import permit system and a list of restricted items that is given to the Customs Department.  The HS codes for these items are not locked in the system, therefore, Brokers must be aware of what is on the PUC list and have Importers apply for the permit prior to importation.  Permit must be attached to the SAD in the system.  No additional clearance is necessary.  Permit is not transferrable. PESTICIDE CONTROL BOARD  The Pesticide Control Board is a statutory body that is responsible for the restriction and registration of all pesticides, insecticides, rodenticides etc.  This restriction requires the registration of any of the above mentioned chemicals prior to importation and an approval form will be issued.  This form must be attached to the SAD in the system and a pesticide control board stamp must be placed on the entry either by BAHA or by the Board itself.  There is no administrative approval in the system for these commodity codes, however, the SAD will not be cleared without the stamp from PCB and approval form. INSECTICIDES  HS CODE: 3808.91.10.00 – for use in Agriculture as approved by the competent authority, whether or not put up in forms or packing for retail sale. The Pesticide Control Board is the competent authority to certify that a pesticide is for use solely in agriculture. - PCB stamp on the entry must contain a signature of the officer certifying the use of the pesticide in order for that HS code to be used. DEPARTMENT OF THE ENVIRONMENT  The Department of the Environment is a government agency that regulates the importation of ozone depleting chemicals, refrigerant base equipment, single use plastic and other products harmful to the environment. This agency deals with environmental management.  These restrictions uses a import license system that locks the HS commodity code of the restricted commodity in the ASYCUDA World system.  This restriction can only be cleared by DOE.  It is the responsibility of the Broker or Importer to contact DOE for clearance.  A valid DOE LICENCE must be attached to the SAD  There a list of restricted commodities for the DOE.  License cannot be transferred by the use of a certificate. DOE  Restriction and prohibition on single use plastic  a valid import license must be attached to the SAD  Approval is done in the system by the DOE because the HS codes are locked in the system.  License is not transferrable  There is a list of restricted single use plastic commodities available  Note:  Existence of non-restricted goods locked in the system MINISTRY OF HEALTH – CHIEF PHARMACIST  The Director of Health Services, specifically the Chief Pharmacist, in the Ministry of Health is task with the approval for the importation of all pharmaceuticals into the country whether or not they are prescription, over the counter, supplements or controlled drugs ( as per list).  The control drugs restricted items (psychotropic and a narcotic list) requires an additional permit prior to importation.  All other pharmaceutical require only the approval letter from the chief Pharmacist with the approval to import and/or the exemption code.  This approval must be attached to the SAD in the system  The commodity code for all pharmaceuticals except for supplements is lock in the system and must be cleared by the proper office. MINISTRY OF HEALTH – DIRECTOR OF HEALTH SERVICES  The Ministry of Health is the entity authorized to regulate precursor chemicals imported into Belize in industrial size containers such as drums.  This restriction as per list requires a letter of approval from MOH prior to importation.  This letter must be attached to the SAD in the system.  Restriction is not locked in the system by commodity code therefore no further clearance is necessary. BELIZE AGRICULTURE AND HEALTH AUTHORITY  BAHA is a statutory body that is tasked with the responsibility of plant and animal health and food safety.  The restriction on food items requires the approval of a BAHA landing permit prior to the importation of the restricted items (as per BAHA Food safety list).  The commodity codes are not locked in the system, however, a BAHA stamp is required on all entry before face-vet. This also extends to road motor vehicles, heavy off road machinery and certain chemicals and wooden packaging materials.  Only food safety has a restricted list, while all other restriction on imports are done on a risk basis approach. BELIZE AGRICULTURE AND HEALTH AUTHORITY  BAHA approval must be obtained before the start of the face-vet process.  The stamps are as follows:  Red stamp – means that documentation is pending and shipment does not require a physical examination of the consignment.  Blue stamp – without a signature means that the BAHA officer will do a physical examination of the consignment.  Blue stamp – with a signature means that the consignment will not be examined. SUPPLIES CONTROL BOARD  The Supplies Control Unit is tasked with the regulating and restricting of items that is a substitute for goods that are locally manufactured or produced.  There is supplies control scheduled that list all restricted items that requires an import or export license prior to import or exportation.  This license must be attached to the SAD in the system and certain products are locked in the system by the commodity code.  License is not transferrable by the use of a certificate, therefore the SAD and all corresponding documents must match the name of the license holder.  All supplies control import/export license are single use. And valid for 60 days. SUPPLIES CONTROL BOARD  Restricts the sale of liquor and other spirituous beverages such as whiskey, vodka, tequila, liqueurs and gin.  The above mentioned goods require the approval of SCU prior to importation so that labeling can be affixed immediately following the payment of duty.  All SAD C4000 and C4070 must attach letter of approval from SCU before clearance is granted FIREARM AND AMMUNITION CONTROL BOARD  The Firearm and Ammunition Control Board is the entity now responsible for the restriction of the importation of arms and ammunition, including gun of all types, except for military use.  The requirement for the importation of firearm and ammunition is the letter of approval from the board and signed by the CEO of Home Affairs.  This documents must be attached to the SAD in the system.  Entry must reflect the owner of the approval letter.  There is a prohibited firearms list but not a restricted firearms list.  Import requirement is still under review. BELIZE DEFENCE FORCE  The Ministry of Defense restricts the importation of military, naval or aerial warfare type of arms and ammunition and military or naval stores, aircraft of any type, military communication equipment, patrol vessels whether armed or unarmed etc.  These items require the written permission of the CEO in the Ministry of Defense.  Bombs and grenade, fireworks, gunpowder, nitroglycerine, dynamites blasting powder etc. requires an approval letter by the Minister of Defense/Commissioner of Police. Subject to review. FORESTRY DEPARTMENT  The Forestry Department regulates the importation and exportation of logwood and lumber and certain plants.  This restriction requires a permit from the Department of Forestry prior to importation or exportation and must be attached to the SAD.  This permit must also be supplemented by a Supplies Control License for certain products.  Items are not locked by commodity codes, therefore no further clearance is necessary. DEPARTMENT OF TRANSPORT/TRAFFIC DEPARTMENT  The Department of Transport and the Traffic Department under the city or town Council request the proper completion of the vehicle data sheet for all motor vehicles, outboard motors, tractors and other off-road vehicles.  This assist in the registering of these commodities and the proper application of transport fees.  All models within five years must have a Customs Enforcement Unit stamp and a round house stamp with the proper signatures.  Brokers is responsible to issue to the owner a copy of the following for registration purposes:  Customs receipt, stamped and signed by the cashier  Copy of the assessment form  Copy of customs declaration, stamp and signed by the valuation officer  Copy of the vehicle data sheet, stamp and signed by the examiner/valuation officer  Stamp for the enforcement for vehicles within 5 years to date. BELIZE TOURISM BOARD (BTB) – QRP PROGRAM  The BTB regulates the exemption for the Qualifies Retried Person Program.  The exemption is granted for new and used personal effects, a mode of transportation – motor vehicle, boat or airplane.  The original letter of exemption from BTB must be approved and signed by the competent officer of customs before attached to the SAD in the system.  The Customs department is responsible for defining the scope of personal and household effect.  Any item identified by the proper officer not falling within the definition has to be duty paid.  The exemption is now locked in the system and admin approval is done by customs.  A full listing of the personal effects, title for mode of transportation will accompany the exemption letter.  The above mentioned documents are certified by the BTB and only original BTB letters are accepted for approval. CENTRAL BANK OF BELIZE  The Central Bank of Belize restricts the movement of currency, bank or other notes which is or have been legal tenders in Belize, any treasury bills or any other monetary instrument.  Permission is granted under part IV of the Exchange Control Regulations.  All exportation of locally manufactured produce or re-exportation that involves monetary transaction must have an XCH2 Exchange Regulation form attached to the SAD.  No additional clearance is required. FISHERIES DEPARTMENT  This agency is responsible for the importation and exportation of all marine products.  The fisheries department issues a notice to export for all marine product.  Certain products such as the conch is also issued a phytosanitary form.  Exporter must apply for their notice to export five days before the date of exportation. DEPARTMENT OF ARCHEOLOGY  The Department of Archeology is tasked with the restriction of antiques, artifacts, ancient monuments, and other articles of archeological value.  A license must be obtained by the proper Minister and the Head of the Department of archeology for the importation and temporary or permanent exportation of all artifacts etc.  License must be attached to the SAD in the system for both importation and exportation and no other approval is necessary for ASYCUDA. INVESTMENT, POLICY AND COMPLIANCE UNIT – Gaming Control Board  This board is responsible for the restriction of all gaming machines where money is involved.  A license is issued for the importation of the following machines:  Slot machines  Roulette games  Poker machines Except games for amusement. Thank you!!!! QUESTIONS?
