WEEK TWO 2.2 THE LEGISLATIVE PROCESS OUTLINE The legislative process involves a number of different stages. Let’s outline the legislative process so as to explain the following terms: Bill First , Second and Third Reading of a Bill Royal Assent Commencement Lower House Upper House Commonwealth House of Senate Representatives New South Wales Legislative Assembly Legislative Council Victoria Legislative Assembly Legislative Council Queensland Legislative Assembly South Australia House of Assembly Legislative Council Western Australia Legislative Assembly Legislative Council Tasmania House of Assembly Legislative Council Australian Capital Legislative Assembly Territory Northern Territory Legislative Assembly With some exceptions, legislation can be first introduced into either the upper or lower house (in the bicameral parliaments). We call the house where legislation is first introduced the House of Origin. The other house becomes the House of Review. - Royal Assent – The Bill is sent to the King’s representative to receive Royal Assent - Publication – The Act is Published in the Government Gazette - Commencement – The Act commences operation as law. Finding a particular Act Note the way that legislation is named in Australia: Title Year Received Royal Assent (Abbreviated jurisdiction in brackets) Spam Act 2003 (Cth) You may need to find a copy of particular legislation, for example the Spam Act 2003 (Cth).
