STANDARD OPERATING PROCEDURES SECTION: 200.00 / Rules & Regulations Guideline: 213.00 Kelly Days Effective Date: Revision Date: 1/2023 213.00 KELLY DAYS 213.10 DEFINITION A Kelly day is a day off without pay, for the sole purpose of reducing the work schedule so the city does not have to pay extra straight pay or overtime pay. 213.20 Kelly Day Guidelines All shift personnel must take one Kelly day in each long cycle (240 hrs.). Kelly days do not accrue. Kelly days will be taken in full 24-hour increments. Personnel may be allowed to work their Kelly day, when taking their pre-scheduled Kelly day will create Overtime. The selection of who may work their Kelly day, when multiple people have a Kelly day on the same day, will be done by department seniority. Kelly days may be swapped or changed within the same cycle and must be approved by the Battalion Chief. Kelly days will be charged to shift personnel when their scheduled Kelly day passes on the calendar if off on any extended leave such as: Workers comp Sick Leave of absence…etc. KELLY HOURS 213.40 DEFINITION Time off without pay, for the sole purpose of reducing the work schedule to avoid paying extra straight time or overtime pay. Kelly hours are to be used in combination with Kelly days to maintain a firefighting work schedule of 212 hours maximum in a 28-day FLSA work cycle. 213.50 PROCEDURES The first time a firefighter takes time off in a cycle on any type of day, the first four hours will be charged as Kelly hours and the balance of hours charged against the appropriate account. After four hours of Kelly time has been used in a cycle, all time off will be charged hour for hour to the appropriate type of day off. If a firefighter is on payroll and working somewhere outside of the city (jury duty, court, etc.) Kelly hours do not apply. Kelly hours are not used in conjunction with Kelly days. 213.60 Kelly Hour Guidelines Time saved by application of the Kelly hour process will remain in the employee’s appropriate benefit bank and will be subject to the same rules as stipulated by city and department policy for that benefit. EXAMPLE: Holiday hours saved in an employee benefit bank because Kelly hours were used to balance the 212-hour work cycle must be taken prior to the end of the year or lost. The three people scheduled off at a time department policy still applies as well. Kelly hours are not sufficient reason for extending the city’s Holiday cut-off deadline. Firefighters who choose to use holidays or vacation time near the end of the year must realize no special provisions exist to extend any holiday/vacation cut-off date or allow more people to be scheduled off.
