Briefing Training 6^th^ Amendment -- Right to a Speedy Trial Good Morning SO! Got some great info from Detective Todd Williams regarding some rulings based on 6^th^ Amendment challenges. Thank you for bringing this up Detective Williams. Below is a brief explanation from Williams about the case and a link to the Supreme Court ruling. *Case law out of Nevada. A juvenile sex assault case out of Las Vegas was dismissed due to law enforcement not attempting to locate a suspect after an original charge arrest warrant was issued. The defense filed a motion to have the case dismissed as the defendant's sixth amendment right was violated, right to a speedy trial. The case was appealed to the Nevada Supreme Court and the Nevada Supreme Court upheld the district court's ruling and the case was dismissed.* *NLVPD took a case involving a juvenile sex assault. The detective established PC for the suspect's arrest. The suspect had since moved from Las Vegas to New Jersey. The detective was aware of the suspect's location and did not attempt to contact him or contact law enforcement in New Jersey. The detective submitted the case for a warrant and the warrant was approved. The warrant was then entered into NCIC, and the detective did no additional follow up to locate or arrest the suspect or contact New Jersey. The suspect was arrested 26 months after the warrant was entered and brought back to Las Vegas. The courts ruled it violated his right to a speedy trial even though he had no idea the warrant existed.* *This ruling has already resulted in a local case being dismissed as well.* This is absolutely something that could affect our cases at the SO, and not just in Detectives. It is also a great reminder that we have a duty to do our due diligence with all our investigations, felony or misdemeanor. I challenge you, Civilian and Commissioned staff, to take the upmost pride in the work you do and put in the time necessary to do your job to the best of your ability.
