Policy I-9: Disciplinary Procedures
I. Policy
- The West Palm Beach Police Department has established a uniform system for rewarding, counseling, administering discipline, and providing remedial training to agency members.
- The policy includes the rights of the accused member and the appeal procedure for disciplinary actions.
II. Definitions
- Administrative Reassignment: temporary duty reassignment with pay while an administrative and/or criminal investigation is being conducted.
- Discipline: action taken to correct undesirable behavior that is contrary to Departmental rules, regulations, directives, and policies.
- Disciplinary Variance: considers the severity of misconduct, time between violations, length and quality of service, and overall work performance.
III. Level of Authority for Discipline
- The Chief of Police or their designee has the authority to approve disciplinary actions, including recognition, counseling, and retraining.
- Recognition includes positive actions such as letters, nominations, awards, and certificates from schools, organizations, and agencies.
IV. Disciplinary Actions
- Verbal Counseling: a non-punitive measure to educate the member about deficiencies and avoid repeat offenses.
- Remedial Training: a non-punitive measure to correct specific job performance deficiencies.
- Written Reprimand: a disciplinary action that may be recommended by a supervisor and approved by the Chief of Police or their designee.
V. Investigation and Discipline
- Supervisors will thoroughly investigate incidents and ascertain if disciplinary action is necessary.
- The Chief of Police or their designee will review and approve or revise disciplinary recommendations.
- The Internal Affairs Unit will prepare a Disciplinary Action Form, which will be served to the member by their respective Shift Commander.
VI. Administrative Leave
- Administrative Leave without pay may be implemented for incidents involving a felony arrest or allegations of a serious nature.
- The employee must be provided with notice of the allegations, a Pre-Determination Conference, and maintenance of benefits.
- Members on Administrative Leave without pay will be compensated for police-related responsibilities and must make weekly telephone contact with the Professional Standards Commander.
