Appeals and Verification of Certificates
- The Assistant Commissioner of the revenue sub-division can pass orders allowing or dismissing an appeal and directing the issue of a caste certificate or an income and caste certificate to the applicant after giving both parties an opportunity to be heard.
Verification of Caste Certificate and Income and Caste Certificate
- The State Government constitutes Verification Committees for each district to verify caste certificates and income and caste certificates issued under sections 4A or 4B.
- Any person who has obtained a caste certificate or an income and caste certificate can make an application to the Verification Committee for issue of a validity certificate.
- The Verification Committee holds an inquiry and grants a validity certificate or rejects the application within thirty days.
Issue of Caste Certificate and Income and Caste Certificate
- Candidates or their parents/guardians belonging to Scheduled Castes or Scheduled Tribes can apply to the Tahasildar for issue of a caste certificate to claim benefit of reservation.
- Candidates or their parents/guardians belonging to other Backward Classes can apply to the Tahasildar for issue of an income and caste certificate to claim benefit of reservation.
- The Tahasildar holds an inquiry, satisfies himself regarding the genuineness of the claim, and passes an order issuing a caste certificate or income and caste certificate, or rejects the application.
- The burden of proving that the candidate belongs to Scheduled Castes, Scheduled Tribes, or other Backward Classes lies with the applicant.
Appeals against Orders
- Any person aggrieved by an order of the Tahasildar under section 4A can appeal to the Assistant Commissioner of the revenue sub-division within thirty days.
- Any person aggrieved by an order passed by the Verification Committee under section 4C can appeal to the relevant authority within thirty days.
Powers of Tahasildar and Verification Committee
- The Tahasildar and Verification Committee have the powers of a Civil Court while holding inquiries under this Act.
- These powers include summoning and examining witnesses, discovery and production of documents, receiving evidence on affidavits, requisitioning public records, and issuing commissions for examining witnesses or documents.
