Use of Force Policy Definitions

Approved Weapons: Weapons meeting Department specifications with officer proficiency and safety training. Pre-use communication to other officers and the subject is required when practical, along with a clear announcement to personnel in the immediate area unless exigent circumstances exist.

Articulable Aggravating Circumstances: Documentable factors that increase the severity or culpability of a crime, including heinousness, violence, or increased threat to others if the suspect remains at large.

Determining Objectively Reasonable Force

Objectively reasonable use of force guided by Graham v. Conner (1989) and subsequent legal interpretations, based on "totality of circumstances."

Factors to assess reasonableness involve:
- Crime severity
- Immediate threat to officer/others
- Suspect resistance/evasion
- Drug/alcohol/mental state
- Time available
- De-escalation resources
- Weapon proximity
- Environmental factors/exigent circumstances.

Officers should choose force options that safely de-escalate and control the situation. The emphasis is on objective, rather than subjective, reasoning.
Medical Attention
- Officers must seek immediate medical attention for any subject sustaining visible injury or injury complaint resulting from any use of force option, particularly those involving impact weapons, OC spray, tasers, canines, vehicle use, or any firearm use leading to injury.
Use of Force to Affect Detention, Arrest, or Search

Reasonable force is permitted to protect self/others, affect lawful detention/arrest, and conduct a lawful search.

When feasible, officers should make their intentions clear to the subject before using force.
Duty to Intervene

Officers must prevent unjustified force applied by other officers, regardless of chain of command.

Intervention is necessary when:
- Unjustified force is witnessed or reasonably should have been observed.
- It's safe to intervene.
Levels of Resistance

Suspects might resist due to various factors like medical conditions, mental/physical/hearing impairments, language barriers, drug/emotional crises – impacting approach.

Levels include:
- Compliant: No resistance
- Passive Resistance: Uncooperative, minimal physical resistance
- Active Resistance: Preventing custody without harm towards officer
- Aggressive Resistance: Intended harm towards officer/others
- Aggravated Aggressive Resistance: Likely to cause harm or death in actions or violence
Levels of Control
- Officers must assess the most objectively reasonable force option to safely control a situation.

Additional Use of Force Policies

Spit Hoods: Temporary protective device, for use only under strict conditions, to reduce the risk of disease exposure. Not to be used on/with subjects having difficulties breathing, vomiting, profuse bleeding, etc. Equipment removed prior to application.

Aerosol Inflammatory Agents: (e.g. pepper spray) can be used for self/other defence, restraining violent individuals including inmates and animals, used when overcoming resistance. Short bursts, no unnecessary use, consider bystanders/environments.

Batons: Defense, restraint, used as last resort when other options fail or are impractical, not to be used for punishment; only authorized strikes to allowed regions.

Less Lethal 12 Gauge/37mm/40mm Ammunition: Used in specific situations like controlling armed, threatening suspects, or crowd control. Must be fired at distance, not at the head.

Tranquilizer Gun/Rifle: Only used by Animal Control for animal restraint, not human beings.

Pressure Point Control Tactics (PPCT): Used strictly by trained officers for certain situations.

Folding Knife: Can be used for defense in extraordinary circumstances, when other methods have proven ineffective, with a focus on limited self-defense.

Conducted Electrical Weapons (CEWs/Tasers):
- Battery/cartridge-operated incapacitation devices for use in specific situations via designated ranges and target areas (torso/legs), in certain circumstances/conditions/settings.
- Alternative methods to ensure compliance considered prior to repeated use.
- Medical intervention, if required post-use.
- Officers will qualify and re-qualify using approved methods.

Firearms: Sworn personnel will receive initial and ongoing training before carrying firearms; authorized firearms/ammunition only; civilians may be authorized with training, qualifications, and permits.

Firearm Discharge: Firearms not discharged as warnings, unless in a deadly force encounter; any potential injury to innocent bystanders to be considered; mandatory supervisor immediate notification for intentional discharges and a memorandum for accidental discharges, including training or investigation if necessary.

Post-Incident Procedures: include: medical attention, supervisor notifications, public safety statements, and administrative/criminal investigations. Surrendering of firearms, testing, and potential administrative relief or return to duty (dependent on investigation outcomes and protocols).

Special Considerations/Deployment Tactics regarding tasers (and other weapons) must be considered.

- Safety concerns are paramount (e.g. exhaustion, pregnancy, elevated locations)

Force Review Boards

Purpose: Review all use of force incidents, considering reasonableness, policy/training deficiencies, weapon/ammunition compliance, potential lesser force alternatives, and necessary policy modifications.

Composition and Procedures: Vary depending on whether deadly force was involved, requiring different board compositions and meeting schedules. All investigations including those involving deadly force, injury and or death have specific procedures and documentation steps.

Jurisdiction Policies
- Concurrent Jurisdiction: Policies outline concurrent jurisdiction agreements/responsibilities of the NLVPD with LVMPD, CCSD Police, NHP, and other state and federal agencies. Specific areas of responsibility are identified, with specific procedures dependent on the context of involvement. Mutual aid between different agencies and departments regulated to ensure cooperative response.
- Jurisdiction Outside Corporate Limits: NLVPD may exercise jurisdiction outside city limits under certain conditions (e.g., fresh pursuit, mutual aid requests, logical investigative needs, particular criminal offenses).
Assistance to Other Agencies
- Policies outline procedures for NLVPD involvement in assisting other agencies (state, local, federal) in emergency situations with a focus on proper documentation and reporting, outlining procedures, conditions and processes to ensure all requests are in compliance with all relevant authorities.
