Omaha Police Department Policies
- Adult Protective Services Policy: OPD investigates reports of vulnerable adult abuse, neglect, self-neglect, or exploitation, per Nebraska Revised Statutes (NRS).
- Coordination: Works with the Adult Protective Services Unit of the Nebraska Department of Health and Human Services (NDHHS)
- Adult Abuse Definition: Any intentional act resulting in physical harm, unreasonable confinement, cruel punishment, sexual abuse, or exploitation. This includes neglect by caregivers or self-neglect.
- Essential Services: Includes necessities like food, shelter, medical treatment, and supervision for vulnerable adults.
- Exploitation Definition: Wrongful or unauthorized taking of vulnerable adult's/senior adult's money, funds, securities, assets, property, due to undue influence, breach of fiduciary duty, deception, extortion, etc.
- Financial Exploitation Definition: Wrongful or unauthorized use of financially vulnerable adults' money, assets, or other property, including by power of attorney, guardianship, or conservatorship.
- Vulnerable Adult Definition: Adults 18+ with substantial mental or functional impairment or with a guardian/conservator appointed under Nebraska Probate Code (Includes mental illness, retardation, cognitive conditions, senility).
- Definitions of related terms: OPD policy notably defines Isolation, Neglect, Physical Injury, Proper Supervision, Self-Care, Senior Adult, Sexual Abuse, Sexual Exploitation, Substantial Functional Impairment, Substantial Mental Impairment, and Unreasonable Confinement from NRS.
- Warning Signs/Reporting: Officers are trained to identify warning signs of abuse (physical, psychological, neglect) and victim behavioral signs (confusion, depression, fear).
- Incident Reporting: Officers complete detailed incident reports, including victim and caregiver information and the nature of the abuse.
- Notification: OPD Adult Special Victims Unit and Domestic Violence Squad are notified electronically of incident reports.
- APS Notification: The domestic violence squad prints, marks reports with "Attention APS," and faxes to appropriate agencies and parties involved.
- Sexual Assault Procedures: Officers follow specific techniques and adhere to the procedures in the OPD “Abuse/Neglect/Injury – Child” policy.
- Victim and Witness Immunity: Victims/witnesses of sexual assault are immune from prosecution for alcohol/drug offenses if they reported the assault/sought medical assistance, or if the evidence was obtained/discovered from these actions.
Accreditation Standards
- CALEA Assessment: CALEA conducts annual web-based assessments.
- Annual Status Reports: OPD's Accreditation Manager submits annual reports to CALEA.
- Four-Year Assessment: Every four years, OPD undergoes on-site CALEA assessments followed by a review and reaccreditation award by CALEA.
- Compliance: After reaccreditation, OPD maintains compliance with applicable standards.
- PowerDMS: OPD uses PowerDMS and shared RPU tracking lists for reports, reviews, and compliance standards.
- Tracking: PowerDMS/shared lists track deadlines and document inventories.
- Reporting: OPD sends periodic reports to the RPU as needed or on request.
Alcohol and Drug Testing
- Compliance: OPD complies with City of Omaha Human Resources' "Drugs and Alcohol" policy, incorporating the Omaha Police Officer's Association CBA.
