Traffic Investigations Unit Responsibilities
- Traffic Investigations Unit detectives (and higher-ranking officers) respond to and oversee pursuit-related accidents.
- Important Note: A pursuit terminated by a forced stop method is considered a use of force, not an accident, even with police vehicle damage.
- Incident commanders (or pursuit managers) investigate these incidents, and may request assistance from the TIU.
- When a suspect evades apprehension, the TIU (or appropriate division) investigates, identifies, and prosecutes the violator.
- The Denver Police Department vigorously pursues eluding charges against violators.
- Felony Charges: Incidents meeting the criteria in CRS §18-9-116.5 will be charged as felonies.
- Misdemeanor Charges: Offenses not meeting these criteria will be filed as misdemeanors.
Commanding Officer of the Traffic Investigations Unit - Responsibilities
- The commanding officer (or designee) responds to scenes and directs the investigation of any pursuit/eluding no-chase related accident resulting in death, serious bodily injury, or extensive property damage.
- When a violator fails to yield to an officer attempting a vehicle stop, but the incident doesn't escalate to a pursuit, the officer will document the event on a "Vehicular Eluding - No Chase" General Occurrence (GO) report.
- The commanding officer will ensure the investigation for possible prosecution of the violator, vehicle seizure, and inclusion in a database.
