    • The commissioners court may prohibit the accumulation of litter on a property within 30 days and 50 feet of a public highway.

    • The commissioners court may provide for the removal and disposal of litter and assess the costs against the property owner.

    • Before taking action, the court must send a notice by certified mail to the property owners, and may not remove or dispose of the litter or assess costs until 30 days after the notice is sent.

    • If the costs are not paid within 60 days, the county may attach a lien and file a record of the lien in the office of the county clerk.

    • The annual rate of accruing interest for unpaid costs is 10%.

    • The penalty for accumulating litter for more than 30 days on a property within 50 feet of a public highway is a Class C Misdemeanor.

    • The provisions of the transportation code apply to government vehicle operators as well as animal-drawn vehicles.

    • Persons, teams, motor vehicles, or other equipment traveling to or from work on a highway are subject to the provisions of the transportation code.
