- The Jessica Lunsford Act revises sexual predator criteria;
- The Jessica Lunsford Act requires quarterly reregistration by sexual predators;
- The Anti-Murder Act prohibits bail or other pretrial release for specified violent felony offender of special concern and certain arrested persons pending a probation violation or community control violation hearing.
- An arrestee charged with a crime under Florida Statute Chapter 874 is not eligible for release on bail or surety bond until first appearance.
- In determining bail, the first appearance judge shall consider the safety of the victim, the victim's children, and any other person who may be in danger if the defendant is released, and exercise caution in releasing defendants.
- Subsequent paperwork signed by the judge that addresses terms and conditions of release satisfy the intent of Florida Statute, making the release appropriate as long as there are no other active processes, outstanding warrants, or specifically noted hearings.
- An offender arrested on a new felony charge will be held without bond until first appearance.
- After first appearance and a determination of probable cause has been made, Classification Unit staff shall place a hold on the offender for an alleged violation without bond for a period not to exceed 72 hours, excluding weekends and holidays.
- Notify the Florida Commission on Offender Review within 24 hours of the finding of probable cause via: c.
- Once a warrant has been issued, or if the offender is in custody as a result of an existing warrant issued by the Commission for violations, the offender must be held without bond pending a revocation hearing.
