Procedures for Subpoenas and Court Appearances for Port St. Lucie Police Department
- Witness Subpoena is a written command to appear before a judicial, administrative, or legislative body having the body and authority to summon witnesses.
- Court Liaison is responsible for receiving and recording all subpoenas.
- The Court Liaison will check if the concerned officer or police personnel will be available to be served with a subpoena.
- Subpoenas will not be accepted for officers or police personnel who are no longer employed by the Police Department.
- If an officer cannot appear as ordered by the subpoena due to medical reasons, emergencies, or other reasons, it shall be the individual's responsibility to contact the Court Liaison and the attorney who has requested the issuance of the subpoena.
- Notices to Appear, when received by the Department, will be immediately forwarded to the Court Liaison.
- Individual officers on suspension from the Department will be required to appear in court as ordered, in appropriate civilian attire.
- Subpoenas that are issued for State Attorney Hearings, Depositions, and Traffic Court will be entered by police personnel on their TeleStaff calendar immediately upon receipt.
- Service of subpoenas to the Court Liaison via the Sheriff’s Department, the St. Lucie County Clerk’s Traffic Division, and the State Attorney’s Office constitutes service on an officer.
- Officers will be responsible for checking the status of cases for subpoenas accepted for various types of hearings.
- The State Attorney’s Office attorney in charge of the specific case is responsible for contacting the Court Liaison to notify of a pending trial.
- If an officer requires a subpoena to be served on a witness for Traffic Court, the request will be in writing to the St. Lucie County Clerk’s Office in St. Lucie West.
