Forms, Filings, and Compliances
- Taxpayer Identification Number (TIN) is required for individuals and juridical persons to comply with Internal Revenue Code. This TIN is indicated on tax documents submitted to the Bureau of Internal Revenue (BIR).
- Different application forms (BIR Forms 1901-1904) are for different types of applicants including self-employed, those with mixed income, purely compensation income, Overseas Filipino Workers/Seamen earning foreign-sourced income, corporations, partnerships, and one-time taxpayers.
- Taxpayers must register with the appropriate Revenue District Office (RDO) before commencing business or operation with jurisdiction over head office, branch offices, place of production, and storage place.
- Registration can also be done through the BIR's Online Registration and Update System (ORUS).
- Certificate of Registration (BIR Form 2303) is issued upon successful registration.
- Cancellation of registration is possible due to business closure, cessation, or termination using BIR Form 1905 (Application for Registration Information Update).
- Annual registration fees (BIR Form 0605) are due on January 31 and amount to P500 for each separate or distinct establishment or place of business.
- Income tax returns have different forms and deadlines. Individual income tax returns (BIR Form 1700, 1701, 1701Q) are due on April 15, May 16, Aug 15, and Nov 15. Corporate income tax returns (BIR Form 1702, 1702Q) are due on the 15th day of the 4th month and 60 days from the quarter's close.
- Capital gains tax returns for domestic stocks (BIR Form 1707, 1707A) are due 30 days from the sale date and 15th day of the 4th month. Capital gains tax returns for real properties (BIR Form 1706) are also due 30 days from the sale date.
- Documentary stamp tax returns (BIR Form 2000, 2000-OT) are due 5 days after the end of the month.
- Transfer taxes (VAT, Percentage Tax, Excise Tax, Donor's Tax, Estate Tax) have different forms and deadlines. VAT is due 20th, 25th days after the month end for Monthly and Quarterly taxes. Percentage tax is due 25 days after quarter end. Excise tax is due before removal to customs; Donor's Tax is due 30 days from the donation date, and Estate tax is due one year after the decedent’s death.
- Withholding taxes (compensation, expanded) have forms and deadlines. Compensation tax is due 10th day of the following month for most tax return filings. December compensation is due on the 15th. Expanded is due on the 10th of the following/next month.
- Withholding tax certificates (BIR Form 2304, 2306, 2307, 2316) have specific requirements/purposes.
Tax Filing
- Manual filing is an offline method using eBIRForms.
- eFiling is the electronic method using the internet (eFPS or Online eBIRForms).
Rule on Amendment of Returns
- Returns, statements, and declarations cannot be withdrawn but can be modified, changed, or amended within three (3) years from the date of filing.
- No modifications after a tax audit/investigation notice.
- Tentative returns become final unless a final amended return is submitted.
Open Cases
- "Stop filer case" refers to cases wherein the Returns Compliance System (RSC) identifies registered taxpayers that failed to file their tax returns by the due date.
BIR eServices
- eRegistration System (eReg) handles TIN issuance, registration fee payment, and certificate generation.
- Electronic Filing and Payment System (eFPS) processes and submits tax returns and payments electronically.
- eBIRForms allows taxpayers to prepare and submit tax returns. eAFS (Electronic Audited Financial Statements) are used to submit ITR(Income Tax Return), Audited Financial Statements (AFS) and required attachments online.
- ePayment Channels for AABs (e.g., online payment, credit/debit cards, mobile) provide electronic means for paying taxes.
- eONETT System facilitates One-Time Transactions (e.g., sale of real properties) transactions pertaining to real properties.
- ORUS (Online Registration and Update System) for registration and updates.
