Study Notes

Halting Allowance

  • Provided for officers on travel duty
  • Payable for each period of 24 hours or any subsequent part thereof, reckoned from the reporting time for departure in the case of air travel, and the scheduled time of departure in other cases to the actual time of arrival
  • Where the total period of absence is less than 24 hours, “per diem” shall mean a period of not less than 8 hours
  • Rates of halting allowance:
    • Where the total period of absence is less than 8 hours but more than 4 hours, halting allowance at one-half of the above rates shall be payable
    • Where lodging is provided at bank’s cost/arranged through the bank free of cost, 3/4th of the halting allowance will be admissible
    • Where boarding is provided at bank’s cost/arranged through the bank free of cost, 1/2 of the halting allowance will be admissible
    • Where lodging and boarding are provided at bank’s cost/arranged through the bank free of cost, 1/4th of the halting allowance will be admissible

Inquiry Proceedings

  • Inquiring Authority may act on evidence recorded by its predecessor or partly recorded by its predecessor and partly recorded by itself
  • If the succeeding Inquiring Authority is of the opinion that further examination of any of the witnesses whose evidence has already been recorded is necessary in the interest of justice, it may recall and cause that to be examined, cross-examined and re-examined
  • The Inquiring Authority shall prepare a report containing:
    • A gist of the articles of charge and the statement of the imputations of misconduct
    • A gist of the defence of the officer in respect of each article of charge
    • An assessment of the evidence in respect of each article of charge
    • The findings on each article of charge and the reasons therefor

Appeal Against Punishment or Suspension

  • An officer may appeal to the Appellate Authority against an order imposing upon him any of the penalties specified in rule 67 or against the order of suspension referred to in rule 68A
  • Appeal shall be preferred within 45 days from the date of receipt of the order appealed against
  • The appeal shall be addressed to the Appellate Authority and submitted to the authority whose order is appealed against
  • The Appellate Authority may pass an order confirming, enhancing, reducing or setting aside the penalty or remitting the case to the authority which imposed the penalty or to any other authority with such directions as it deems fit in the circumstances of the case

Leave Encashment and LTC/HTC

  • Facility of leave encashment with leave travel concession may be extended to the officers as per extant norms
  • The encashment has to be sanctioned and credited preferably before the salary date of the last month of retirement to take care of TDS etc., but in any case, not beyond date of retirement
  • If an officer fails to proceed on LTC/HTC within the extended period after retirement, the amount of leave encashment along with consequential tax liability, if any, will be recovered from the officer
  • The above leave encashment will have no bearing and will not affect Rule 38 (i) of SBIOSR 1992, where an officer when retires from the Bank’s service, shall be eligible to be paid a sum equivalent to the emoluments of any period, not exceeding 240 days of privilege leave that he had accumulated

Provident Fund and Pension

  • If joining time is granted in continuation of leave, the last day of leave shall be the day preceding the day on which joining time commences
  • No joining time shall be admissible to an officer when the transfer does not involve a posting to a different place
  • No joining time will be admissible to an officer when his posting is of a temporary nature, irrespective of the fact that posting is to a place or station other than the one at which he is permanently posted

Conduct, Discipline, and Integrity

  • Every officer shall conform to and abide by these rules and shall observe, comply with and obey all lawful and reasonable orders and directions which may from time to time be given to him by any person under whose jurisdiction, superintendence or control he may for the time being be placed
  • Every officer shall undertake and perform his duties as an official of the Bank in such capacity and at such place as he may from time to time be directed by the Bank
