Residency in India: Basic Conditions
- An individual is considered a resident in India if they are present in the country for at least 182 days during the current financial year or 60 days during the current financial year and 365 days during the preceding four years.
Residential Status Based on Duration
- An individual present in India for at least 730 days during the 7 immediately preceding years is classified as a resident.
Status of Non-Registered Business Organizations
- A business organization not registered in India is considered a non-resident for tax purposes, regardless of its operations within the country.
Additional Conditions for Individual Residency
- In addition to the basic conditions, an individual may be considered a resident if they meet either of the following:
- Seems to stay in India for 182 days or more during the financial year.
- Total stay in India during the previous 4 years is 365 days or more and stays 60 days or more in the current year.
Basic Condition for Organizations
- Any person, shop, institution, company, or business organization is considered a resident in India if they are registered or incorporated in India, or if they have a place of business or an office based in the country.
